The hallways of the REGJB are alive with chatter, most centering on the antics of a certain circuit judge, in her first term.
The rumors have reached us all the way here, in the semi-frozen north, as we await a verdict.
Our thoughts on the Judge who recently threatened to hold a lawyer in contempt who wanted to leave around 5pm to pick up their children?
COWABUNGA!

You would think our judge would know better after the contretemps a few years ago of the county court judge harassing a female lawyer who needed a break to pump milk for her child.
Let's try to imagine the reasoning that went into the threat.
I'm a circuit judge, which means I am smarter than you and more important than you.
What you want to do upsets my plans. So you cannot do it, even though it involves your child.
Perhaps our Judge wants the lawyer to write a letter of apology?
Dear Judge,
Sorry I am a parent with a young child that is in childcare when I work. I will try and avoid the mistake in the future. Please do not hold me in contempt.
Yeah, this one is a real winner.
And people wonder why we try cases in other states.
Many of these judges are pussies; get all aggressive and in their face , tell them to preside over the case and not your life and threaten to take the issue to a higher level ..:these judge hardly want problems. They’re bark is worse than their bite

ReplyDeleteThis brings up a very interesting topic in regards to people in the position of power. At what point in their career do they believe they are above everyone else and think it's ok to belittle, talk down, verbal abuse, threaten/bully etc another person?

ReplyDelete2 I am not done with the swiftees. Not by a long shot. For Super Bowl weekend we are going to have a lyrics face off. And they cannot win with her insipid nonsense.
I could not disagree more with these anonymous comments about Judge Cabarga-I have had numerous cases in front of her since she took over from Judge Simon.-She is intelligent, thoughtful and not afraid to rule for the defense (I have won a PVH and MTS in front of her which I cannot say for several of our other judges)-she once held up her own schedule to wait for a State witness that missed multiple depositions and was ordered to Court (which they kept saying would be there) and after waiting for almost 2 hours I got the correct result- she also has shown compassion to a client on probation for armed robbery and deemed after a dangerous hearing that he was not a danger and gave that young man another chance. Finally when my wife was ill not only did she give me the time that I needed on a case but went out of her way to seek me out and ask how she was doing the next time the Judge saw me.
ReplyDeleteIncredibly happy for your experiences and the compassion and civility you were shown. It’s unfortunate you think that your experience is the universal one and can’t have empathy for other people who have seen and experienced differently. PA’s are able to come in for one or two cases and be on their way. PD’s are in there day in and out for entire calendars. The experiences, especially with this judge, are not the same.
DeleteI recall back in my ASA days, telling a judge's JA, that I was a single dad, raising my daughter, and that my daughter's mother did not live in the area. The JA indicated the judge was in recess and not available, and that I need to wait.
ReplyDeleteThe school told me my daughter was injured, and needed a parent to pick up her immediately to take her to get medical treatment. The JA told me that I needed to wait, as a mandatory hearing was scheduled (which I had already waited over an hour for before the recess), and that I had zero permission to leave.
I told said JA, "Have the judge issue a criminal contempt which I will deal with when I get back." The defense had no issue with me leaving. The JA was furious. I left and came back the next day. I was told the hearing was rescheduled and all was well and no contempt was forthcoming. Happened about 15 years ago, but still remember it well.
Not the first time she's done this to a PD with child at home. As a mother of 2, you'd think she'd be more understanding.

Actually Rump,cowabunga was uttered by chief Thunder cloud,on the 1950’s Howdy Doody show, when he was frustrated by Buffalo Bob Smith. It became a surfer term as you mentioned, in the sixties and was later perpetuated by Bart Simpson who brought it up to date. “Don’t have a cow man”. Sorry to show my age.

ReplyDeleteWhy are we dumping on Carbarga? I too have seen her in a "bad mood" and be unkind but, nothing and I mean nothing compares her to Milton Hirsch. If you show up one second late, he insults you, shuts you down and is a horrible jerk. Milt, did it ever occur to you that there are other judges in that building who may not quote Shakespeare but, deserve our attention at 9:00:00 am sharp? I think Milt needs a female Hispanic opponent.

ReplyDeleteSame judge who refused to reschedule an Arthur hearing on a newly-filed capital case when the prosecutor ended up in trial, forcing the release of a man accused of raping multiple children. She later expressed regret— not to the lawyer, of course.
ReplyDeleteI am amazed that anyone wants the job of chief judge or administrative judge, let alone that ours are universally great. Imagine having to try to be in charge of all these idiots. I'd rather be a preschool teacher, at least they take naps sometimes.

To 11:40 comments- I am a private attorney and am not hiding it (here is my name 10:04-most people could figure it out)-I have no affiliation with any reelection for the Judge but I have had in excess of 20 cases in front of her and have gotten to know her well- I have been in the REG for close to 25 years and have seen many good and many bad judges go in and out and she is one of the very good ones -I just saw one judge who I will not name have a compete meltdown on the bench about 2 weeks ago- never seen her to do or cry on the which is plainly insulting-and just to defend this particular incident which I had no part of- I was told by one of the attorneys that certain people were walking in and out during a charge conference to the jury which was interfering and would get any Judge incensed -and as for temperament the Great Judge Diane Ward had quite a temper -did that make her a bad Judge- or person- get some real experience and then talk to me.
