SO MUCH FOR PEOPLE NOT READING PRIOR POSTS

Our extremely well written golf post on Jack Nicklaus's amazing win at the Masters in 1986 was roundly ignored, while the comments came flowing in on the prior post about the Dade Prosecutor arrested in Broward for DUI and LSA.

Reports indicate breath and urine were refused.

Reports indicate that the prosecutor may have threatened the job of the arresting officer. If true, this would be a disappointing turn of events.

Because there are no coincidences in life, the case has been assigned to embattled Broweird Judge Destry, who is being challenged by another Dade ASA.

Truth is stranger than fiction.
And Broward is one of the strangest places on earth.

See You In Court.

  1. Destry, that's a tough draw

  2. I thought your poetic phrase of Nicklaus and 86 was amazing. You did it justice.

Not the Captain Fact Check number three:

Nicklaus' drive at 17 was way left, not way right. Of course, that didn't matter to Jack, who hit it within 18 feet of the cup and made the putt for birdie.

    Thanks for the memories.

  3. Don't know that the case stays in Destry. The only two felonies charged are the two Child Neglect charges. Not convinced that the ASA prefiling the case will file those charges. If not, then it's a bind down to CC and a new judge.

  4. The felony child neglect charges should be no actioned because the DUI statute creates a penalty enhancement for children in the car when the driver is DUI, so it's likely that the DUI's and LSA will end up in ciunty court.

  5. Hard to believe that not everyone still marvels about a golf tournament thirty years ago....

  6. I have handled a few felony child neglect and the DUI with kids in car cases. The law says that the more specific statute controls. The DUI statute makes it a misd. Child neglect is a felony and a rather nebulous statute. The DUI should control, unless, of course, she where to beat the kids in the car while driving.

  7. When Al Milian was arrested for DUI, he told the cop this...

"You know who I am...(cop said no)... well you're going to find out who I am..."

Rump, this is public record so, publish it. I know Al's refusal suspension stuck and the DUI was tossed but, he bullied his way through a DUI arrest and he's a judge now.

The ASA will probably be fired.

George Bush had a DUI conviction and Dick Cheney had two so, why is it we want to fire everyone for a DUI arrest but, we let those two mess up the entire country for 8 years.

    1. He's a judge now because the people of Miami-Dade voted him into office. The others likewise got their positions because the people voted them into office. Grow up. There are ways to properly have a say in just about anything.

  8. 99% of Americans would rather watch a judge read jury instructions than watch or hear about golf

  9. A golf tournament from before I was born vs pretty much anything else. Anything else wins every time

  10. Last time I checked LSA was a 3rd degree felony (316.027). Even though it was a "minor accident" once the press got wind of this, and with 1-800-car accident, 411-pain, 1-800-call-robert, and all those other ambulance chasers I wouldn't be surprised if the person has an injury.

  11. I read the A form on the prosecutor. It's in the clerk web site and free to download.

KFR and Don Horn will fire her for trying to badge her way out of this. They hate that.

You'd also think she would know not to say she's on all kinds of pain meds too.

  12. What a wonderful and fascinating story about that golf game 30 years ago--anything on the winner of the 1980 championship bowling tournament??? DMD

  13. I couldn't agree more with your characterization of Broweird. I've been negotiating a .23 gram coke possession with one of the ASA. Best offer for my client with one prior 10 years ago: 6 months Broweird County Jail. I'll plea this one to the Court

  14. Broweird. The county where an old white jewish State Attorney sends out his gung ho ASAs to put mostly black and brown defendants to prison. And the old white jewish judges are more than happy to oblige. Dont be black in broward.
