    ELIZABETH HOLMES SENTENCED ....

    Holmes received 135 months (more than 11 years) from Judge Edward Davila. Holmes, who has a toddler at home, and is also pregnant, addressed the court before sentencing, and said: "I am devastated by my failings. Every day for the past years I have felt deep pain for what people went through because I failed them". "I gave everything I had to building our company and saving our company. I regret my failings with every cell in my body".

    Judge Davila did not enhance her sentence for harm to patients as she was acquitted on those charges. He also did not enhance her for a leadership role finding that did not apply to the head of a corporation but was reserved for organizers of criminal activity. The fact that she did not accept responsibility did count against her.

    The Judge determined the Guidelines at between 11-14 years. AUSA Schenk asked for 15 years. The defense attorney, Kevin Downey, asked for 18 months. He argues that Holmes used all of the money to build Theranos and not be buy yachts or a mansion.

    Judge Davila found that at least ten investors were defrauded out of $121.1 million dollars. Prosecutors had argues that the lose was $804 million while the Defense argued for between $44-48 million.

  11. So she got pregnant twice after arrest in hopes of a sympathy sentence. 11 sounds a bit light, but I guess she at least gotta start her time at an actual prison, instead of Martha Stewart's camp.
