SAD

  By now word has spread through the Miami legal community that a longtime and well known law professor at FIU has been relieved of his position pending a review by FIU of allegations by a law student that he inappropriately displayed a picture or pictures of an animal with its genitalia exposed. The Herald ran an article and we allowed comments about it in the prior post. 

We do not need to pile on - especially since there has been no determination of guilt- only an allegation. Someone’s reputation is at stake and we take that seriously. We will be especially strict with the comments  so kindly act accordingly. We get it is an issue. We just have to thread a needle here. 

Oy. Or as we say in Miami - ay dios mio. 

Meanwhile DOM has all the news about the state of Florida giving Judge Williams the middle finger and not enforcing or respecting her injunction to stop State law enforcement officers from arresting immigrants.  We wouldn’t mess with Judge Williams  if we were you.

A tangent: The constitution vests to Congress the power to impose tariffs but Congress ceded to the President only the power to execute legislative intent. Theoretically, the Supreme Court could enjoin Presidential action for tariffs shown to be in transgression of Congressional intent. For example, and I speculate, a statute which survives Presidential veto, and eliminates the tariff on Canadian lumber could check the President. ... When a pig flys.

Are you serious? Any female that took his class in at least the last decade have known of Scott’s inappropriate behavior and reputation. If you google him rate my professor has reviews from 2018 about it. This special treatment is precisely why so many students were silenced. Scott would frequently tout his connections in the legal community and so many students were terrified of beginning their careers tarnished him. He should be exposed for who he is, as should other members of the bar and bench who engage in the exact same kind of predatory behavior.

And I hope it’s not lost on anyone that this whole “they are only allegations” b.s. is coming from the same people and blog that gratuitously tars and feathers so many people for so much less evidence. You want to rake people over the coals? Then keep that same energy across the board. You won’t, because you’re a bunch of hypocrites.

See the thing is that’s the rub - he was hired as an ethics expert for rhe SAO. They can’t do anything right. The guy they hired gets suspended from FIU. it just gets worse and worse.

You have no idea the crap I have held back on about judges and prosecutors. Trust me I protect more than defense attorneys. In fact most of the comments I don’t post are about Dade ASAs and Judges.

Inflating her top brass’s salaries. While at the same time keeping the bottom understaffed and underpaid. It doesn’t take a genius to see this.

By allowing Fingerhut to remain employed at the SAO, Rundle is opening herself up to a lawsuit. They are on notice of his behavior. This is not one complaint but more than one complaint at FIU. Also how can he remain on staff at Florida Bar leadership Academy.

Unfortunately, these “allegations” have been around for many years. These women just had balls to come forward and officially lodge a complaint. Hopefully Anyone else who felt victimized would come forward and let this be resolved one way or the other.

Well, this gives me reason to doubt (from Rate my Professor):

Professor Fingerhut is one of the most engaging and brilliant professors I've ever had. Also, as a female student who took several of his classes I can attest that he was NEVER inappropriate, he is just REAL. If you're easily offended, need hand-holding, or can't handle real discussions, don't take his class … maybe rethink law school altogether.

I feel like we need more details on the allegations to pass judgment. All I can glean from the Herald story is he showed pictures of animal genitalia in class. Why? I don't know but these are college students if there was some educational purpose I think they could handle it. On the other hand if he is actually sexually harassing students he should not be in a position to be able to do that. Presumably FIU has some sort of due process set up to arrive at the facts, let that play out. Does seem like the SAO ethics position is cursed.

animal genetalia...lol...I have to walk by 4 cocks every time I go to the state courthouse, and then cross paths with a pitt bull with tennis ball sized nuts swinging behind him...then on the way home, I see 3-4 Ford F-150s with balls of similar or larger size, often gold, hanging from the trailer hitch. This is in addition to the bitch in wynwood that just had a litter and has dog boobs scraping the ground as she walks towards miam to see if anybody dropped some empanadas.

Rumpole, these allegations were pending for months. I hope Fingerhut told them before the FIU letter. EVERYONE knew and were talking about it. He was removed from teaching weeks or months before the FIU letter.

I looked at the rate my professor comments, which were nearly all highly favorable. I have known Scott for many years, and my experience was that he never raised "anti-woman lawyer" concerns which are oh so common when a woman lawyer (especially a really good woman lawyer) is dealing with the male criminal defense bar. I don't care why Mrs. Rundle hired him, but I feel confident that his decades of professionalism, deep knowledge of the law, and simple lack of interest in sexualizing the practice of law will be helpful to those in the SAO.
