 DOM'S  blog covers his never ending obsession with pro se litigant Fane Lozman who, like DOM, continually beats the government. Birds of a feather flock together. 

Somehow (we think) that everyone's favourite federal blogger missed this little lawsuit:

Which ex-president has filed a lawsuit in the SDFL to force Twitter to give him back his account:

[ ]  Benjamin Harrison (account @potusyouknowleastabout)

[ ] D.J. Trump 

[ ] Hillary Clinton (trick answer. She wasn't the president in our little sting of the universe. Hopefully in other universe string realities she is finishing her second term. 

Which current SDFL US District Court has this little gem of a lawsuit?

[ ] Judge Moore, who immediately issued a pre-trial order denying all continuances?

[ ] Judge Singhal, who Trump thinks owes him? 

[ ] Judge Scola, who clearly has better things to do than this headache?

There are eight (count em, uno-ocho) lawyers who have signed off on this lawsuit, most likely to spread the costs of frivolous lawsuit sanctions ( we are making NO judgment about this lawsuit, merely commenting that lately, lawyers who have represented the former president, albeit in a elections lawsuit context, tend to get sanctioned), but the most interesting thing is that this clown of a former president has hired a law firm with a named partner of ....(wait for it) 

BARNUM!

  1. I did 5 minutes of research and guess who is a partner at that law firm in the Gables who is the main lawyer for Trump? Guess? No really guess?

    Carlos Trujillo. I remember him as a prosecutor. Dishonest and a bully. No wonder.

    BTW, Trump gave Carlos a job too.

  2. How dare trump (Putin's puppet) think he can use the court system to argue that elected officials are openly calling for him to be censored and pressuring big tech to do their bidding? When Facebook complies (under threat of regulation), that's clearly NOT state action! Everything he says is Russian disinformation anyways! Who are the lawyers on this lawsuit? Barnum? Russian stooge! If you have a problem with Facebook and Twitter silencing your political opponents, maybe you shouldnt support a white supremacist! Do better! Check your privilege! These lawyers should be disbarred! Sanctioned! Get in their faces! Film them in the toilet!

Here's the problem with this ridiculous lawsuit - Plaintiff alleges "On January 8, 2021, Twitter announced that it was suspending Plaintiff’s account(s) indefinitely, claiming falsely that Plaintiff had incited violence and, therefore, must be suspended under Twitter’s 'standards.'" (D.E. 62. p. 2 of the brief, p. 8 of the pdf).

    Two things:

    1) On January 8, 2021, Plaintiff was still POTUS. Congress passed no statute that was vetoed and overridden. Unless the POTUS took state action against himself, there is no credible "state action" against the Plaintiff here at a time when he was the chief executive of the state.

    2) Twitter's announcement that the Plaintiff has incited violence is its opinion. And it has the right to hold that opinion and to make reasonable policies for use and access to its services based on opinions that are not related to protected class status. And last I checked, being an asshole (which is basically what they opine the Plaintiff to be) is not a protected class.

    I understand that the Plaintiff doesn't like that he was banned from Twitter and that the Taliban were not banned. So? The remedy is for him to point this out to whomever will listen on whatever platforms he can get on (Fox News?) and convince all of us consumers to pressure Twitter to change its policy.

  5. 9:16:00 - Go back down your rabbit hole. Joe Biden is a good President and so is Kamala a good Vice-president. Less than a year on the job and they've already shown America what a real Pres/VP are. They don't lie, they actually care about Americans, and they are willing to engage Republicans who actually believe in negotiating. Trump was the worst EVER. Hopefully someone will put him and his family in jail where they belong. I'm thinking tax evasion and treason are two of the reasons.

  9. I remember Carlos Trujillo as a prosecutor. Not a nice person and he made it clear he cared less about justice. He wanted to win even if that was not justice. Me no fan of Carlos Trujillo. I heard Trump is looking for someone to cut the grass at Mar a largo... Carlos apply now!

  10. It is fascinating that left wingers can use all sorts of incendiary terms towards others, but they themselves are without sin. How can anyone claim that a president who has been caught in a number of mistruths and a vice president who only giggles are just wonderful. President Biden currently is approved by 38% of the voters. I guess everyone else is just a moron, but I hope that none of those morons has the audacity to appear at a Board of Education meeting and make suggestions about the education of their children. That is best left to the far left wing teachers' unions.

  11. You have to love the irony here. Republicans are supposed to be the party of limited government. They are the party who has traditionally said things like, "it's my bakery, I can serve or not serve whoever I want and the government should not be interfering in that decision."

    But now they (or at least the Trump wing of the party) are taking the position that Twitter doesn't have the right to serve or not serve whoever it wants.
