Couple of big verdicts Thursday:
Alex Michaels WON his case before Judge Johnson with the jury returning a not guilty verdict Thursday afternoon. Couple of hard fighting ASAs took the loss.
ASA Gail Levine and company WON their before Judge Tinkler-Mendez case of the defendant who murdered retired Police Captain Bobby Yee. PDs for the defense.

JUDGE ALFONSO SEPE HAS PASSED AWAY ...... We received this in our in box:
Our dearest father, Judge Alfonso Sepe, passed away last night while surrounded by the love of his 16 grandchildren, children Arvi, Cindy, Kevin and Sonny, and wife Phyllis, other family members and some of our closest friends. Our dad was a brilliant man who was full of stories and accomplishments that impacted our family and community as he served as a lead prosecutor and then criminal court judge for our state for decades. But for us, his greatest accomplishment was how he created a family that is now full of love and commitment toward being with one another in those good times and in those not so good times. We love how he taught us to have courage, to have a healthy competitive spirit, to love public speaking and to love to learn. We will miss you, dad, so much, but you will always be in our hearts.

Cops secretly taping conversations with lawyers in hallway interviews? Police chief says its legal to secretly tape people?
ReplyDeleteIt's time we all put our iPhones on record when dealing with these sleazy cops. Expose the lies. They can't object; their chief says perfectly legal.
And of course it's Miami beach, the worst of the worst. Giving a bad name to all good and hard working cops everywhere.
Under the statute it is legal. It is not a constitutional issue, as Carlos states. Nor is the answer is not depositions. The answer is ASA's taking the time and trouble to be present at the interviews in the hallway.
ReplyDeleteHard to believe that the passing of Al Sepe elicits nothing. The Herald is silent as is every other news source one would expect to carry it. For better or worse, he was a very large part of this community's legal's history. Yes, it was a different era but how quickly we forget.

ReplyDeleteIt is not legal. Cops can record without consent for a legitimate investigative purpose. This procedure clearly is not.

ReplyDeleteThe ASA's are present for each and every hallway interview. It is currently unheard of to do a hallway interview without an ASA present. If defense attorneys started secretly recording hallway interviews, we would be set on fire in open court.
ReplyDelete10:25- I had the same reaction this morning when I saw that there was only a paid obituary in the Herald. However,I received a call today from David O'Valle for information about Al. He is writing a story.
ReplyDeleteThere is precedent for Alex's situation. See Vizzi v. State, 501 So. 2d 613 (Fla. 3d DCA 1986). I remember seeing Carl Vizzi being led into the court holding cell at the end of the trial, while his client was released and walked out the front door of the courtroom, a free man.
