ANOTHER INMATE DIES AT DCJ

David Ovalle at the Miami Herald has all the details in the story here. 

Go in for DWLS, get taken out in a body bag. Not a pretty picture. 

Joseph Wilner died on the notorious 9th floor of the jail, where they "house" inmates with psychiatric problems. House is really not a proper term. Lets just describe exactly what they do: 
they strip the inmates naked and put them in a wire cage or a plastic bubble. 

The rats have better beds at the DCJ than inmates on the 9th floor. 

So here is the question: who's going to get arrested  for manslaughter for the negligence involved in this man's death? 

And where is our esteemed state attorney and the grand jury investigation for a jail, which like the roach motel, has a motto that "you check in, but don't check out?" 

How many more people are the Dade County Department of Corrections going to kill this year?  Three people have died on the ninth floor this year. DWLS is a damned misdemeanor! We are killing our citizens for driving with a suspended license. This is outrageous. 

And it's more than that: it's a crime.

When they fired Dr Poitier for refusing to use cheaper, non-indicated drugs for psychiatric inmates, they lost a caring, protective supervisor on the ninth floor. They have finally fired the medical director who was responsible for those policies. They need to bring Poitier back. He is one of the few people who continue to care about those guys and help them as best he can in what is a nasty shithole.

DCJ officials have blood on their hands, but they don't care. Indeed, a society can be judged by how the criminals are treated. So sad that Miami is guilty of human rights atrocities. Sad also that the defense bar has done nothing about this. Too many lawyers comfy in their tasseled loafers to buck the system.

Former ASA here.

I admit that I never saw or cared about conditions in the jail when I was an ASA. But I saw how bad it is, particularly on the 9th floor, when I went into private practice. It is really bad.

Security concerns aside, Leifman should have every judge tour the PTDC and the ninth floor. KFR should have every ASA take a tour.

I never wear my tasseled loafers into DCJ - rookie mistake, the tassels can pick up the detritus. I prefer Wolverine boots, sometimes even slickers. Get you facts straight buddy. Since all the people there are PD clients anyhow, this doesn't fall on Miami, it falls on the PDs.

939.06 Acquitted defendant not liable for costs.—
(1) A defendant in a criminal prosecution who is acquitted or discharged is not liable for any costs or fees of the court or any ministerial office, or for any charge of subsistence while detained in custody. If the defendant has paid any taxable costs, or fees required under s. 27.52(1)(b), in the case, the clerk or judge shall give him or her a certificate of the payment of such costs, with the items thereof, which, when audited and approved according to law, shall be refunded to the defendant.
(2) To receive a refund under this section, a defendant must submit a request for the refund to the Justice Administrative Commission on a form and in a manner prescribed by the commission. The defendant must attach to the form an order from the court demonstrating the defendant’s right to the refund and the amount of the refund.

Acquitted defendants have a right to recover some costs but, not attorney's fees.

Well... unless you are a public official... then, it depends.

If he was on the ninth floor he probably had some mental health issue. Which made him a drain on society. Survival of the fittest, gentlemen. Not a single phuc is given by me on this one.

I cannot print an anonymous and unattributed comment about another lawyer being a target of a federal investigation. These are people's reputations at stake here and I just cannot allow such possibly false rumors to be spread. show me a target letter and that's a different story.

Rumpole - thanks for not smearing the names of lawyers just based on innuendo/speculation. It would probably be easy to let any comment onto your blog, but moderation is what keeps this website civilized.
