UPDATE: The trial is continuing through next week. The trial has gone smoothly witnesses report, since the contretemps earlier in the week.
Indeed, after court concluded Friday, the judge and both sides all went out for happy hour and laughed over the week's events over a few cold ones. Okay- that last part is not true. But things are proceeding smoothly and there should be a verdict next week.
Let's stop the rumor mongering (We know, the whole pot calling the kettle black thing) and tell you what we know.
Alex Michaels is in trial before Judge Charlie Johnson.
On Wednesday Alex did an amazing job taking apart the prosecution's eye witness on cross-examination.
Alex was also held in contempt on Wednesday. The reasons have not been made public. There are rumors that the judge will issue a written order.
The trial is on-going.
Alex is NOT in jail, as we write this.
Standby for more news as we get it. That's a figure of speech. You don't need to stand and you certainly don't need to be near us. You get our point.
In other news. Donald Trump announced that Alex has his full support. Are we seeing a possible appointment as Attorney General in the Trump administration? How about US District Judge, or even a Court Of Appeals spot? You never know.

ReplyDeleteAccording to O'Valle at the MH, this time is was for repeated outbursts and for throwing a pen in court; not sure at what or at who; among other things. Judge Charlie Johnson sentenced him to a week in jail. The Attempted Murder trial is proceeding forward.
He threw his pen at the jury and it hit the jury box.
ReplyDeleteThe judge should not be sending lawyers to jail for a tantrum or for throwing a pen. Assuming that is all true Alex can be fined, reprimanded, reported to the Bar etc. This is not Cuba, China etc.

ReplyDeleteIt is baffling and suspicious to me that there has been nothing on here about the two very recent signed 3d DCA opinions (released on the same day from different judges) expressing concern over "excessive" 6 month contempt sentences. Yet much is written about thrown pens and confiscated phones. What gives?
ReplyDeleteI read those opinions recently. I too was surprised that this was the first mention of it. When both defendants immediately apologized, I almost agree with the 3rd. 6 months was more than excessive.
DeleteI was not in court but I do agree. Throwing a pen is not enought to go to jail. The mad dog threw a pen in trial against big Ed in front of judge young. There, judge young declared a mistrial and jeopardy attached. It was a spectacle and but the case should not have gone to trial in the first place, so it was good. Alex crossed the Danube river swimming crawl stroke- bullets hitting the water around him. He swam to freedom and now he defends people's freedom. Judge Johnson will sleep on it and purge the contempt.

ReplyDeleteA second adjudication of contempt. This type of behavior has to cease. Throwing your pen at the jury box in an attempt to intimidate the jury or witness and being constantly disruptive is not what our system is about. It is time for Mr. Michaels to be suspended from the bar for 91 days. When he can show he is rehabilitated, the bar examiners can recommend his reinstatement.

I can not imagine how the professor could take a position like he does. 91 days means one needs to reapply to the fla bar. An extreamly harsh position. Nor can I can imagine how rumpole could gave this putz special blogging privileges- they were rightfully revoked. I have been around the block and back. I watched the mad dog throw a pen once and nothing happened to him. The mad dog is a fighter and a good lawyer -even though sometimes he needs the muzzle. He bites hard. Alex is harmless and he has a great heart. He is also a fighter who swam the Danube. Stick to the law and stay out of the way of facts just like a good professors.
ReplyDeleteAlex is a good lawyer and great guy. But, he is totally out of control. Charlie also is a great guy with a very even temper. I have no problem giving Charlie the benefit of the doubt on this one. I disagree with the notion that Charlie should just refer him to the Bar (frankly, Alex is probably better of with the week in jail than the Bar referral.............though I suspect that they'll pick up on this one courtesy of the Herald).

ReplyDeleteJudge Charlie Johnson is easily one of the most leve-lheaded and calmest people you'll ever meet . It is hard to imagine what a lawyer would have to do to have Judge Johnson issue a contempt citation . Alex tries more cases than anyone, but he needs to step the game down a notch . If he can get Judge Johnson to hold him in contempt, that he is probably gone way over the line

But, no, his only offense is NOT fighting too hard for his clients. Alex has been crossing lines since he started. Many of his more over the top comments and acts had nothing to do with fighting the good fight (you think throwing a pen or calling a prosecutor stupid is fighting for a client?). Jason (who also is a fighter) is right. Alex needs to settle down.
I just hope the Bar doesn't hammer him for this one. In the end, Alex is a great guy who just needs to exercise more control.

Hey Captain. It's the Florida Bar and the Board of Governors who make the rehabilition call. The Board of Bar Examinets would only make the call if he were disbarred and seeking reinstatement

ReplyDeleteAlex is funny and I like him on a personal level, but no lawyer should behave the way that he does. It's hard to tell if he cant or wont stop acting like a jerk. He doesn't need to, he's a pretty good lawyer.

If this clown pulled these stunts in federal court here or in NY he would never see the light of day. I have earned more with just one of my fees than this idiot has in his blighted career. He is a true bottom feeder. Rather have the PD then him anyday even for a jay walking ticket.

ReplyDelete9:05 - that is just my point. He will not abuse the Federal judges or misbehave in their courtrooms, but he feels free to do as he wishes in state court. It is time for the Circuit and County judges to put their foot down, control their courtrooms and end this buffoonery. Another adjudication for contempt would result in a 91 day suspension. PERFECT.
ReplyDeleteBaron is correct, it would require a petition filed with the Florida Supreme Court, then referred to Bar counsel for investigation. It would be up to the Florida Supreme Court as to whether the applicant should be readmitted. I would suggest that it would take at least a year, if not two before Alex would be readmitted. That would be just fine.
Wait, wait, wait. So even after all that transpired in the courtroom, he STILL WON? Ouch. The ASAs take the BIG LOSS.
