ORANGE










We want to know what bright bureaucrat at the Jail decided to order the orange jumpsuits for all of the Dade County inmates awaiting trial.

This is Miami folks. We try and do things with style, so when we screw up in the national spotlight (riots, election fraud, you know the drill) we at least look cool.

You can't walk down Ocean Drive without bumping into a wannabe clothing designer.
We are sure one of those aspiring Calvin Kleins would have donated their time for some free publicity.

How about the Dolphins teal, orange, and black? Cuffs trimmed in white.?

Something other than these bright orange blobs.

Don’t be surprised if the next time you saunter through the REGJB on your rounds if you see a surprising number of our judiciary peering at you behind a pair of sunglasses. And not because of a hangover (giving them the benefit of the doubt).


For once, you dear robed readers have our sympathy. (Quick, look outside. Is there a blue moon?) You are the ones who have to deal with that bright orange glare all day (ok- the two hours a day that you work). And it’s not as if our robed readers need any more distractions when trying to work their way through a tough two page arraignment calendar.

This is the Dade County Jail we are talking about. Somewhere, if some enterprising prosecutor pokes around, is an orange coloured scandal just waiting to be uncovered.

REGJB TRIVIA

Congratulations to Assistant Public Defender David Sisselman who was the winner of the last trivia contest. Sisselman was the only one who emailed us that quick draw Henry Ferro was the attorney who beat Ted Mastos and that Ferro then resigned from the bench after he pointed a gun at a juvenile defendant accused of armed robbery and asked him how it felt.
Displaying the kind of street smarts and common sense our judiciary is known for around the world, , Ferro saw fit to assault the defendant in front of his family members including Georgia Ayers. For those of you new to Miami, Ms. Ayers was about as powerful a community activist as we have seen in these parts.

These days one can find quick draw Ferro holed up in his home in the swamps of middle Florida, emerging mole like to verbally assault our State Attorney when certain former judicial assistants are bright enough to hire the wise Mr. Ferro to defend them from impending criminal charges.

Are you making allegations that his judicial decisions were somehow compromised by allowing a questionable JA to remain on the job? What 'deal' influenced any of his rulings? Get over this already. It's obvious you don't like his JA. There's now a political organization that was titled for situations like this. It's called MOVE ON. Get on with your own life and stop worrying about theirs..

  17. Herb Walker is a good prosecutor. Not a nice person, but a damm good prosecutor. Learn how to argue like he does. sure he does whine to the judge, but he does it in a good way. he's a lawyer. It amazes me each time I hear him argue to a jury in closing, he's good. So for the defense bar out there, make nice to him.

  58. Dear 4:37 poster: There must be more than one Stu Mishkin. My only recollection of a case with Stu was his impassioned plea for 'any deal' so that he would not have to go to trial. It may have been the quality of the evidence, but who can tell? The name Mishkin never caused fear at the A.S.A. level that you suggest it might have. Nice enough guy, but no Jack Denaro.

I'm an ex-pd, and while I would not put mishkin in the roy black /jack denaro category, nor would I say he is as bad as some are saying. maybe he's a little less aggressive with age, but we planned to go to trial together, he was great with strategy and legal research and writing motions, not so go at depos (seemed bored) and was raring to try the case, but won it on motions. You can't argue with success.

    1. Howard "Mousey" Gross. Now working on South Beach and drives a Harley.
    2. Ellen Maximum Morphonios. She died a few years ago. Ran a fun court. No pleas from the bench. You took the state deal or went to trial.
    3. Al Sepe. Still alive. Was a county court judge, then, got in big trouble... and all of a sudden the gov makes him a Circuit Court Judge. Was arrested in CourtBroom. Hung jury, took plea deal to very small prision sentence. Is now home alone.
    4. I do not think any of the judges were acquitted in courtbroom.
    5. Had to be Henry Oppenborn. He started court every day with the pledge of you know what... it was funny to see the non-english speakers stand there with their hands on their hearts and mumble...
    6. I think Mench for the Bench was Alan Postman but, may have also been Harvey Baxter.
    7. I can not remember either Scola being in charge of county court... so, I am not sure.
    8. Arthur Snyder. Died recently. Ran a very funny court. If your client could pass a poly he would dismiss a murder case. He was mayor of NMB and later Aventura. He played tennis so, they named the court after him. I liked him.
    9. a. Howard Gross and atty Swickle. Both were acquitted but, disbarred.
    b. Broward judge was: Dale Ross???
    c. Acquittal for both.
    d. Trial held in Broward.

T.Sclafani represented Harvey Swickle in the Gross/Swickle Trial before Judge Dan Futch which was held at the Dade County Courthouse 71 West Flagler Street.Had they been found guilty Futch would have had them place their hands on the miniature "electric chair"he kept in his chambers which actually did provide a shock.But they were both found Not Guilty!

In the grand scheme of things who in sao cares if a first year lawyer gets the shit kicked out of him by chris lyons? at least you will learn something more than trying the case against an equally clueless pd. This is one of many problems with sao, when i was there everyone in county used to fight over jury trials, now we have losers like 428 who are afraid of them and get an even bigger ass whupping in felonies when they start liberating violent felons on the streets of miami.

  92. Someone said, "Why all the Mishkin hating, jealous?" No. Actually the reason is that he did an awful job with a poor client who was mentally slow. I took over the case after Mishkin, cleaned up his mess, and got a nolle prosse that took work that should have been done years before. Mishkin left a very bad taste in this clients mouth.

    I tried an Armed Robbery of a convenience store case in 1990. My client had something like 18 priors. The offer was Life. So, we tried it of course.

    Defendant was found guilty and at sentencing, Judge Phil Davis said to the defendant, "the jury having found you guilty, you will be spending the rest of your life in prison."

    The guy, Terry Coney, said to the judge, "Kiss my mother-fucking black ass."

    Judge Davis shot back, "only if I'm in jail with you, Mr. Coney."

    Shortly thereafter, Davis was arrested and in jail for the Operation CourtBroom case along with:

    David Goodhart
    Arthur Massey
    William Castro
    Arthur Luongo

    In 2006, Judge Ivan Hernandez a South Florida County Court Judge decided to ignore his duty to promote public confidence by continuing to employ his Judicial Assistant after the Judge's office was raided by the Miami-Dade State Attorney's office under a criminal subpoena. Judge Hernandez court house computer was seized in early March 2006, as part of the Miami-Dade State Attorneys Office public corruption criminal investigation against the Judge and his Judicial assistant.

    The Judge's right hand and judicial assistant also made several anti-Semitic slurs against highly respected administrative Judge Steve Leifman, because the administrative Judge had informed Judge Ivan Hernandez that he was getting numerous upon numerous complaints from litigants about the judicial assistants rudeness and obstruction of access to the court.

    Judge Ivan Hernandez who is fortunately up for re-election this year will be facing opposition for his judicial seat. O.R.J. urges all who vote this year to restore justice and remove Judge Ivan Hernandez by voting for highly respected Attorney Robin W. Faber.




    In addition to the criminal investigation Judge Ivan Hernandez, recently had a "show cause order" (writ of mandamus) issued against him by the Third District Court of Appeal, after his judicial assistant Juan D'Arce was rude and repeatedly denied a litigant access to his Court. Slom (the Administrative Judge overseeing Judge Hernandez), tells the Miami Herald on May 30, 2006, that he has received numerous upon numerous complaints about Juan D'Arce being rude, insensitive and obstructing the access of litigants to the Court.     Operation Restore Justice is geared toward exposing corruption in the Florida Court system. The web site is here to expose the very rare cases in which a Judge or those under the Judge's control violate the publics trust.

    The Supreme Court of Florida has set a path of rooting out judicial wrong doing at all levels. The Supreme Court has released numerous opinions over the past few years making it clear to the general public that it will not tolerate violations of the code of judicial conduct either by a sitting judge or a candidate for judge. Recently the Supreme Court of Florida removed a judge from office because of violations of the code of judicial conduct that happened during his judicial campaign to become a Florida Judge.

    All citizens of Florida can be sure that our highest court will NOT tolerate violations of the Code of Judicial conduct at any level. Our supreme court is not shy in expressing its condemnation of any Judge who violates the public trust by not following the code of judicial conduct.

    Operation Restore Justice is under the control of a private citizen. It was due to the criminal investigation presently against Judge Ivan Hernandez and his Judicial Assistant, by the Miami-Dade State Attorneys office which has resulted in the seizure of the Judges computer under a criminal subpoena, that Operation Restore Justice was born in early 2006. In addition to complaints from numerous litigants of being denied access to Judge Hernandez court and Racial slurs by his Judicial Assistant against the administrative Judge.

    Florida has some of the best Judges in the world. We cannot let a handful of bad apples destroy the prestige of Florida's judicial system. The Supreme Court of Florida through its recent opinions has demonstrated that it will NOT tolerate judges who do not follow the code of judicial conduct.
