  9. NOW MAYBE WE CAN DISCUSS MORE RELEVANT ITEMS:

    JUDICIAL ELECTIONS:

    Here is the backdrop: The President of the Florida Family Policy Council, lawyer John Stemberger, is also a Bush appointee to the Orange County Judicial Nominating Commission.

    The Council, is a Christian conservative group that is for "pro-life, pro-family values in the Legislature and in the public square". The group goes on to state that "we will endeavor in all that we do to be people of good faith and good will in making the case for Biblical family values in the public square."

    Why is this important to us way down here in Miami-Dade County?

    Because Stemberger's group is mailing questionnaires to all the judicial candidates and expects them to respond to questions having to do with court rulings on abortion, gay adoption, school vouchers, assisted suicide and gay marriage.

    His group will compile the survey results and then print 1,000,000 (that's MILLION) pamphlets to be distributed to churches and other locations.

    Will the candidates running in Miami-Dade County respond to the survey?

    OR will they follow the dictates of the Judicial Ethics Advisory Committee. Chairman and Judge Robert Benton has stated that, "a judge's job is to ascertain what the law is and to apply it even-handedly. A judge's personal philosophy is not an appropriate basis to decide legal questions."

    THEREFORE, THE CAPTAIN HEREBY ISSUES THE FOLLOWING DICTATE:

    TO THOSE JUDICIAL CANDIDATES OF THE ELEVENTH CIRCUIT, MIAMI-DADE COUNTY:

    If you decide to respond to the questionnaire of the Florida Family Policy Council, or any other group's questionnaire, which asks you to give your personal views on such issues as "whether you are a born-again Christian", or whether you support gay rights, gay marriage, or gay adoption, etc.,

    YOU SHALL NOT BE WORTHY OF THE SUPPORT OF THE LOYAL READERS OF THE RUMPOLE BLOG.

    All these other groups that offer so-called endorsements; what do they ask judicial candidates?
    Does the Latin Builders association ask how a candidate feels about Latins? Does the PBA ask if a candidate likes police officers? This whole endorsement thing is a pile of crap and I agree with you that none candidates should answer the hypocritical family council's questionnaire.

First, Captain is incorrect in assuming such inappropriate questions are asked by those endorsing the candidates - it would clearly be illegal for the candidates to answer such questions. Second, you Mr. Alvarez are not endorsed by any organizations and would like to discredit your opponent's endorsements via the blog. As several others have noted - this blog is not for the benefit of candidates and you should try to campaign in person or on your website. You should not use this as your personal campaign-grounds.

  15. NORTH OF THE BORDER...

    I swear this is true and it happened to me this morning north of the border:

    Your case starts off uphill when you draw certain blonde, female judges on the 7th floor in Broward anyway, but I had to deal with an ASA who does more than joust with Dade lawyers...this guy is just plain nasty.

    Case is set for a bond hearing. I know what you're thinking...BOND? in BROWARD? Imagine the gaul to seek a bond on a third degree felony.

    Client has been in custody 40 days, NO BOND, with no info in court file. Special Unit ASA wont let me see the PC affidavit. I ask him "why"?, he says because youre from Miami. Thinking hes joking I say, "we dont treat you guys that way, but if you are going to use it during the bond hearing, you should let me see it". He relents.

    He gives it to me and the hearing ensues. Clerk digs up an information at the request of the judge.

    My guy has a long rap sheet of priors. A bond is set at the reasonable amount of $1,770,000.00 (i swear) for 4 third degree felonies, all economic.

    After the hearing I ask the ASA what the client scores. While looking at the scoresheet I try to make some small talk to lighten the mood. I mention that I was an ASA. "That doesnt impress me", he says. "It musn't have been in Broward".

    He then tells me (and i swear this is true) that i should "...go back to Miami and not come up to Broward and practice". (maybe hes right considering my success at the bond hearing).

    He says "the law is different here". I reply, "And youre the sherrif?"

    Court adjourns and I repair, to their jungle-themed coffee shop, along with a client's family member. A few minutes later, the same ASA spots me, comes into the coffee shop and shouts "Welcome to Broward County!" and walks out.

    I chase him down the hall to ask him what he meant by that comment, and he replies "Just trying to be friendly".

  23. One thing has always troubled me. Ok. 2 things. 1) Rumpole could erase any post he wants and no one would know. Even if the poster complained, Rumpole could erase that complaint and many bad posts about Phil have been posted and not erased.

  34. I am a candidate who submitted a "Response" to the above-noted questionnaire. However, I refused to answer any of the questions regarding "born again Christians," life-changing experiences with God, abortion, etc., saying instead that I would follow the laws of the State of Florida and the Constitutions of Florida and the United States. I also submitted a "Candidate's Statement" that tells a bit about myself and my candidacy. I hope that this will not preclude my endorsement. Thank you.

  55. To clarify one time: I am banned from the PDO by Brummer , as is Lynn Overman. No reason was given, although the reason is pretty clear: We were a bit too vocal and energetic in out attempt to oust Brummer and crew. My picture hangs on a wall inside the receiptionists' cubicle on the 1st floor. On another wall about 20 feet away is a picture of Brummer receiving the ACLU's Free Speech Award.

    Also, contrary to what a previous poster wrote, I have never had a problem with Judge Jimenez and have no idea what that was about, although I appreciate the spirit of the post.

    In 2006, Judge Ivan Hernandez a South Florida County Court Judge decided to ignore his duty to promote public confidence by continuing to employ his Judicial Assistant after the Judge's office was raided by the Miami-Dade State Attorney's office under a criminal subpoena. Judge Hernandez court house computer was seized in early March 2006, as part of the Miami-Dade State Attorneys Office public corruption criminal investigation against the Judge and his Judicial assistant.

    The Judge's right hand and judicial assistant also made several anti-Semitic slurs against highly respected administrative Judge Steve Leifman, because the administrative Judge had informed Judge Ivan Hernandez that he was getting numerous upon numerous complaints from litigants about the judicial assistants rudeness and obstruction of access to the court.

    Judge Ivan Hernandez who is fortunately up for re-election this year will be facing opposition for his judicial seat. O.R.J. urges all who vote this year to restore justice and remove Judge Ivan Hernandez by voting for highly respected Attorney Robin W. Faber.




    In addition to the criminal investigation Judge Ivan Hernandez, recently had a "show cause order" (writ of mandamus) issued against him by the Third District Court of Appeal, after his judicial assistant Juan D'Arce was rude and repeatedly denied a litigant access to his Court.     Notice of District Court Assessment Survey: The District Court of Appeal Workload and Jurisdiction Assessment committee is asking lawyers, litigants and the public to complete an on-line survey to help them evaluate the district courts of appeal.     Operation Restore Justice is geared toward exposing corruption in the Florida Court system. The web site is here to expose the very rare cases in which a Judge or those under the Judge's control violate the publics trust.

    The Supreme Court of Florida has set a path of rooting out judicial wrong doing at all levels. The Supreme Court has released numerous opinions over the past few years making it clear to the general public that it will not tolerate violations of the code of judicial conduct either by a sitting judge or a candidate for judge. Recently the Supreme Court of Florida removed a judge from office because of violations of the code of judicial conduct that happened during his judicial campaign to become a Florida Judge.

    All citizens of Florida can be sure that our highest court will NOT tolerate violations of the Code of Judicial conduct at any level. Our supreme court is not shy in expressing its condemnation of any Judge who violates the public trust by not following the code of judicial conduct.

    Operation Restore Justice is under the control of a private citizen. It was due to the criminal investigation presently against Judge Ivan Hernandez and his Judicial Assistant, by the Miami-Dade State Attorneys office which has resulted in the seizure of the Judges computer under a criminal subpoena, that Operation Restore Justice was born in early 2006. In addition to complaints from numerous litigants of being denied access to Judge Hernandez court and Racial slurs by his Judicial Assistant against the administrative Judge.

    Florida has some of the best Judges in the world. We cannot let a handful of bad apples destroy the prestige of Florida's judicial system. The Supreme Court of Florida through its recent opinions has demonstrated that it will NOT tolerate judges who do not follow the code of judicial conduct.

  61. it seems many people realize that manno schurr is ruthless and not worthy, but if you don't want her to be a judge, you need to help bardiwil who has good momentum and a lot of integrity.
