"CODE BLUE" - NEW JUDGES BACK IN TOWN

THE CAPTAIN REPORTS:

As many of you know, in November, we elected several new judges to the County and Circuit Court bench. New faces you may see hiding behind those black (and sometimes) blue robes include: Judges Patricia Marino-Pedraza, Robin Faber, Victoria del Pino, Gloria Gonzalez-Meyer, Don Cohn, Jose Fernandez, Valerie Manno Schurr, Antonio Marin and Marisa Tinkler Mendez.

All this week, they, along with 110 other newly elected and appointed judges, went to Orlando for Florida's Judicial College. The faculty of sitting and retired judges included Judges Stanford Blake, Kevin Emas and Sam Slom, among others from Miami-Dade County. During the week of schooling, the new judges were reminded of others who donned the robes who got caught in compromising situations, such as DUI arrests, romantic relationships, pornographic emails, and the recent removal of Judge Sloop from the bench for ordering 11 people jailed for mistakenly going to the wrong courtroom; (they had been directed by court personnel to the wrong courtroom).

Also, during the week, each new judge presided over a mock trial where a host of scenarios was thrown at them to see how they would rule and react. In one mock trial, presided over by one of the new female judges from Miami, (I'll let you guess which one), the case was about a lying, cheating husband who had been stabbed by his wife. During the trial, the attorneys asked to go sidebar, and while they were there, the defendant grabbed the knife and snuck it back to the defense table before the judge noticed. They also threw a few more curve balls at her honor, including a sleeping juror, a gum chewing defendant and a name calling lawyer, not to mention the knife incident.

After the mock trial was over, one of the teachers reminded the new jurist that she must make herself aware of everything that happens in the courtroom, not just the legal arguments.

The BLOG looks forward to critiquing the new judges as they begin presiding over calendars, hearings and trials here in Miami and hopes that the judges remember that most of the attorneys practicing in the REGJB are hard working, dedicated barristers just trying to do their best for their clients while at the same time attempting to manage a law practice and keep their heads above water.

    How to avoid ruling to avoid error.
    How to make a case appeal proof.
    How to make the lawyers look bad and judge look good.
    How to stay out of trouble but, be re-elected.
    How to push us around.
    How to get out of the office by noon almost every day.
    How to have your JA's machine answer the phone most of the time to avoid work.
    How to create rules that make all kinds of work for us just so they can be controlling and assholes.....

  2. Here's how I envision Judge Camp:

    Teaching Judge: No- hold the gavel more at the base-it gives you more leverage

    New Judge: "Like this?"

    teaching Judge: "Exactly. Very good. B+ in Gavel. OK. Now repeat after me. Motion denied. Motion denied. No...you in the back row-- keep your voice even...not too much inflection. Motion Denied. See how the tone stays the same through all syllabals? Better...Better...

  8. Welcome to today's Judicial college class topic: FACIAL EXPRESSIONS AND VOICE INTONATION. This is particularly important when you don't know how to rule, the law, and especially if you have been transferred from an area you know to one you do not. For example: a defense attorney uses the term Bruton, Miranda, or Williams Rule and you were a civil attorney before becoming judge and do not know what those terms mean. Do not say- What is Miranda? do you ; counselor did you file a motion, can I have a copy of any case law you have in support of your position. By all means wait until back in chambers before cursing the lawyer and throwing a book against the wall. I will now accept nominations for judges who need a refresher course, CLE, at the college. I nominate Jacqueline Hogan Scola for the seminar on anger management.

  14. Rump: I'm surprised at your response posted last night at 9:07pm. You noted some faculty from Miami were well-regarded judges like Blake, Emas and Slom (yes,all Gators). You also probably know that other faculty from Miami include: Judges Platzer, B. Scola, Kelly, Barzee, Tunis, Leesfield, Baily, Freeman, etc. Do you really envision any of them, whom you have spoken about in positive ways, telling a judge how to use a gavel. That was a ridiculous post by the "real" Rump we've come to know.

    They rule in favor of the State 99.9999% of the time until they realize cops lie.

    I wish they could all go away for two years and come back with experience.

  17. Think about this, if Bennett H. Brummer is willing to screw his client to stay re-elected, what stops a Judge from doing the same to your client who you know is innocent, but Fernandez-Rundle wants to use as the center piece of her next campaign? Judge school is a secret camp where they talk on ways to stay elected and such. Term limits are needed for Judges. As well, what about Brummer? Slime ball of all PDs in the US. Sucks to be him or on his staff.

  26. All the newly elected judges, with a few notable exceptions (and most definitely all the re-elected ones) have already violated most of the Canons.
