MISTAKES AND WHAT IS COMING

We all make mistakes. Your blogger has made 7 this year. Last year- 9.

Senator Eric Schmitt (Clown, Missouri) made one on national TV during the testimony of former DOJ prosecutor Jack Smith.  Schmitt was trying to draw a connection between Smith and Atlanta prosecutor Fanni Willis, who indicted Trump.  Asked directly if he had met her, Smith denied it.  Ah, thought Schmitt, “I’m fixing to spring mah trap.” He then asked Smith if he had been to an Atlanta Hawks game on February 3,2024.  Puzzled, Smith thought for a moment and then denied it  “Now ah got em!” Schmitt thought to himself.  He told Smith he had his texts  and Smith and his team talked about Smith attending the Hawks game.  The Senator told Smith he had committed perjury and that he would be remembered as a “dirtbag”.   Visions of congressman Nixon and communist spies and microfilm in a pumpkin patch which propelled Nixon to the Senate and then the Vice Presidency danced in Schmidtt’s small brain.

Just one teeny tiny problem.  The Senator is apparently no sports fan.  Quick research by senate staffers and media during the hearing showed that on February 3, 2024 Iowa women’s basketball team played Maryland.   The failing NY Times quickly found a picture of Mr Smith at the game.  Atlanta has the Hawks- an NBA team.  Iowa has the Hawkeyes and on that night Smith went to the game to see  Caitlin Clark the women’s college phenom.  No perjury.  No Nixon like advancement to becoming Vice President.  Just a doofus with his foot in his mouth and no Hawkeye  eyesight.  The Senator quickly left the hearing and was quoted muttering “he’s still a dirtbag.”

Monday is a big day. Why? Legal nerds the world over will quickly shout that It’s the First Monday in October.  And what does that mean? Maybe a robed reader knows

Jack Smith and Biden hurt the DOJ irreparably with the prosecution of Donald Trump.

Why the disdain for our profession?
I met with a potential client the other day who let me know that he hates lawyers and does not trust any of us. He told me that lawyers prey on others’ misfortunes. I understand that the majority of interactions with lawyers occur when something has gone wrong in a person’s life. But, the same can be said for surgeons, plumbers, mechanics, and several others. Why do people love to hate on lawyers?

Anonymous said...

Only because they took too long.

Even Shakespeare: "Let's kill all the lawyers," Henry VI, part 2.

The longer I practice law and witness how lawyers treat their clients, the less I trust lawyers as well. People love to hate on lawyers because we (1) we earned it; and (2) think we are above the disdain.

Anonymous at 6:22. Please read any of the indictments, and perhaps the federal rules requiring indictment by grand jury and see if you still believe that Smith and DoJ improperly charged Trump.

I’m a lawyer and have disdain for many

THE CAPTAIN RESPONDS:

Wednesday, September 30, 2026 1:38:22 PM ASKED:

"Interesting trivia would be last time that a judge with a white anglo male name who was not an incumbent won an election in Miami Dade. I don't know the answer but its gotta be a long time.".

In 2024, former judge Jason Bloch won election. For someone who had never been a judge, the only two I can recall in the past twenty years (10 elections) would be Martin Zilber in 2014, and Robin Faber in 2006.

CAP OUT .......

The Esquire Class reigns supreme. We The People are second class citizens. It's bad enough when The Esquire Class confines itself to the judicial branch. But when The Esquire Class invades the executive branch and the legislature, they become insufferable Carpetbaggers. The good news? Lawyers are like backsides; everyone has one, and they are all a little stinky.

Oh Captain, my Captain, how could you forget Joe Perkins who's coming to a criminal division near you?

Anonymous said...

I miss Judge Martin Zilber. He was the wealthiest judge on the bench, but was humble and brilliant on criminal law and procedure issues.

I wish he would come back to criminal division and sit as a Senior Judge. He would be great in backup to preside of the most complex trials and death penalty matters.

Rumpole, don’t you agree? Trialmaster? Captain Justice?

Talk about mistakes - how about that former PD in bond hearings who asked the judge to expedite his client's release because the client is a "celebrity" rap star in a red jump suit?

Anonymous said...

Imagine the following scenario circa January 2021: The Democratic Party has decided to pretend Donald Trump does not exist.

Anonymous said...

by anglo I meant Christian not Jewish. Jewish gets its own automatic vote base in Miami like Hispanic.

Stop calling people names that prevents me from posting. Example : judge so and so was a flaming asshole and dumb as shit. Vs. judge so and so lacked any judicial temperament, berated lawyers and staff for no reason and couldn’t find his way out of an elevator without help. One gets posted. One does not. Get with the program will ya?

Who is the stupid lawyer who made all kinds of news by asking Judge Mindy Glazer for special treatment for his client the other day because he was a "celebrity." Wow, Mindy fired back, and said she treats everyone the same.

Anonymous said...

It’s true. The criminal defense bar does miss Judge Zilber.

Anonymous said...

former ASA that was part of the draconian “win at all cost” club is gone hallelujah.

Anonymous said...

Because we think we are better than non lawyers.

Anonymous said...

I too saw the "celebrity" in bond hearing. Whoever that lawyer was, sure looked stupid telling a seasoned judge to release his client fast because he was famous. That is law school 101 of what not to say.

i have read them. biden charged his political enemy and it backfired big time. these political
prosecutions should have given way to prosecutorial discretion. trumps your president.

Mistakes? Botched execution, now Christine Pike is in the hospital for medical treatment? WTF? Doesn't some authority in Tennessee have a state-issued handgun to end this nightmare?

Why the disdain? I know plenty of REG defense lawyers who talk the talk at that initial client meeting, tout their Google review rating, tout their "Top 10 Rising Lawyer in ______" plaque, charge and collect a big fee. Then proceed to avoid client's phone calls, doesn't do any work on the case and just takes a plea. That would do it.

Anonymous said...

And you signed him up anyway?

Anonymous said...

Everyone is on drugs

I don't use used car salesman tactics.

Those poor oppressed white christian male lawyers suffering from discrimination by voters! Especially egregious in light of the large number of white christian male criminal defendants.

Buhler?

No one’s happy about Perkins coming back to REG. He’s a manipulative, inappropriate horses ass.
