Orenthal James Simpson was granted parole today in his nine to thirty-three year prison sentence for the contretemps in a Las Vegas hotel wherein he participated in a poorly conceived and poorly executed plan to "rob" the individuals who had some of his sports memorabilia.
Longtime and careful readers of the blog will remember that OJ was also prosecuted in the REGJB.
While his lawyer in that case-Yale Galenter- won it, he lost the case in Nevada in what was a widely criticized performance of abjectly poor lawyering. Having watched the Nevada case, we join in that view.
It's hard to have sympathy for Mr. Simpson. While acquitted of the cold-blooded knife murder of two innocent people including his ex-wife, our view of the evidence is that he was clearly and undoubtedly the killer.
There are many reasons why OJ Simpson was acquitted, race being at the top of the list. But there was also poor police work and very good defense lawyering. Lee Bailey's cross of Mark Furman-the lead detective-criticized at the time- was in fact well done, having gotten Furman to continually deny having used the "N" racial epithet, when in fact the defense had lots of evidence that Furman continually used the word. The cross was a great example in how a defense case is prepared and presented. Sometimes you pass up the opportunity for the "wow!" moment to bring the chickens home to roost at the end of the case.
But another reason was that the defense used a jury expert and conducted mock trials and learned the type of juror who would be sympathetic to their client-African American females. The prosecution didn't use a consultant, and one could argue that the case was pretty much over after jury selection in which there were ten women, nine of whom were African American.
Should parole have been denied based on Mr. Simpson's prior murder case for which he was acquitted?
Probably not. An acquittal is an acquittal (except in Federal court, where it is not: see, Dowling v. United States, 110 S.Ct 668 (1990)).
OJ will be released October 1, 2017 and we will give you one guess where he wants to live?

ReplyDeleteI was in a doctor's office waiting room yesterday listening to a black family all excited that OJ is getting out. I'm white. I don't get it. They were so happy for OJ. To me, he's a murderer.
Boy, we have a long way to go with race relations in this country.
There is a tricky way to channel the murder into the parole hearing. They should have pursued this line of inquiry. "Mr. Simpson, your wife was murdered in 1992. We must accept the fact that you did not do it since you say so and you, of course, are an honest man. But as an honest and reformed criminal and a concerned husband, can we assume that you will spend every waking hour of your release searching for her killer? And, by the way, while you were in prison, what efforts did you make to help the LAPD find the real killer? Because if you did absolutely nothing and will continue to do absolutely nothing, what kind of man are you that is deserving of parole?"

ReplyDeleteAttorney Richard Strafer, appellate attorney extraordinaire, passed away at the age of 66. He apparently contracted a mysterious infection while on a European cruise and lapsed into a coma. Richard was working at Roy Black's firm. Our thoughts and prayers go out to the family as well as to the entire Black firm. Reported in the DBR online this morning.

ReplyDeleteDecember 27, 2017 --- OJ arrested for domestic violence in his Kendell home. Case falls in front of Judge Martin Zilber. Defense Attorney is now RICK FREEDMAN and Andy Boros. Yale Galnter watches from tv and says "oy vey". SIR KENNETH? Doesn't care. He is in his soaking pool in St. Barts in a beautiful custom Vilebrequin bathing suit covered in tiny images of Teddy Mastos's. Wonderful. The world is just as it should be.
Black people love the fact that OJ is out and was acquitted of killing two white people. 836. If you cannot figure out that the black community, most of them, consider this a minor victory compared to the injustices of slavery, deprived of jobs, Brown v. Board of Education, cops killing people unjustly for traffic infraction. 836: if you could not fathom reasons for blacks celebrating a minor victory of a black getting away with murder in light of all the injustices done by whites to blacks, and continues to this day, then you are unfit to practice felony criminal law.

ReplyDeleteMy brother Jorge Armando Covarrubias, CDCR T23089, was wrongfully convicted and sentenced to 30 years to life under the terms of an unknowing and involuntary plea bargain.
He was convicted for Second Degree Attempted Murder PC664/187 (5 years) plus the gun enhancement, 12022.53 (d)(25 years too life). Total= 30 years to life.
Both, the former trial counsel and the former District Attorney who prosecute my brother’s case has submitted affidavits stating that the conviction was obtained by fraud and duress.
Jon A. Divens SB 145549, my brother’s trial counsel just admitted he used my brother’s inability to understand English to improperly advised him to enter into a plea bargain of 30 years to life, for a crime he did NOT commit. Divens disbarred by practicing law in California after being found guilty of committing several crimes of moral turpitude and fraud. Also Divens is being prosecuted in Indiana for several crimes.
The Honorable Lillian Vega Jacobs, former District Attorney who prosecuted the case presented an affidavit stating that she observed my brother hesitant and reluctant to enter into a plea of guilty, and that she did not believe that Jorge would accept such plea, because that is not a plea at all.
My bother received a harsher sentence than those who have committed rape and/or have killed another human being. The difference here is that my brother was completely illiterate in writing and speaking English and had NOT prior criminal record in the United States nor Mexico.
We have tried unsuccessfuly for 17 years to prove the truth but ALL our atempts have been unsuccessful.
My brother attests that the court intérpreter Cecilia Alcaraz never explained to him the truth in Spanish about court proceedings nor about such plea bargain. He was unable to understand because at that time he was complete iliterate un writing and speaking english.
At this time we are trying to obtain a declaration from the Court intérpreter, but we have no concrete answer from her. She is afraid of something.
In the last conversation I had with her, she informed me that the Los Angeles’ County District Attorney Office told her to avoid problems, “Keep her mouth shut,” and not to answer my emails or phone calls. However, we continúe with our figth to show the honest truth. The truth that my brother’s language inability was used against him, and his due process rights was violated. A right well protected by the California and US constitutions. Is this justice?
Jorge told me that all he wants is to show the truth, that he is innocent of the charges, that he did not sign nor agree to accept such plea bargain, and to be deported to México.
Please help us to find justice.

if the prosecutors had been acting in a civil trial, they would have been sued for malpractice. they committed one mistake after another and in large part because of that, OJ walked.
