We want to know what bright bureaucrat at the Jail decided to order the orange jumpsuits for all of the Dade County inmates awaiting trial.
This is Miami folks. We try and do things with style, so when we screw up in the national spotlight (riots, election fraud, you know the drill) we at least look cool.
You can't walk down Ocean Drive without bumping into a wannabe clothing designer.
We are sure one of those aspiring Calvin Kleins would have donated their time for some free publicity.
How about the Dolphins teal, orange, and black? Cuffs trimmed in white.?
Something other than these bright orange blobs.
Don’t be surprised if the next time you saunter through the REGJB on your rounds if you see a surprising number of our judiciary peering at you behind a pair of sunglasses. And not because of a hangover (giving them the benefit of the doubt).
For once, you dear robed readers have our sympathy. (Quick, look outside. Is there a blue moon?) You are the ones who have to deal with that bright orange glare all day (ok- the two hours a day that you work). And it’s not as if our robed readers need any more distractions when trying to work their way through a tough two page arraignment calendar.
This is the Dade County Jail we are talking about. Somewhere, if some enterprising prosecutor pokes around, is an orange coloured scandal just waiting to be uncovered.
REGJB TRIVIA
Congratulations to Assistant Public Defender David Sisselman who was the winner of the last trivia contest. Sisselman was the only one who emailed us that quick draw Henry Ferro was the attorney who beat Ted Mastos and that Ferro then resigned from the bench after he pointed a gun at a juvenile defendant accused of armed robbery and asked him how it felt. Displaying the kind of street smarts and common sense our judiciary is known for around the world, , Ferro saw fit to assault the defendant in front of his family members including Georgia Ayers. For those of you new to Miami, Ms. Ayers was about as powerful a community activist as we have seen in these parts.
These days one can find quick draw Ferro holed up in his home in the swamps of middle Florida, emerging mole like to verbally assault our State Attorney when certain former judicial assistants are bright enough to hire the wise Mr. Ferro to defend them from impending criminal charges.

8. Snyder
9:46 show you name coward
ReplyDeleteI admit this phony Rumpole is a bit funny.
ReplyDeleteLets take a vote:
a. keep the old rumpole
b. keep the imposter
ff at 9:15- correct, but you didn't answer the other parts of the questions you answered. Why isn't Gross a Judge anymore? Why did they name Tennis courts after Judge Snyder?
ReplyDeleteFake Rumpole- you're funny. A for initiative. But we can't allow your posts to stay up- note our posts have our fictional picture. And you are way off base when you attack us and think we are a lawyer who is oft mentioned as a Rumpole suspect. Why that attorney hasn't complained more is beyond us. He has the patience of Job.

ReplyDeleteGreat post.

ReplyDeleteHow do we know you are the real rumpole?
No really sure why that corruption post was directed toward Hernandez? Are you making allegations that his judicial decisions were somehow compromised by allowing a questionable JA to remain on the job? What 'deal' influenced any of his rulings? Get over this already. It's obvious you don't like his JA. There's now a political organization that was titled for situations like this. It's called MOVE ON. Get on with your own life and stop worrying about theirs..

ReplyDeleteThe rants against judge hernandez are probably by he who must not be named. We remove them when we see them. Just ignore them and him and he will fade away or sue you.
ReplyDeleteOMG whats the deal
ReplyDeleteit is Juan D'Arce why would he who should not be named do this he has his own web site ORJ
ReplyDeleteRumpole have you been able to follow up on the Dade County Bar Association recent findings against judge Hernandez' campaign and his lack of candor in failing to disclose to the DCBA committee that his wife was the one responsible for running the deceptive ads?
ReplyDeleteDoe Herb Walker always attack the under privileged defendant. I mean come on. It is always the defendants who have the legitimate defense or better stated mitigation and Herb should cut a deal.
ReplyDeleteI wish we could prosecute good ol' Walker.
MCGILLIS CRAWL BACK INTO YOUR HOLE AND TAKE YOUR MEDS!!!!!!!!
ReplyDeleteThat was not Rumpole post above!! its the imposter blaming he who should not be named!!
ReplyDeletelenny bite me haber
ReplyDeleteMaximum Miller (now in civil).
ReplyDelete-t
Herb Walker is a good prosecutor. Not a nice person, but a damm good prosecutor. Learn how to argue like he does. sure he does whine to the judge, but he does it in a good way. he's a lawyer. It amazes me each time I hear him argue to a jury in closing, he's good. So for the defense bar out there, make nice to him.
ReplyDelete1) Howard Gross: aquitted in bribe trial , removed by Fl SC
ReplyDelete2) Ellen Maximum Morphonius
3) Sepe, first hung jury, later pled quilty, served 18 months
4) Phil Davis
5) Henry Oppenborn
6) Harvey Baxter
Ted Mastos
7) Scola (Bob and Jackie)
8) Art Snyder...played a lot that's why
9) Attorney Harvey Swickle, former judge Howie Gross
Bonus Question: Name of Judge: Andrews or Anderson ???
Outcome: Gross acquited, Swickle convicted
Dade County
Sincerely Yours Della Street
7) is wrong because neither of the scolas were chief of county court.
ReplyDelete8) the reason why they named tennis courts after him is also wrong.
9) bonus question is wrong. and swickle was acquitted as well.
Close Della, but no cigar.
Fake Rumpole- you are a persistent little bugger...I will give you that.
ReplyDeleteMiller is a maximum moron. Morphinios was Maximum - but she gave you a hell of a trial- the defense got in everything they wanted. Just don't lose.
ReplyDeleteJudge in Gross case from Broward was Crct.Judge Dan Futch
ReplyDeleteRumpole, why do you keep ignoring Ivan Hernandez' DCBA problem?
ReplyDeleteDear Rumpole:
ReplyDeleteOn futch!!! (used as a verb)... My only errors came from Paul Drake who now has a dime size hole in his instep from my stiletto heel. I think he has age-related dementia. By the way, don't tell me you weren't impressed by my Henry Oppenborn answer!

does newman even know the law?
ReplyDeleteSnyder was the mayor, and named the courts after Himself so he could pick up women while he played tennis.
ReplyDeleteJason Grey is correct!
ReplyDeleteThe person who said Judge Futch is correct!
Where was the trial of Gross held?
Fake Rumpole- your posts are very funny. I hate removing them. Why don't you just post as "fake rumpole" or something like that?
Your "see you in court" lines made me laugh.
What pray tell is Judge Hernandez's DCBA problem? and why should I care?
ReplyDeleteStill waiting for someone to answer #7- email with your name if you want a prize.

ReplyDeletePast DUI trial masters:
ReplyDeleteRichard Essen
Michael Cohen
Bobby Reiff
Pat Nally
Stu Mishkin
Alan Shuminer
Jimbo Best
Chris?
ReplyDeleteARE YOU KIDDING ME? Essen NEVER tried a case, Cohen was/is a chicken shit, Mishkin pleads everybody.
ReplyDeleteFor sheer balls you hire Jim Best he don't f--- around.
Reiff is the best prepared, period, and he WILL try your case.
Nally was great
Alan is just a great lawyer. You get your money's worth.
Use "pracitto" in a sentence:
ReplyDelete"I done smacked mah bitch, an wuz arrested, but da judge done pracittoed me outta jail."
As an ASA I would crap my pants when Joe Fernandez, Andy Parks and Mike Braxton were on my DUI calendar
ReplyDeleteMishkin was and is the trial master. He's the man....learned from the feet of Essen. He and Essen used to give those DUI trial master seminars in the 80's....made a fortune...your father too.
ReplyDeleteAlan?

Please make every effort to attend in support of this most wonderful Judge.
Essen never did shit. It was Nally, Palomino, Greenfield and the list goes on
ReplyDeletealan, your sentence doesn't make sense.
ReplyDeleteI want to go on the record as saying that Stu Mishkin is an asshole.
ReplyDeletestu mishkin has forgot more law than you ever knew. there was a time in this town when the cry 'get me mishkin" was heard over and over again and prosecutors like abe laeser or david gilbert or reid rubin would curse when they saw the doors of the courtroom burst open and mishkin would swagger in and take over for the pd.
ReplyDeleteYou just haven't been around long enough to know beter.
you can have your mel blacks and richard sharpsteins..i've seen too many acquittals not to be a fan of mishkin as well.
ReplyDeleteIf it is true that Stu Mishkin was once good, then it makes sense that he forgot more law than I ever knew, because he is now a worthless hack.
ReplyDeletea few points to consider- rumor has it that stuart mihkin turned down appointments as a federal magistrate several times...he is that good.
ReplyDeleteisn't it suspicious that chris pracitto states he has never even read or seen the blog? he protestth too muchth
I have been a DC for a long time and in our office when we see Mshkin we know we have a fight on our hands. And he's tricky- not sleezy-just tricky, especially on cross.
ReplyDeleteI will not get into any details, but I have a few former clients who received what they felt to be a far less than adequate defense from Mishkin.
ReplyDeleteWhen your kids get arrested, hire Mishkin. When mine do, i will spend my money elsewhere.
ReplyDelete4:49. Why are you checking the blog on taxpayers time. Don't you have a community to protect?
ReplyDeleteand i disagree with whoever said scott saul was a good lawyer
ReplyDeletein fact...the following could not represent my dog in a bone theft case:
ReplyDeleteMishkin
Saul
Medoff
and like 95% of the other lawyers in the courthouse.
Dear 4:37 poster: There must be more than one Stu Mishkin. My only recollection of a case with Stu was his impassioned plea for 'any deal' so that he would not have to go to trial. It may have been the quality of the evidence, but who can tell? The name Mishkin never caused fear at the A.S.A. level that you suggest it might have. Nice enough guy, but no Jack Denaro.
ReplyDeleteMishkin is always sweaty and out of breath
ReplyDeleteI would let almost any c level pd represent me before mishkin
ReplyDeleteMe thinks there is a fair amount of leg pulling or literary license on the subject of Mr. Mishkin. Leave him alone please.
ReplyDeleteok i will...but he's still not representing my dog.
ReplyDeleteOne more thing...I did hear that in an effort to appease Milt Hirsch, GW Bush has promised to appoint Mishkin to the USSupreme Court should Stevens die or retire.
ReplyDeleteI hear Mishkin looks sexy in biker shorts.
ReplyDeleteYou people have no idea: from a web search, an excerpt from a law web site on a big civil matter mishkin was brought in to handle:
ReplyDelete“But the court's finding mirrors the arguments of Skadden, Arps, Slate, Meagher & Flom of counsel attorney, Miami lawyer Stuart R. Mishkin, who represented the PGA. His client wasn't trying to control information, he said. It was simply trying to keep Morris from taking information the PGA spends a lot of money to compile and disseminate for free to the media, and then turning around and selling it to third parties without the PGA's permission.”

ReplyDeleteWould you please explain why you are allowing fake rumpole's hyperlink which takes one to George Alvarez' websiste to remain on the blog?
Thank you very much.
Shall we post as "Super Fake Rumpole" with a hyperlink to Judge Bronwyn Miller's website?
new poll idea:
ReplyDeleteYou are facing life in prison.
You can
1) Go pro se
2) be represented by Mishkin
What do you choose?
Rumpole notes: This is the David Markus who does NOT run a federal blog, but he's a very good lawyer in his own right.
ReplyDelete2) Judge Miller's people: please post Judge Miller's web site.
We do not think fake rumpole has anything to do with mr alvarez, and he was just trying to cause trouble. But to be fair, please post the web site for the lovely and talented Judge Bronwyn Miller for all to peruse.
why all the mishikin hate? jealous?
ReplyDeletechris?
ReplyDeleteI saw a post go up the other day with a link to blecher, and then it was taken down a second later, and a few minutes later the almost exact same post went up under rumpole's name.
ReplyDeletecaught ya didn't I?
rick freedman admitted privately that he was rumpole. he said it. I believe it. That ends it. Move on people.
ReplyDeletealan?
ReplyDeleteI'm an ex-pd, and while I would not put mishkin in the roy black /jack denaro category, nor would I say he is as bad as some are saying. maybe he's a little less aggressive with age, but we planned to go to trial together, he was great with strategy and legal research and writing motions, not so go at depos (seemed bored) and was raring to try the case, but won it on motions. You can't argue with success.
ReplyDeleteI actually know many of these guys:
ReplyDelete1. Howard "Mousey" Gross. Now working on South Beach and drives a Harley.
2. Ellen Maximum Morphonios. She died a few years ago. Ran a fun court. No pleas from the bench. You took the state deal or went to trial.
3. Al Sepe. Still alive. Was a county court judge, then, got in big trouble... and all of a sudden the gov makes him a Circuit Court Judge. Was arrested in CourtBroom. Hung jury, took plea deal to very small prision sentence. Is now home alone.
4. I do not think any of the judges were acquitted in courtbroom.
5. Had to be Henry Oppenborn. He started court every day with the pledge of you know what... it was funny to see the non-english speakers stand there with their hands on their hearts and mumble...
6. I think Mench for the Bench was Alan Postman but, may have also been Harvey Baxter.
7. I can not remember either Scola being in charge of county court... so, I am not sure.
8. Arthur Snyder. Died recently. Ran a very funny court. If your client could pass a poly he would dismiss a murder case. He was mayor of NMB and later Aventura. He played tennis so, they named the court after him. I liked him.
9. a. Howard Gross and atty Swickle. Both were acquitted but, disbarred.
b. Broward judge was: Dale Ross???
c. Acquittal for both.
d. Trial held in Broward.
Funny how Richard Essen tells everyone he never lost a case???
ReplyDeleteHe has not been in a courtroom for over 25 years except when he had jury duty.
He knows nothing about the real world.
To David Markus: Not completely correct. Although it may not have been in the Justice building, I can recall another episode involving a gun when you were at a real loss for words -- but not as spacy as Greg. Glad you both made it back to work that day!!
ReplyDeleteto trivia at 5:43- one judge was acquitted-walked out the door and went home in courtbroom.
ReplyDeleteCorrect on Snyder being the Mayor of NMB.
Wrong on the broward Judge- it was the always nice, pleasant and fair (see the sarcasm) Judge Futch.
The trial as other readers have noted, was at the Dade County Courthouse.
Mastos went home -- because he ratted every other judge out. Now he still wears a gavel on his tie clip. Real CHUTZPAH !
ReplyDeleteFake Rumpole does have a life so sorry for delay in responding to the freking cry-baby.
ReplyDeleteWe have non link our name to the sweet heart B Miller.
Why: Because we are fair, honest and have integrity. All the traits Hernandez wants.
we have now linked our name to B Miller.
ReplyDeleteSpell check and grammer police
Sorry Rumpole.
ReplyDeleteHow can I be your apprentice with grammer issues?
T.Sclafani represented Harvey Swickle in the Gross/Swickle Trial before Judge Dan Futch which was held at the Dade County Courthouse 71 West Flagler Street.Had they been found guilty Futch would have had them place their hands on the miniature "electric chair"he kept in his chambers which actually did provide a shock. But they were both found Not Guilty!
ReplyDeletebreaking news:
ReplyDeleteFake Rumpole is Rumpoles alter ego. yes they are the same person
Rumpie:

"cant we all just get along" Rodney King, Los Angeles.
I always thought Alvarez and Hernandez were not in the same camp.
ReplyDeleteThen I pulled over on the side of the road and took a closer look at there campaign signs and guess what. Both using the same printing company outta Hialeah. Art work almost identical except for colors.
Hernandez has NERVE with a capital "N". milking his service in veitnam. I want a investigation as to what his service really was.
watch the custodial jury box when the new orange gen-pop and bright red safety cell colors are all togther.

mr 428 joe fernandez made you nervous? you must be a real pussy, why would any lawyer on a dui case worry you. In the grand scheme of things who in sao cares if a first year lawyer gets the shit kicked out of him by chris lyons? at least you will learn something more than trying the case against an equally clueless pd. This is one of many problems with sao, when i was there everyone in county used to fight over jury trials, now we have losers like 428 who are afraid of them and get an even bigger ass whupping in felonies when they start liberating violent felons on the streets of miami.
ReplyDeleteTrivia Freak- YOU DA MAN (or woman). You got the very hardest trivia question- Judge Lehr is in fact married to Bruce Lehr, who many moons ago was a Chief of County Court back when they had less than 7 dozen chiefs and two other prosecutors.
ReplyDeleteIf you privately email us your name, you will receive a prize. Your call.
We did delete the court broom opinon but left the link up.
We are not fake rumpole as well, because if you scroll back you can see we deleted a whole bunch of posts..but we think he's pretty funny.
rumpole dont listen to juanita she just upset that he cant get ssi
ReplyDeletefor my money I would hire Mishkin. (i only have a buck 20)
ReplyDeleteSomeone said, "Why all the Mishkin hating, jealous?" No. Actually the reason is that he did an awful job with a poor client who was mentally slow. I took over the case after Mishkin, cleaned up his mess, and got a nolle prosse that took work that should have been done years before. Mishkin left a very bad taste in this clients mouth.
ReplyDeleteTrue Story:
ReplyDeleteI tried an Armed Robbery of a convenience store case in 1990. My client had something like 18 priors. The offer was Life. So, we tried it of course.
Defendant was found guilty and at sentencing, Judge Phil Davis said to the defendant, "the jury having found you guilty, you will be spending the rest of your life in prison."
The guy, Terry Coney, said to the judge, "Kiss my mother-fucking black ass."
Judge Davis shot back, "only if I'm in jail with you, Mr. Coney."
Shortly thereafter, Davis was arrested and in jail for the Operation CourtBroom case along with:
Harvey Shenberg
Alfonso Sepe
David Goodhart
Arthur Massey
William Castro
Arthur Luongo
Harry Boehme
Nancy Lechtner
I will never forget Mr. Coney's words and Judge Davis'comeback; truer words never spoken.
by the way, the ASA was -

whats even more hilarious is that she has over $100,000 in her campaign chest compared to alvarez $10,000 loan to himself.
ReplyDeleteJudge B. Miller take $900.00 of that hundred grand and get a web site professional to make your site as good as you are.
Hey- Rick - I sure do remember that case. Armed robbery of a liquor store. Phil Davis was a real disappointment. Talk about a guy who had a self destructive streak.

In 2006, Judge Ivan Hernandez a South Florida County Court Judge decided to ignore his duty to promote public confidence by continuing to employ his Judicial Assistant after the Judge's office was raided by the Miami-Dade State Attorney's office under a criminal subpoena. Judge Hernandez court house computer was seized in early March 2006, as part of the Miami-Dade State Attorneys Office public corruption criminal investigation against the Judge and his Judicial assistant.
The Judge's right hand and judicial assistant also made several anti-Semitic slurs against highly respected administrative Judge Steve Leifman, because the administrative Judge had informed Judge Ivan Hernandez that he was getting numerous upon numerous complaints from litigants about the judicial assistants rudeness and obstruction of access to the court.
Judge Ivan Hernandez who is fortunately up for re-election this year will be facing opposition for his judicial seat. O.R.J. urges all who vote this year to restore justice and remove Judge Ivan Hernandez by voting for highly respected Attorney Robin W. Faber.
In addition to the criminal investigation Judge Ivan Hernandez, recently had a "show cause order" (writ of mandamus) issued against him by the Third District Court of Appeal, after his judicial assistant Juan D'Arce was rude and repeatedly denied a litigant access to his Court. Operation Restore Justice is geared toward exposing corruption in the Florida Court system. The web site is here to expose the very rare cases in which a Judge or those under the Judge's control violate the publics trust.
The Supreme Court of Florida has set a path of rooting out judicial wrong doing at all levels. The Supreme Court has released numerous opinions over the past few years making it clear to the general public that it will not tolerate violations of the code of judicial conduct either by a sitting judge or a candidate for judge.
