Two recent articles on the death penalty deserve mention today.
First, Fred Grimm, from the Miami Herald, wrote an Op Ed called Dollars and Sense on Capital Punishment. Part of it reads:
"Some 14 death row inmates in Florida have been cleared by DNA testing, after spending an average of 20 years on death row. Outside of the old Confederacy, that might be cause enough to reexamine the underlying morality of capital punishment."
"Instead, Florida Gov. Rick Scott vetoed funds earmarked for the Florida Innocence Commission, charged with sorting out flaws in the criminal justice system — an embarrassing mess of misidentifications and false confessions and lying jail house informants — that made Florida the national leader in wrongful convictions."

And, the Huffington Post, speaks about the "murder" of a Texas death row inmate who was convicted for starting a fire that killed his three young children. Governor Perry gets the award here for the latest Governor to sign a death warrant that executed an innocent person.
The Huff Post article is called:
"Cameron Todd Willingham Exoneration Was Written But Never Filed By Texas Judge"
And reads in part:
"A Texas judge who reviewed the controversial 2004 execution of Cameron Todd Willingham planned to posthumously exonerate the father who was put to death for killing his three daughters in a house fire. "
"Scientific experts who debunked the arson evidence used against Willingham at his 1992 trial and a jailhouse witness who recanted his shaky testimony convinced District Court Judge Charlie Baird in 2010 that "Texas wrongfully convicted" him. But Baird's order clearing Willingham's name never became official, because a higher court halted the posthumous inquiry while it considered whether the judge had authority to examine the capital case."

In local news, the State of Florida vs. Adam Kaufman continues in Courtroom 4-1 on Monday. Bill Matthewman and Al Milian for the Defense. Dramatic testimony ended the week with a Crime Scene Detective returning to the stand to first deny and then admit having an affair with the lead homicide detective.
In case you missed it, the Herald article started out this way:
"But on Thursday, the trial took an unexpected turn when the defense attacked the morals and honesty of Detective Ana Howell, the lead crime scene investigator for Aventura police.
It was revealed in court that Howell, who gathered evidence in the death of Eleonora Kaufman, had an adulterous affair with the lead homicide detective on the case, Anthony Angulo."
"Kaufman’s defense attorney William Matthewman asked Howell about the affair.
“Isn't it true, ma'am, you previously had an intimate sexual relationship with detective Angulo?” Matthewman asked her in court."
“I am married and have three kids. My job is very important to me,” an uncomfortable Howell said from the witness stand. “This is very important to me, sir, because this is my life here,” she told defense attorney William Matthewman."

It's a shame we all don't have the opportunity delve into the private lives of defense attorneys, especially when it has nothing to do with the innocence or guilt of their clients. It might put an end to that BS line of cross-examination once and for all, doncha think?

Three, I think we can all assume that the private lives of defense attorneys will always be a sordid tale.
I don't know where Fred Grimm got that number of 14 death row inmates who were cleared by dna in Florida. 14 inmates may have been cleared, but they weren't on death row. Hey, but why have the truth get in the way of a good story.

When the govt is attempting the put someone in prison for any given time, the jury should know if the evidence against that person is being brought by an honest witness, or in this case a liar. The bottom line is this witness lied to the jury about a matter relating to her ability to be truthful. If she was honest from the get go, perhaps her credibility could have been salvaged.
As far as the defense attorneys private life, how is that relevant to a case. The defense attorney ( like the prosecutor) isn't testifying, so what purpose would that serve? You don't like criminals so you somehow equate that with their lawyer? Pretty shallow thought process. I don't like criminals either, but I do like the constitution.

I am sorry 6:39, but the willingness of a witness to betray her family and marriage vows, with another witness in the case is absolutely relevant. It shows 1 she is a lying cheat who cannot be trusted, and 2 that she has a motivation to shade her evidence toward her former boy toys version.

According to the Innocence Project, there have been a total of 13 prisoners cleared of their crimes in Florida due to DNA testing. Only one, Frankie Lee Smith, was on death row.
BUT .....
There have a been a total of 23 inmates on death row in Florida who were later released because:
a) their conviction was overturned AND
i) they were acquitted at re-trial
or
ii) all charges were dropped
b) they were given an absolute pardon by the governor based on new evidence of innocence.
Florida, with 23 exonerations of inmates on death row, leads the nation in that category.

Until its demise due to budget cuts (and if you believe that I am the tooth fairy) I was a member of the Florida Commission on Captial Cases. In its last two sessions, the Commission was prepared to address the issue of whether the death penalty in Florida was actually working.
ReplyDeleteIt was our examination of the effects of the death penalty on the judiciary that gave rise to the very odd attempt by one of our members to propose in the House that there be two supreme courts comprised of ten members. Five members for criminal matters and five for civil.
The President of the Senate was so disturbed about where the commission was going and the work being done by regional collatoral counsel on behalf of death row inmates, he decided, despite the now obvious lack of oversight of those offices, to "save the taxpayer's money" by doing away with the Commission, which took up all of $200,000 of the budget.
The fact of the matter is that, as Justice Kogan put it so many years ago, death just does not work. It uses up a ridiculous amounts of judcial resources, taxpayer money to provide for death row inmates and deters nothing. In fact it may have the opposite effect, as perpetrators may, in a panic to avoid death after having committed one murder, commit another, which could be a police officer.
Not one death row inmate will tell you that, before committing his/her initial crime, considered the death penalty before pulling the trigger, so to speak.
If the legislature and the governor are serious about reducing the expenditures for prisons try with the extra $65,000 per year it takes to keep each and every death row inmate. With over 400 of them, the savings per year would be over $30,000,000 per year. That would pay a lot of teachers.

They migrated around the globe over thousands of years. Acts of violence on one human by another was not invented by whites. It is as old as humankind itself.
Further there is evidence that as man migrated, they diversified, and at times tribes fought with one another.
And for the record, in more recent history, many Africans who were sold into slavery were captured and sold by other Africans. Warring nations in Africa were killing one another before a white guy even thought about using them as slaves.

As long as you espouse the belief that every white is a devil who preys on minorities, it gives you a trumped up excuse to be angry. It also gives you an excuse for being rude. It's an excuse for why you can't get into Harvard. It's an excuse for everything.

Every time you write you show that you are a classless fool, with a huge chip on your shoulder. The world does not owe you anything just because someone you heard of was discriminated against. You being stopped on your bike is nothing like what people who struggled for civil rights went through, an it is an insult to them when you compare yourself to them.
Moreover, your fear, anger, racist views are also an insult to those people who risked their lives for you. They didn't withstand the dogs and fire hoses for you to write an express yourself the way you do.
I was following the Kaufman Trial on local news and paper but to see it on a national broadcast today showed the rest of the nation the lack of creditability we (MIAMI) have w/ many detectives who have taken an oath. That Ana Howell is one nice piece of small ass, I feel sorry for her bum ass husband!
