TUESDAY MORNING HEADLINES

(for those smart and educated readers who disdain CNN and the NY Times and get their news here;

ON A SERIOUS NOTE:

Maybe it’s time to back things down on the blog a bit and have a serious discussion on what the death of Fidel Castro will mean to our fair city.

Lawyers should write in with memories about working in the REGJB during the Mariel Boat Lift. Who remembers going into the building with the National Guard outside?

How has the Cuban diaspora (8:22 ASA-did we spell and use that word correctly?) changed Miami?

Was Miami changed for the better, or worse?

When Cuba does open up, what business opportunities will exist for attorneys in Miami?

Will Judge Farina open a Havana Branch Court?

Will those attorneys banned by Brummer be allowed to travel to Cuba?

Can you get a good cup of Café Cubano in Cuba these days?
How about Cuban toast?

How many Cuban/American attorneys would consider going to Cuba to live and work?

Will Castro's illness effect the upcoming judicial elections? What candidates will seek to capture the renewed anti-Castro feelings that are running through the streets of Miami?

One thing is for sure: The death of Castro will inexorably affect our fair City as much as, if not more, then the Cuban Revolution.

Interesting times await us all.

Rumpole, on Hernandez, I think you should call Libre and speak to the Editor for the real details as he has always placed pictures with contact information in the past without asking for permission. Ask previous candidates. I mean, if Hernandez is in vilation, then Faber seems to be endorsed by the Supreme Court, President Bush and other candidates as per the website we are not suppose to see. I say, clarify this or also get on Faber for his lack of morals for allowing that site to go on for this long.

  24. If Hernandez is seeen as a problem, how about the Judges who beat the incumbents who are supposed to have been ran by Hernadez's allies? You have to be fair and bash evenly, not just him. I mean, you say that he is bad and that it is illegal to run against sitting judges which I think is lots of BS. Regardless, the Judges who replaced the sitting Judges or receive what is seen as help should be the focus of the hate this blog puts forth. Let's start with Ivan Fernandez, Diane Ward, Marti Shapiro, etc. Fair is Fair.

  38. I think that all the juvenile cases that Faber was assigned should be checked as his statement show that he may not have done the job of a public defender correctly? Why? Finding someone guilty before an actual finding or court ruling? According to a civil attorney I just spoke with, those banned by Brummer can sue the PDO for defamation and slander if the bans are based on reasons that relate poorly upon their character and are false. Considering that neither Lynn, Gabe, or Dave was fired from the PDO, it is unlikely that anything they did while there would give rise to a proper ban after they left. Could be some nice $ in it for them.

    You really blew it this time. Samuels (sorry ,but I can't refer to him as "Judge") got himself elected by telling voters that they should not re-elect a judge who had been a ... (Jaws music here) criminal defense attorney. [Thankfully, former criminal defense attorney and terrific judge Kevin Emas was reappointed and went on to the circuit court.]

    Included in the advertisement was a picture of a dark faced man looking out from behind jail bars (can you say Mel Gibson plays Samuels in the movie).

    When he was in branch court, Samuels could be found at the local Denny's having breakfast at 10:30 a.m. (true story; I saw him there after court).

    As a criminal (and Constitutional rights) defense attorney, I believe that someone who uses such tactics to get elected is unworthy of the bench.

All I did was report what the Bar said and make some sarcastic remarks. If you think that was offensive, wait until you read "Judge Hernandez, the movie." Boy will that piss you off.     RESPONSE: Not that I wish the guy illness but anyone [Samuels, in his campaign against Judge Emas] who states in media ads that the voters should remove the sitting judge "because he used to be a criminal defense attorney" and then shows a drawing of a dark colored man sitting behind jail bars is worthy of condemnation, not well wishes.

I ponder that question, not as an immigration attorney, but as someone who's wondering what the hoopla is all about. Will the free-for-all boat people stop?   72. Has anyone looked into Migna Sanchez-Llorens' campaign "Loan" of $25,000 to her campaign on 9/14/05 and the same day a campaign check written to attorney Robert Pertierra for "Consulting Services." Sounds a little bit fishy to me. I wonder if they are looking into it at 1350 N.W. 12 Avenue.
    What was this $25,000 for? Pertierra has no campaign experience. What kind of consulting did he give Migna? Perhaps, it was for other not so kosher purposes.

    Highly respected, Chief Judge Joseph P. Farina, wrote to the Judicial Qualifications Commission "J.Q.C." regards several complaints his office received against Judge Ivan Hernandez and his JA, obstructing the access of litigants to Judge Hernandez's court. CLICK HERE to view the letter.
    Bennett H. Brummer, the top defender of the poor in his capacity as PUBLIC DEFENDER of Miami-Dade County, wrote to Chief Judge Farina complaining about Judge Ivan Hernandez and his JA, Juan D'Arce. CLICK HERE to view the letter.

    Highly respected, Attorney, Don S. Cohn, wrote to Chief Judge Farina complaining about Judge Ivan Hernandez and his JA, Juan D'Arce. CLICK HERE to view letter.




    In 2006, Judge Ivan Hernandez a South Florida County Court Judge decided to ignore his duty to promote public confidence by continuing to employ his Judicial Assistant after the Judge's office was raided by the Miami-Dade State Attorney's office under a criminal subpoena. Judge Hernandez court house computer was seized in early March 2006, as part of the Miami-Dade State Attorneys Office public corruption criminal investigation against the Judge and his Judicial assistant.

    The Judge's right hand and judicial assistant also made several anti-Semitic slurs against highly respected administrative Judge Steve Leifman, because the administrative Judge had informed Judge Ivan Hernandez that he was getting numerous upon numerous complaints from litigants about the judicial assistants rudeness and obstruction of access to the court.

    Judge Ivan Hernandez who is fortunately up for re-election this year will be facing opposition for his judicial seat. O.R.J. urges all who vote this year to restore justice and remove Judge Ivan Hernandez by voting for highly respected Attorney Robin W. Faber.




    In addition to the criminal investigation Judge Ivan Hernandez, recently had a "show cause order" (writ of mandamus) issued against him by the Third District Court of Appeal, after his judicial assistant Juan D'Arce was rude and repeatedly denied a litigant access to his Court.     Judge Samuel J. Slom (the Administrative Judge overseeing Judge Hernandez), tells the Miami Herald on May 30, 2006, that he has received numerous upon numerous complaints about Juan D'Arce being rude, insensitive and obstructing the access of litigants to the Court.     Highly respected, Chief Judge Joseph P. Farina, wrote to the Judicial Qualifications Commission "J.Q.C." regards several complaints his office received against Judge Ivan Hernandez and his JA, obstructing the access of litigants to Judge Hernandez's court. CLICK HERE to view the letter.

    In 2006, Judge Ivan Hernandez a South Florida County Court Judge decided to ignore his duty to promote public confidence by continuing to employ his Judicial Assistant after the Judge's office was raided by the Miami-Dade State Attorney's office under a criminal subpoena. Judge Hernandez court house computer was seized in early March 2006, as part of the Miami-Dade State Attorneys Office public corruption criminal investigation against the Judge and his Judicial assistant.

    The Judge's right hand and judicial assistant also made several anti-Semitic slurs against highly respected administrative Judge Steve Leifman, because the administrative Judge had informed Judge Ivan Hernandez that he was getting numerous upon numerous complaints from litigants about the judicial assistants rudeness and obstruction of access to the court.

    Judge Ivan Hernandez who is fortunately up for re-election this year will be facing opposition for his judicial seat. O.R.J. urges all who vote this year to restore justice and remove Judge Ivan Hernandez by voting for highly respected Attorney Robin W. Faber.




    In addition to the criminal investigation Judge Ivan Hernandez, recently had a "show cause order" (writ of mandamus) issued against him by the Third District Court of Appeal, after his judicial assistant Juan D'Arce was rude and repeatedly denied a litigant access to his Court.     Judge Samuel J. Slom (the Administrative Judge overseeing Judge Hernandez), tells the Miami Herald on May 30, 2006, that he has received numerous upon numerous complaints about Juan D'Arce being rude, insensitive and obstructing the access of litigants to the Court.     Operation Restore Justice is geared toward exposing corruption in the Florida Court system. The web site is here to expose the very rare cases in which a Judge or those under the Judge's control violate the publics trust.

    The Supreme Court of Florida has set a path of rooting out judicial wrong doing at all levels. The Supreme Court has released numerous opinions over the past few years making it clear to the general public that it will not tolerate violations of the code of judicial conduct either by a sitting judge or a candidate for judge. Recently the Supreme Court of Florida removed a judge from office because of violations of the code of judicial conduct that happened during his judicial campaign to become a Florida Judge.

    All citizens of Florida can be sure that our highest court will NOT tolerate violations of the Code of Judicial conduct at any level. Our supreme court is not shy in expressing its condemnation of any Judge who violates the public trust by not following the code of judicial conduct.

    Operation Restore Justice is under the control of a private citizen. It was due to the criminal investigation presently against Judge Ivan Hernandez and his Judicial Assistant, by the Miami-Dade State Attorneys office which has resulted in the seizure of the Judges computer under a criminal subpoena, that Operation Restore Justice was born in early 2006. In addition to complaints from numerous litigants of being denied access to Judge Hernandez court and Racial slurs by his Judicial Assistant against the administrative Judge.

    Florida has some of the best Judges in the world. We cannot let a handful of bad apples destroy the prestige of Florida's judicial system. The Supreme Court of Florida through its recent opinions has demonstrated that it will NOT tolerate judges who do not follow the code of judicial conduct.
