FLORIDA'S CONSTITUTIONAL CRISIS

Florida's Real Men Don't Wear Masks Governor held a news conference today in Miramar (Motto "we got nothing special")  in which he not only dared the Florida Supreme Court to stop him from putting Judge Francis on the Court, he Double Dared them to stop him.

The Florida Supreme Court had given the Governor who has presided over the unnecessary deaths of more Floridians than all other of Florida's Governors combined, until Wednesday to respond to what appears to be a show cause order as to why the court should not order the Governor to wear a mask to appoint any other eligible lawyer in Florida to the Supreme Court.

DeSantis said "no way Jose!".

Thwack...the Ball is now in the Florida Supreme Court's court. Their bet has been called. Will they now order the Governor to appoint someone else?

On September 24 (which hereinafter will be known as the Judge/Justice Francis' Bar Admission Anniversary) Judge Francis will officially be a member of the sisterhood of the shark for ten long years. You do not often encounter that type of experience in every day life which is why her selection to the court is soooooo special. On that date, Judge Francis can become Justice Francis but for the slight obstacle of the Florida Supreme Court who has previously ruled that when a Governor makes a judicial appointment it cannot be for a future time.  So this could be a problem of a Constitutional magnitude.

Except that our Governor, a devoted Beatles Fan, is basically quoting John Lennon: "there are no problems...only solutions" and his solution on Wednesday was to legally say "Oh yeah? Sez who?"

Rest assured we are following this from afar. Socially distanced, yet intrigued.

  1. I think it is important to support our wonderful governor who knows that If this appointment doesn't work out there are a whole bunch of people like myself and my colleagues- experienced judges of the court who would be willing to serve if asked. The governor should obviously choose a trial judge in circuit court like myself. County court judges just do not have the experience for the types of tough cases us circuit judges handle.
Just sayin I've been a member of the Bar for more than ten years. My former partners were never members, but that doesn't matter. And I myself am a colored woman too.

  2. Would we be having this same conversation if he appointed a janitor at the justice bldg? Both are equally unqualified to be on that court.

  3. The Governor and his lackies(the Florida JNC) made sure that there was only one African-American or Caribbean-American to pick. They eliminated the competent in favor of the ineligible, and refused the follow the Florida Constitution. "We the people" had to rely on a state legislator to insist. None of the "textualists" accept any blame--least of all the Governor, who doubled down in his press conference.

  4. What an unbelievable disgrace that Barbara Lagoa is on the list to be nominated to SCOTUS. A politically manipulative husband, with the assistance of Hector Lombana falling on his sword to get her out from under her demands for a year leave of absence from the US Attorney office and unethical behavior while on the 3rd DCA are now being packaged into a SCOTUS nomination, if Trump gets re-elected.

This "jurist" has no qualifications for SCOTUS, and I commit myself to making sure the Senate Judiciary Committee hears of all this, if she is even floated for nomination. Her conduct no only exhibited a lack of ethics (she participated in violating the rules of the court and attempted to deceive her colleagues), but is an acknowledgement of her lack of judicial intellect.

  5. Perhaps the governor was trying to name a Black to the court, or are we thinking that everyone on the list was agreed to by him. If he cannot appoint her, I guess he will appoint someone else on the list, but I do understand that it would have been better to have a governor with a drug problem who spends his time naked on the floor of Miami Beach hotel rooms with other Gs. Oh to have the wisdom of a progressive!

Look, edyacaton, bar reuslts, trial expreiance is wayyyyy overrated.
Name recogition is the main ussue. A grat lawyer has a grat name and a gart name makes yuou a grat judge.

  11. The anonoymous poster at 11:12 said anyone voting for Joe Biden is a joke. I guess that I am a joke. Whoever you are you need to quit drinking the Trump kool aid. How many books and articles and interviews do you need to be exposed to before you finally get it: Trump is fucking crazy? At least I have the right to an opinion and am willing to sign my name.
