As reported by NBC6 Miami, JAC has ordered one court appointed attorney to repay 282 thousand dollars in court appointed fees that could not be accounted for. The commission held a hearing. There was significant incredulity about the billing of more than 24 hours of work in a day more than 44 (That's Reggie Jackson's number with the Yanks BTW) times.

Meanwhile, the City of Miami Beach continues to prosecute people for taking pictures and videos of police officers...except when the case is set for trial. Then they run faster than a judge from a bar tab.
Ace Herald Scribe has all the details of the latest act of cowardice of CMB here and their prosecutor Yoe Lopez dismissing a case a year after arrest as it came to court for trial. Lawyer Dan Tibbitt, who doesn't take sh$t from any prosecutor or judge, and has won some very big cases, was ready for battle and took the win.
Yo Yoe! Your reputation is worth more than whatever Miami Beach is paying you to wreck the lives of people taking pictures. Are you going to arrest Ovalle if he takes a picture of a cop making an arrest? Or if he takes a picture of you getting your case whipped in court?

Ah so that's who the overbiller was. Found it odd that the attorney's name escaped mention. Rump is not shy about naming other attorneys and judges he disapproves of.

ReplyDeleteNice try with Reggie Jackson and #44 but the Gold Medal in this category goes to Hank Aaron who also wore #44. More importantly, Aaron hit 44 home runs 4 times in his career. There has never been another player who matched his season home run total with his jersey number as many times as Hammerin' Hank.

ReplyDeleteBack when I started doing appointed cases, I think it paid $40 per hour for out-of-court work and $60 for in-court time. On top of that, there was a ridiculous lowball maximum payment which you needed special approval to be paid in excess. Even for a young attorney that is not enough to live on. What is it at now? Would each of us work for that much? The only ethical path for a lawyer is to be forced out of doing that work, unless you are subsidizing that work from other clients or wealth. But it is hypocritical for society to condemn those who succumb to the financial need created on purpose by the government to bill enough underpaid hours to live on. Not to make a good living for a lawyer, mind you, but enough to pay the bills and get by.
ReplyDeleteThe death penalty wheel makes a lot of money. More people are trying to, and thankfully have, gotten on it. Trying to break up an old white mens club. I’m sure they believe in the work, but they aren’t doing it for charity. There is money in it. Rae has to pay back like $280k of I think $2.8 million she made in the last few years.

What about the practice of some local defense lawyers to pay off the DEA for information on their next narco arrest so they can illegally solicit the target beforehand and get hired??

ReplyDeleteLet me be clear. I think the over billing scandal really gives our profession a black eye. These clients need good lawyers. The state wants to pay for people with no experience to take the case. Take some depos for 7500 and then beg for life. We know these cases result in serious miscarriages of justice and need really aggressive and experienced lawyers. But then we have people who over bill and it plays into the state and JACs hand in lowering fees and costs.
ReplyDeleteSecond. I do know Rae and I think she is an exceptional lawyer and I am very sorry to see her in this trouble. I wrote the post the best way I could. I give her the benefit of the doubt but she apparently doesn’t have an explanation for the 44 times of billing 24 hours in a day. And that really makes me sad for her. But it deserves comment and that’s why I wrote the post. And why I print the negative comments. I never professed to be a neutral member of the media. I’ve been in this business too long and have too many friends to claim that. But I do my best. There is nothing worse than when a friend gets into trouble and I post it. It sucks.
Call me a hypocrite. I am what I am and make no apology for it and don’t hide it (other than my identity duh)
