DEWEY BEATS TRUMAN!


IN RE: Judge Samuels:





Judge Samuels, currently ensconced in Domestic Violence Court and facing a challenge for re-election, has had his ups and downs recently. Word has reached us from several sources, including one close to his campaign that some medical issues have slowed the Judge down from a summer of robust campaigning. But, the source hastens to add, Judge Samuels is feeling better and back on track and working hard towards his reelection.

Speaking of Domestic Violence Court, we had occasion in the last two weeks to wander down to the Civil Court Complex. Did you know that there is a Starbucks on a corner directly opposite the civil court house?

What with all of those lawsuits about debentured bonds and subrogated insurance polices, one should fully expect that this Starbucks will be intravenously feeding judges and juries espresso and cappuccinos.


Civil Court, Family Court, Domestic Violence Court and Federal Court are all within a few blocks of each other. Almost makes those of us who labour in the REGJB feel unwanted. This slight must be unintentional. Right?

Yes, we may be the unwashed, rumpled, ruffled, lewd and lascivious litigators of criminal law, but you can’t live without us.


We also note that Family Court has a child care center. That would make way too much sense for the REGJB.

It almost pains us to note that North Of The Border has all their court divisions in the same courthouse. So you can enter a NOA on a murder case, take a continuance on a DUI, go to an uncontested divorce calendar, and pick a jury on the civil suit against your former client for un-paid fees.
You just can’t get any of your cases called if you’re from Miami.

Signs that things aren’t as they seem:

Billions of dollars and over two thousand American lives have brought American style courts to Iraq. Yesterday, prior to a verdict, the presiding Judge had Saddam Hussein pick which method of execution he would prefer. Hussein choose a firing squad.

Somewhere right now, there are dozens of Judges in Texas, and even a few on our own 3RD PCA saying to themselves “what’s wrong with that?”

There are so many things wrong with that, we don’t know where to start.

PS: The Herald reports this morning that our hard working state and federal prosecutors offices have not dropped the Art Teele investigation despite his death last year. That's the spirit! Don't let him weasel out of his crimes just by dying. This is Miami, where we're tough on crime.

    Investigators: Moneyman Jeffrey Epstein solicited teen masseuses
    JULY 26--Prepare to take a shower after reading this remarkably sleazy probable cause affidavit filed in the case of Jeffrey Epstein, the billionaire financier who was arrested Sunday for soliciting sex from a masseuse at his Florida mansion. Beginning in mid-March 2005, Epstein became the target of a sexual battery probe conducted by the Palm Beach Police Department, according to the affidavit, which alleges that Epstein, 53, paid a series of underage girls to engage in sexual activity with him. Frankly, there are too many dirty details in the affidavit to properly synopsize, but, if investigators are to be believed, Epstein has a thing for teenagers, vibrators, and assorted massage lotions. Epstein, pictured above in a Palm Beach County Sheriff's Office mug shot, has been indicted on a felony solicitation of prostitution rap. The indictment, which does not allege that the solicited party was a minor, charges that the crime occurred between August 2004 and October 2005. In a statement, Epstein's lawyer dismissed the affidavit's charges as "false accusations." Jose Alessi, a former houseman, told cops that Epstein would receive three massages daily and that his masseuses were "younger and younger" and "appeared to be sixteen or seventeen years of age at the most." He also reported that following Epstein massages he sometimes had to "wash off a massager/vibrator and a long rubber penis" which had been left in a sink. Alfredo Rodriguez, a former house manager, told probers that he "knew" Epstein's masseuses were still in high school. Rodriguez also told of having to "wipe down" vibrators and sex toys post-massage and returning them to an armoire near Epstein's bed. In a 2002 New York magazine profile of Epstein, Donald Trump called the moneyman a "terrific guy" who "likes beautiful women as much as I do, and many of them are on the younger side." Epstein, who reportedly runs a multibillion-dollar investment fund, travels in his own Boeing 727 (upon which he has transported Bill Clinton to Africa) and owns a 45,000-square-foot mansion on Manhattan's Upper East Side. Your Rumpole of the Bailey Picture that posts with your name features British Actor Leo McKern. Without consulting Google, or a search engine of that ilk, can you tell me the name of the movie that he was in where he played a priest from a mystical Eastern Religion on a quest to find a sacrificial piece of jewelry? Can you name his co-stars and advise if any of them are accomplished in other walks of life besides acting? Can you name at least three countries where shooting took place in that movie?   8. Rumpole here arethe DCBA findings on Ivan Hernadez' campaign and the reasons why you should care should be apparent to any rational person if not to a lawyer.The facts :

    On July 20, 2006 the judicial campaign practices commission of the Dade County Bar Association issued an advisory opinion regarding the actions of judge Ivan Hernandez'campaign for having run an ad "Libertad News" a Spanish "periodiquito" (community newspaper)with a picture of Florida Governor Jeb Bush

    In response to the complaint judge Hernandez stated "... in reference to the above matter, I have not placed a newspaper ad for my political campaign with the newspaper by the name of the "La Libertad News". Any advertisement placed on that newspaper was not paid or approved by my campaign manager or myself "

    The commission found that the Ad violated Judicial Canon 7(A)(3)(D)(iii)in that it implied that Florida Governor Jeb Bush had endorsed the candidacy of judge Hernandez for reelection to the County Court, group 4.

    The commission was"constrained to make any further finding that judge Hernandez violated any law, judicial canon or pledge in that judge Hernandez has denied having authored ,authorized ,approved or otherwise had prior knowledge of the advertisement question"

    The illegal ad listed Marixa Hernandez as the campaign treasurer. In his response to the commission judge Hernandez failed to inform the committee that Marixa Hernandez was his wife.

    They wrote "...the commission does wish to note a perceived lack of candor in judge Hernandez's July 17th 2006 response in failing to disclose that Marixa Hernandez in addition to being the judge's campaign treasurer is also his wife. Moreover, the commission is troubled by judge Hernandez' terse responses in both his July 13 and 17 2006 letters and by his apparent lack of concern that without his authorization or approval,others may be placing improper advertisements,containing not only misleading information regarding endorsements by prominent public officials, but also personal information of the candidate and his wife"

    The commission members were David Rothman, Don Horn, Leslie Smith, Vivian R. Reyes and Raul Chacon writing unanimously

The Governor has not endorsed Hernandez and the DCBA has issued a strong condemnation of Judge Hernandez deceptive campaign practices. The opinion of the DCBA will be available in PDF later today. As the readers of O.R.J. know, Judge Hernandez and his suspended without pay Judicial Assistant are under criminal investigation by the Dade County State Attorneys office. In early March 2006, Judge Hernandez office computer was seized under a criminal subpoena.

The relevance of Judge Hernandez' cavalier attitude about the ad implying an endorsement from the Governor is that it is simply one more situation where he is willing to cut corners and look the other way while improper and/or unethical behaviors occur that don't hurt him. D'Arce running campaigns against sitting judges, why should he care, right? Working part time to improve his golf game, what's the big deal? So what if someone wants to help him, wink, wink. Hernandez is despised because he doesn't care. Judges are suppossed to take the high road, not dive underneath it. He simply doesn't care about it and so I don't care about him. I made a mistake when I voted for him and now I will correct that mistake. His opponent is not only qualified but is taking the high road in this campaign. Why Faber isn't more of a sh*t about this I don't know because there's a lot to play with. He will probably win because of it.

  38. Today was the last day of the reporting period for judicial candidates. Next week we will learn who are pretenders and who are contenders. True, the numbers might not have personal wealth thrown in but they will tell you volumes about who is supporting who and by how much. Then we'll really know how Juan's candidates are doing. If Leifman, Miller, Faber and McWhorter have big war chests then it will be a long 5 weeks to election day for Gonzalez, Hernandez, Alvarez and Marino-Pedraza. None of the incumbents had an opponent last reporting cycle. If money has flooded into the non-D'Arce candidates reports then support will continue to come their way..everyone loves a winner. The beast may be slain after all.

Despite all the low bar poll numbers, the half-time schedule, the criminal investigation of his side-kick, the dirty tricks by his campaign and the JQC investigation of himself, Ivan remains a hispanic incumbent in Dade County and many voters don't know about him or get what it is he represents in the legal community.     You really blew it this time. Samuels (sorry ,but I can't refer to him as "Judge") got himself elected by telling voters that they should not re-elect a judge who had been a ... (Jaws music here) criminal defense attorney. [Thankfully, former criminal defense attorney and terrific judge Kevin Emas was reappointed and went on to the circuit court.]

    Included in the advertisement was a picture of a dark faced man looking out from behind jail bars (can you say Mel Gibson plays Samuels in the movie).

    Samuels can still be found at the local Denny's having breakfast at 10:30 a.m. (true story; I have seen him there after court).

    As a criminal (and Constitutional rights) defense attorney, I believe that someone who uses such tactics to get elected is unworthy of the bench.

    Bennett H. Brummer, the top defender of the poor in his capacity as PUBLIC DEFENDER of Miami-Dade County, wrote to Chief Judge Farina complaining about Judge Ivan Hernandez and his JA, Juan D'Arce. CLICK HERE to view the letter.

    In 2006, Judge Ivan Hernandez a South Florida County Court Judge decided to ignore his duty to promote public confidence by continuing to employ his Judicial Assistant after the Judge's office was raided by the Miami-Dade State Attorney's office under a criminal subpoena. Judge Hernandez court house computer was seized in early March 2006, as part of the Miami-Dade State Attorneys Office public corruption criminal investigation against the Judge and his Judicial assistant.

    The Judge's right hand and judicial assistant also made several anti-Semitic slurs against highly respected administrative Judge Steve Leifman, because the administrative Judge had informed Judge Ivan Hernandez that he was getting numerous upon numerous complaints from litigants about the judicial assistants rudeness and obstruction of access to the court.

    Judge Ivan Hernandez who is fortunately up for re-election this year will be facing opposition for his judicial seat. O.R.J. urges all who vote this year to restore justice and remove Judge Ivan Hernandez by voting for highly respected Attorney Robin W. Faber.




    In addition to the criminal investigation Judge Ivan Hernandez, recently had a "show cause order" (writ of mandamus) issued against him by the Third District Court of Appeal, after his judicial assistant Juan D'Arce was rude and repeatedly denied a litigant access to his Court. Slom (the Administrative Judge overseeing Judge Hernandez), tells the Miami Herald on May 30, 2006, that he has received numerous upon numerous complaints about Juan D'Arce being rude, insensitive and obstructing the access of litigants to the Court.     In 2006, Judge Ivan Hernandez a South Florida County Court Judge decided to ignore his duty to promote public confidence by continuing to employ his Judicial Assistant after the Judge's office was raided by the Miami-Dade State Attorney's office under a criminal subpoena. Judge Hernandez court house computer was seized in early March 2006, as part of the Miami-Dade State Attorneys Office public corruption criminal investigation against the Judge and his Judicial assistant.

    The Judge's right hand and judicial assistant also made several anti-Semitic slurs against highly respected administrative Judge Steve Leifman, because the administrative Judge had informed Judge Ivan Hernandez that he was getting numerous upon numerous complaints from litigants about the judicial assistants rudeness and obstruction of access to the court.

    Judge Ivan Hernandez who is fortunately up for re-election this year will be facing opposition for his judicial seat. O.R.J. urges all who vote this year to restore justice and remove Judge Ivan Hernandez by voting for highly respected Attorney Robin W. Faber.




    In addition to the criminal investigation Judge Ivan Hernandez, recently had a "show cause order" (writ of mandamus) issued against him by the Third District Court of Appeal, after his judicial assistant Juan D'Arce was rude and repeatedly denied a litigant access to his Court.     Operation Restore Justice is geared toward exposing corruption in the Florida Court system. The web site is here to expose the very rare cases in which a Judge or those under the Judge's control violate the publics trust.

    The Supreme Court of Florida has set a path of rooting out judicial wrong doing at all levels. The Supreme Court has released numerous opinions over the past few years making it clear to the general public that it will not tolerate violations of the code of judicial conduct either by a sitting judge or a candidate for judge. Recently the Supreme Court of Florida removed a judge from office because of violations of the code of judicial conduct that happened during his judicial campaign to become a Florida Judge.

    All citizens of Florida can be sure that our highest court will NOT tolerate violations of the Code of Judicial conduct at any level. Our supreme court is not shy in expressing its condemnation of any Judge who violates the public trust by not following the code of judicial conduct.

    Operation Restore Justice is under the control of a private citizen. It was due to the criminal investigation presently against Judge Ivan Hernandez and his Judicial Assistant, by the Miami-Dade State Attorneys office which has resulted in the seizure of the Judges computer under a criminal subpoena, that Operation Restore Justice was born in early 2006. In addition to complaints from numerous litigants of being denied access to Judge Hernandez court and Racial slurs by his Judicial Assistant against the administrative Judge.

    Florida has some of the best Judges in the world. We cannot let a handful of bad apples destroy the prestige of Florida's judicial system. The Supreme Court of Florida through its recent opinions has demonstrated that it will NOT tolerate judges who do not follow the code of judicial conduct.
