THEY'RE DANCIN IN THE JURY ROOM

They're doing something called "Zumba" in the jury pool room this Friday (although on the commonly
used Gregorian calendar Friday is the 30th, not the 29th. But this is the REGJB, where time is relative, so we digress.)

Does Judge Joe Fernandez know about this hoe-down?
Didn't famed Miami filmmaker @Billycorben get in serious hot water (until rescued by everyone's favourite federal blogger) for doing less in the jury room?  Can the Irish STOMP troupe be far behind?
Zumba? Really?

Speaking of Twitter, @davidovalle305 took a vacation just when things were getting fun. But have you seen his replacement @annaedge4 and her tweets? She is covering the much discussed trial before Judge Tinkler-Mendez over the death of young Rilya Wilson and the  motion for mistrial because the Dade SAO used a prosecutor who was under a Bar suspension at the time he gave his opening statement. Edgerton's article on the judge denying the motion for mistrial is here.

David- enjoy your vacation and google Wally Pipp while you have some time on your hands.

If you missed our post yesterday, there's a full compliment of trial prosecutors back at work in the Rilya Wilson case. They were down to two for a while.

So there you have it- they're dancing in the jury pool room and tap dancing before Judge Tinkler-Mendez. It's never boring at the REGJB.
See You In Court.

  6. According to today's Daily Business Review (DBR), Judge Victoria Brennan has ordered a murder suspect to be held without bail after Judge Milton Hirsch was forced off the case - Hirsh originally granted bail to the murder suspect.

  8. How can Brennan reverse another Circuit Court judge's order? She is unbelievable. A disgrace to the bech.

  9. Does not matter what Brennan does, INS has a hold. Client cannot go home one way or another.

  11. 5:41 - YOU are a disgrace to this blog and clearly don't know what you are talking about. Hirsch got smacked by the third DCA for granting a bond on a defendant when he had no authority to do so. Brennan only did what everyone, including the appellate court, knew was the proper course of action: hold a murderer with no bond. You must be one of those stupid attorneys that Brennan has ZERO tolerance for, got called out on your laziness or stupidity, and now you want to trash her (undeservedly) on this blog. I don't agree with all that she does on the bench, but this was not an error on her part.

  12. 5:41 you obviously dont know the law. When a judge is recused for bias, as what happened here, the successor judge is permitted to reconsider all of the prior rulings when requested by the party who asked for the recusal. The judge can refuse to reconsider, but is permitted to. So Judge Brennan only followed the law as she was permitted to do.

  17. 5:41 - funny comment. Judge Hirsch is the one who reverses the orders of other judges and who ignores caselaw.

  20. The Brennan defenders, aka State Attorneys, clearly don't know the procedural history of the case or the case law. There must be a change in circumstance or some evidence that Hirch's original ruling was in some way a result of bias. Since there is no such evidence and the only change was that a new judge was appointed, that is not a change in circumstances per the case law. Open up westlaw. And Brennan makes me reminiscent for the days of Butchko.

  21. THE CAPTAIN REPORTS:

AND YOUR NEW Circuit and County Court Judges are:

We expect to hear from Governor Scott's office later today on the three new Judges in Miami-Dade County. We will have one new Circuit Court Judge and two new County Court Judges very shortly.

I expect that one of those appointments will almost certainly go to Jason Dimitris. The real question though is whether Judge Fleur Lobree will extend her judicial career beyond next month by getting one of the three seats. Her current term expires at the end of December.

Anyone want to guess on who will get the three appointments:

    CIRCUIT:

    Judge Andrew Hague
    Judge Eric Hendon
    Judge Fleur Lobree
    Alan Fine
    Alan Sackrin
    Jason Bloch
    Jason Dimitris
    Candace Duff
    Steven Reininger

    COUNTY:

    Madeline Acosta
    Betty Capote
    Michelle Delancy
    Jason Dimitris
    Carlos Guzman
    Fleur Lobree
    Shirlyon McWhorter
    Melba Pearson
    Julie Terry

    CAP OUT ....

  22. Breaking:

Michael Jordan asked to change his shorts .....

Michael Jordan said Thursday he did refuse to change out of cargo shorts while playing golf recently at a Miami Beach country club, but he said he was hardly being a rebel.

"I've been there many times and no one told me a thing," Jordan told ESPN Chicago by text. "Then all of a sudden they come to me on the 11th hole and say I can't wear cargo shorts. Wow! The round is almost over and you want me to buy shorts now? Yeah, right!!"

After declining to change, Jordan reportedly continued his round, but it could be his last at the club. A report in the New York Post quoted a source saying that Jordan, a Chicago Bulls Hall of Famer and owner of the Charlotte Bobcats, would not be invited back.

    "No problem!!" Jordan replied.

A spokesman from La Gorce Country Club said its president was on vacation and declined comment at this time. An employee in the pro shop said that required attire is: "a collared shirt and golf shorts or pants, no cargo or denim. If there are pockets on the outside, it's not allowed."

  23. 12:12 pm. You show your ignorance of the law. Look at rule 2.330(h) governing judicial disqualification on your Westlaw. Judge Brennan as the successor judge can reconsider Hirsch's prior ruling.

  24. 12:12 based upon a change in circumstances. A new judge is not a change in circumstances. Case law nitwit.
