PETITION TO HONOR JUDGE CRESPO.

One may argue against a court-room dedication for Judge Crespo WITHOUT insulting Judge Crespo. As has been pointed out, we have lost many judges while they served. Why are we to honor Crespo but not Levine, Dakis, et al? Why are we to honor Crespo over those judges who served, retired and then died? Judge Crespo was a fine and honorable man, but so are a great many other judges who sit and have sat in Miami-Dade County over the past 100 years.

Judge Lenny Glick has posted that Judge Scott Silverman, our official historian, has opined that it is the within the purview of our county commission to name a courtroom. If Judge Scotty says it, it must be right. As such, I have take the liberty of preparing a petition to be circulated in our community and sent to the commission.
I do this fully mindful of and obedient to Canon 4 of our Code of Judicial Conduct encouraging judges to Engage in Activities to Improve the Law, the Legal System, and the Aministration of Justice.

I do not, in any way, mean to denigrate fine jusrists and good friends such as Judges Henry Leyte-Vidal, Linda Dakis, Steve Levine or any of the other fine judges mentioned in the blog as deserving of recognition. I do this to celebrate and remember the life of one of us who was truly unique. I am the first to say: Though I've kidded you and berated you, by the living God that made you, you're a better man than I am, Manny Crespo.

The following petition can be signed in my chambers at the REGJB--602. Copies will be provided to all who wish to get others to sign. All signed petitions should be sent to my office for collection and forwarding to the commission:

Whereas: Judge Manny Crespo was a consummate public servant.
Whereas: Judge Manny Crespo strove on a daily basis to provide our community with fair and equal justice for all.
Whereas: Judge Manny Crespo has raised the bar of public service by devoting so much of his “work” time and his “free” time to assure our community that equality, fairness and justice are not simply cherished, nebulous concepts, but a reality to which we can aspire.
Whereas: Judge Manny Crespo should serve as an example to us all, but especially to those of us who labor in our courts.
We the undersigned, most respectfully, request the Miami-Dade County Commission name a courtroom in the Richard E. Gerstein Justice Building the Judge Manny Crespo Memorial Courtroom.
The courtroom to be so named shall be designated by the Chief Judge of the 11th Judicial Circuit of Florida.

Judge Pineiro's heart may be in the right place, but his petition drive certainly violates Canon 5, which prohibits using the office of judge to conduct solicitations, whether for funds, membership, or any other purpose. Every lawyer who appears before the good judge will wonder if failure to enter chambers to sign the petition will have adverse consequences for the lawyer or client. This is precisely the type of judicial coercion that Canon 5 prohibits. If the name-a-courtroom-for-Crespo idea has merit, it will have community support without lobbying by judges. And if it does not have that kind of community support, it is not entitled to impermissible lobbying by the judiciary. At the very least, Judge P should seek an Advisory Opinion before undertaking such questionable activity.

In response to 3:17:36 PM. You are absolutely right. It never occured to me that someone might be concerned that failing to sign the petition would incur my animosity--for the simple reason that it never would as this has nothing to do with any case. What is personal should always stay personal.

However, I should always shy away from the appearance of impropriety so I thank-you for you advice and will follow it. However much I would like to assume an active role in the promotion of a memorial, I will simply sign the petition and turn it over to anyone who wishes to be responsible for distribution, collection and forwarding to the Miami Dade Commission.
The petition, sadly, will no longer be available in chambers, but I am sure someone will be able to run with it. Again thank-you for pointing out a stumbling block which should have, quite frankly, been obvious to me.

If Rumpole may interject as a mediator (a role we are otherwise wholly unsuited for) in this matter, it seems to us that honoring the memory of Judge Crespo does not demean the memory of Judges Dakis, Levine, Leyte-Vidal and others. Judge Crespo has friends who wish to extend this honor in his memory. We support the naming of courtrooms after all of these Judges, and probably others as well. But since Judge Crespo volunteered for weekend bond duty frequently, and volunteered every Monday to address and swear in prospective jurors, it is all together fitting and proper (to steal a line from President Lincoln) that we remember him by naming either the Jury Room or the bond hearing courtroom after him.


To answer Sam I Am, it seems illogical to argue against honoring Judge Crespo because others are equally deserving of the same honor. Why not honor all departed Judges? Judge Crespo has his close friends and supporters and it is up to the friends of the other Judges to do the same.

To address Judge Pinero's concerns the Petition should be given to your friendly neighborhood FACDL Justice Building Rep, who can post it in the attorneys' room on two, the coffee shop on seven, and Au Bon Pain.

Sorry for the slow posts, but this thing is spinning out of control. Judge Phil Knight would have had this thing over with in two days.

  5. No one responded to the query about certification in specialized law fields, e.g., criminal trials. Is it a respected credential? Merely a fee generator for the Bar? Why so few - are the standards impossibly high? The test too hard? Are lawyers retained on bases other than merit and experience, rendering certification no big deal? What's the scoop?

  8. Gerstein's Chief Investigator, Martin Dardis, who died recently, "followed the money" and found Nixon campaign dollars paid for the Watergate burglars and dirty tricks. The key check went through a Miami bank. They were set to prosecute Nixon, et al, until the Watergate Special Prosecutor asked them to defer to a federal prosecution. Then Ford pardoned Nixon and the rest is just history.

    Basically this should have been our warning that Miami was about to become the scandal capital of the nation.

    I don't know if it's respected or not (I would assume so), but with all the discussions about non-qualified judges perhaps there could be some sort of certification/exam prior to being eligible to run for judge.
    Why not? Make them take a real (not renting videos) course and study and pass a certification before putting in their money.

  14. If they have to take a test, make it specific to their future assignment. Let every judge who sits in criminal court pass the Bar's certification test for criminal trials as a pre-requisite to sitting. If they are going to decide which attorneys are correct, maybe they should know some of the correct answers themselves.

    Unfortunately judges often change divisions, civil to criminal etc, so a general knowledge certification exam would probably be more appropriate.
    Practical experience, may not be a realistic test because there are some people, mainly civil practitioners (in my mind) who may be very good judges but may not have done 'typical' trial work.

    The 3rd DCA named the law library in the Court after former Chief Judge Alan R. Schwartz and he is alive.

    I like the gallery of paintings in memory of Judge who retired while in office and/or died while in office.

I will say one thing, when you try to win an election by going at it in a dirty way as she is, it will not succeed. Yes, like I was advise by a blogger one should be professional about their acts, that same advise needs to be told to "Parks" as well.

    For now, I apologize to the bloggers, but not to "Parks" and when the time comes, it will be posted. But, it will be a while before I do.............

    This is Cathy Parks. I read the Blog weekly, usually on a Saturday morning, as I'm doing now, because I find it interesting, informative and, sometimes, amuzing. I do not know who you are or what you are about, but I take great offense at your continuous unfounded nasty allegations and insults that are directed to me. What I do know is that I have received hate mail in my mailbox, hate mail that was illegally placed in my mailbox by someone who trespassed on my property, for which a police report was duly filed.   44. I'm not a fan of naming public property after people. But in Miami, it seems to be the way to remember deceased friends. If we follow that path, though, before long, every courtroom, jury room, closet, and office will be named after a deceased person who was popular in life, and the courthouses will become just like the streets of Miami. Won't that be meaningful? And confusing, when in a few years no one knows anything about the persons whose nameplates adorn the doors. And imagine the confusion for persons not familiar with the Justice Building: "You have to be in Judge Glick's courtroom, which is called the Judge Crespo courtroom." At least with a portrait, a passerby has some sense of the person connected with the name being honored, without confusion. And, not to be personal, but every courtroom in every courthouse in Miami belongs to me -- and more importantly, to my clients -- and to you and your clients -- not to a single judge, living or deceased. It's one thing to build a monument to a person, like the Ben Willard memorial in the parking lot across from the Justice Building (quick test: Who was he and why did his friends memorialize him?) -- but it is quite another to rename a public courtroom or jury room like it was paid for with the donations of a congregant. Manny deserves to be remembered, but not by giving his name to one of everyone's courtrooms. A portrait is just fine, to be placed in a suitable location that it can be seen and contemplated while one awaits (1) a jury verdict, (2) a bond hearing, (3) a calendar call, or (4) a late judge. (Answer to Ben Willard quiz: He was a cranky old judge who scared the right of jury trial out of every "boy" to appear before him. In his time, at least, someone thought we should remember him.]

  51. Manny was a real nice guy off the bench, however while he wore the rob he was not such a great person. In fact, many will argue and argue correctly that Manny Crespo was a joke of a judge. manny did not follow the law, and his antics on the bench would be a highlite for a comedy show.

    Manny Crespo's courtroom was a laugh of laughs. Manny insulted people, played favorites with his Cuban brothers and those who donated to his campaigns. In fact, I recall sitting in a Manny's courtroom and watching him scream and yell, and then wink at the defendant.

    The truth is Manny used the bench to live his life, not to help society. I have been told that Manny has done everything from let a man walk out of his courtroom with no bond and promise to surrender himself after being given a five year prison sentence (the man did not show up and is now missing) to let a women fake a pregnancy and escape (and Manny never asked for medical records). Manny had defendants bring thei girlfriends up so he could look at their chests and he screamed on and on about the breasts.

    Unfortunately I did not get to practice in front of Manny, but from these stories I heard, he was a character, not an honored man that we should dedicate a courtroom to.

During the course of the conversation I told her that I never wanted to exist in a vegetative state, dependent on some machine and taking fluids from a bottle.

    Saying you've got some info and not sharing it is unfair to Parks and makes you look stupid. You can't expect her (or anyone else) to respond to accusations you won't make (the fact that you won't say what the accusation is makes me think you're the one who's being dishonest).

  70. The problem is, I want to give "Parks" a chance to come open and tell the group. What she did involves many other candidates, not just one. Parks, should really come out and say it herself. However, if she does not, it will come out. I can not post yet and there is a reason for it. I don't mind looking like the bad one or being called names or that I need to be sent to a mental place. Those are just words, they don't hurt. I don't like it, but that is part of life. Enjoy your weekend.

  80. Ms. Themis, I saw you campaigning for Mendez, why are you so gung ho to attack a very nice and consciensious person like Catherine Parks. Please stop attacking her, it is not right. You might be dead set on campaigning for your canididate Tinkler, but that does not give you carte blanck to attack someone we know very well and care for. Please refrain from these dirty tricks and just campaign for your candidate without insulting others. By the way this is NOT Catherine Parks, contrary to your skewed view, not every blog about Cathy is written by her. She does have a lot of friends who care about her also!!!   86. The big losers in this primary election were Lorenzo and Levy's candidates. Lorenzo and Levy raked in a lot of money this time, but few candidates will hire them again because their guru reputation is gone.

Rima, it is funny what you wrote to me, you were so nice when asking me to give out your cards! You mention "the lady you were payinf dropped you and you were looking for someone or if we (those) that were around me at the time if we knew of anyone that would pass out your cards. One of the ladies took you telephone number. I turned you down! I remember you telling me "both" ladies were your friends! I did not speak much to you! I am not on the campaign committee for one and of course I vote for Marisa. Will even though everyone wished you luck, I saw you were defeated in the first primary. P.S. all the best!
