PHIL DAVIS UPDATE

Whilst on our travels, we received this email from a 12th Street Irregular:

Rumpole- quick and sparse update on the Phil Davis trial. I was in the building today and was told closings would be in the afternoons. No surprise the JOA motions were denied. It's a big nasty paper case and the jury will probably not be charged until 5pm. Most insiders are predicting a verdict Wednesday, but there is no real consensus as to whether it will be guilty or not guilty. 

Rumpole says: Thanks. Anybody see the closings?

Any updates on what kind of dui's are PIT eligible in 2010? All of them? 1st? 1st refusal? 1st dubal .08-.16? Just Dade? FL?

Money line is -160 Not guilty and and -120 guilty.

that was a pretty stupid post by the new times guy, what does he think that Davis said " I'm gonna steal all the money that comes into the program" and KFR approve it ? stupid blog piece by the New Times

Rumpole_ I thought your readers would like to know the very successful results of our two blitz weeks in county court. To date there have been 2,655 cases that were set among our eight judges. 4678 police officers were summonsed to appear in court, comprising almost $345,000 in salary and overtime.

211 cases were closed with a plea. 156 were dismissed. 982 bench warrants were issued and the rest were continued. THANKS TO ALL WHO WORKED SO HARD TO MAKE THIS TRAFFIC BLITZ SUCCESSFUL.

From what I heard about PTI for DUI's, if happening, is this: you need to blow and it cannot be a high blow (either below 2.0 or 1.5...I think 1.5), it has to be a first (a previous breakdown counts against you), and no accident (even if it's not the defendant's fault - no exceptions). You'd basically do all the same dui conditions, then get the pti-knp at the end. The issue that will come up is that there will not be mitigating circumstances, so you either qualify or don't.

I just wonder how this will hurt the defense bar? Shouldn't be that big of a deal short term since most cases that come accross their desk are refusals, but eventually word will get out about pti.

Davis and his colleagues should be ashamed of themselves no matter what happened. KFR and company gave him an opportunity that not many would have. And, we all know how he returned her kindness.

Now he's suggesting that she was aware of what he was doing?

Pitiful. Truly pitiful.

PTI for DUI will really hurt Hersch, Catalano, Reiff, Quirantes, Best, and many others.

How can they charge big fees for PTI?

You don't think it's worth asking what took place in that meeting with KFR in 2003?
Especially when Davis claims he pretty much showed her and a half-dozen ASAs his books?
OK, so it's looks like he's a liar (here's my updated post with Ed Griffith's responses: http://blogs.miaminewtimes.com/riptide/2009/11/ex-judge_phil_davis_convicted.php).
But I don't see why it's "stupid" to ask the SAO to respond to his allegations.

About Davis and this blog-it's a shame that most love to kick people when their down. Juries have been known to find the innocent guilty. Btw the defense attorneys did a great job in showing how the paper trail was just bad bookkeeping. But maybe the jury was more interested in looking at hot Shulevitz than listening to co counsels arguments. I know my ADD would take me there. She's hot!
