2014 Judicial Poll
The 2014 DCBA Judicial Poll will be conducted electronically and e-mailed to all members of The Florida Bar in the Eleventh Judicial Circuit of Florida* on July 16, 2014. The deadline to complete the Judicial Poll is July 30, 2014 at 1:00 p.m.
Poll results will be released on July 31, 2014 at 10:00 a.m. in the Association's Executive Offices and will be posted on the DCBA's website. We hope that everyone will take the time to vote.

Here is what you need to know:
The Defendant, Guy Bailey, is 75 years old. He is an attorney; or should I say WAS an attorney before this mess. He was convicted of First Degree Grand Theft after a jury trial. He scores State Prison. The State asked for State Prison. The Defense filed a Motion for Downward Departure.
Judge Hirsch, decided to write a nine page sentencing Order that quotes from the like of:
Shakespeare, Plato, and Oliver Wendell Holmes; just to name a few.
WORD OF THE DAY GUYS:
Get to work and define the following words, all used in the Order:
Malapropism
Deontological
Tautology
Septuagenarian
Sedulously
Penological
In all seriousness, it is an Order worth your time to read. Not for the big words, or the quotes from famous dead persons, but for the proposition that prison is not always the proper sentence. And Judge Hirsch advances that argument in his well written Order.
Have a great weekend and stay out of the direct sun, lest you end up like some of those that are quoted from in the Order.

This order is an outrage and should be appealed. Among other things, it presumes that a lawyer who steals money has already suffered enough because of his fall from grace due to his actions. It encourages the public to believe and in fact proves that lawyers get special treatment.It also assumes payment of restitution from someone who was convicted because he stole money and didn't repay. The assumed recourse is a paper judgment for treble damages. Bailey is experienced enough to hold nothing in his name. A criminal belongs in jail. Bailey is a criminal.
ReplyDeleteOld lawyers shouldn't be incarcerated. Neither should young black kids who sell coke. Guess which client I have.
ReplyDeletePrison should be for violent offenders. The State and some judges use prison very cavalierly in cases that don't call for it. That's why we have so many people in prison that don't belong there.
ReplyDeleteSay what you want about Milt but he is wicked smart and not afraid to go against the grain if he believes it to be the just result. I wish more judges has his cajones and intellect.

DeleteWhat do you expect? Veronica just like Victoria were recruited to run by Hector Lombana. You cannot expect a high ethical standard when the consultant keeps targeting judges with candidates of this caliber and no experience. Truly a sad stage in our judiciary.

Guy Bailey's past history dealing with client trust funds is a matter of public record.See Kenet v. Bailey, 679 So.2d 348(Fla.3d DCA 1996). For his "remorse," see Kenet v. Bailey, Hunt, Jones & Busto, 785 So.2d 515 (Fla.3d DCA 2000).Explain this. And yes, I'm signing my name.
ReplyDeleteEveryone please check with Nuria Saenz' colleagues......she calls in sick when she is supposed to be trying cases on PIP "Blitz " calendars......then her colleagues have to deal with large numbers of undisposed motions in the files.....which she never got around to hearing cause she is absent so much .....it takes months to get a hearing.....unless of course you happen to be an insurance company.....she loves insurance companies .....especially if they are represented by Maury Udell

Popularity contest, pure and simple. How many good judges have been hurt because one lawyer thinks he should have won and bad mouths the judge? How many good judges took a hit for the acts of others with a similar name? How many good judges may not be the most personable, but do the job in a fair and intellectually honest manner? And lastly, how many good judges have lost their jobs because only 1 in 20 of the attorneys in this cliquish community vote? It stinks and should have been thrown out a long time ago.
