PERSON OF THE WEEK MAY 12, 2017

It was a quiet week at the REGJB this week...at least for us. We almost picked FACDL, Miami Chapter who will be having their annual soiree tomorrow night. Lawyers will gather and hold their cheap chardonnay and tell each each other with wine-induced grins, "for all we do...this chardonnay's for you."

But then this email crossed our desk from FACDL:

Chief Judge Soto is commissioning the creation a back-up county court trial division. The hope is for this division to be operational in January 2018. AOC, along with representatives from the SAO, PDO and FACDL-Miami will participate on a committee to work out the details. One of the primary objectives of this division is to alleviate the backlog in our jail divisions so clients can have their trials quicker. The impact on regular divisions should be minimal. More details will be shared as they become available.

So Judge Soto, for working to alleviate the backlog in the misdemeanor jail division- You are our REGJB Person of the week.

Take a bow.

From Occupied America, where as startling as it is people are still in jail for Misdemeanors..Misdemeanors!!, fight the power!

ARE YOU KIDDING ME?? More trials in Misdemeanors?? Please the freaking case to CTS and spend money and resources where they are needed. I remember when county court judges tried murder cases in back up. Now what? De la O going to county court to try a jury disorderly conduct? Come on! Get a grip. More on this on my world famous blog.

Please stop this "Person of the Week" nonsense now. Stop before it becomes institutionalized, hollow, and tiresome. Your two recent "Person" posts have been exercises in craven backslapping; accolades were given to low wattage politicians who have done little to stand above the crowd. Please stop now. Real lawyers, clerks, bailiffs, corrections officers, and judges do their (usually) tiresome jobs daily. Their efforts are respectable, even edifying. But, by setting out on your weekly recognition effort you will stimulate the self serving, self promoting grandstanding which is all too common in our learned profession and our justice system.
Respectfully,
Nigel Molesworth

Translation: Mary Jo will have to be replaced by two or more judges. I'd give the award to Mart Jo.

Who the hell needs a county court back up division?

The arrest numbers are way, way down.

Did you see what the 3rd DCA did to Al Milian? Looks like he'll have to move out of criminal because the prosecutors can recuse him on every single case.

Read: State v. Dixon, 3D17-281.

We all know that Al is nuts but, this shows he's stupid too.

Does anyone remember Julie Harris Nelson. I used to go against her and she was a very dim bulb. How is the JNC even considering her to be a judge and preside over cases where she will have to rule and actually make a decision.

State v. Dixon, 3D17-281. Rough rebuke for Al Milian.

1:22 Look on the bright ide of things. Everybody knows that you cannot disqualify a judge based upon his or her rulings. Now, the Third DCA says that when a policy is announced you can. And, what difference should it make where a certain ruling can be established by other evidence. If the Third didn't like what he was doing, it should have reversed him. There is nothing in the record to show that he would not have followed the law if the Court so ruled. I think the decision is a bad one.

"As grounds for disqualification, the Assistant State Attorney identified Dixon's pending charges and current bond status and stated that the State was not going to be able to complete its investigation prior to the twenty-first day (January 17, 2017"

If the State as not completed its investigation, then the Defendant should not be sitting in a jail cell.

Judge Soto good luck trying to staff the back up court. Clerk's office looking at more layoffs. Just saying...
