A LINE OF THE TIMES

The "line" situation is ridiculous and the adminstration needs to not only assume the blame but also come up with a solution.

This is not a recent phenomena but has been perculating up for a long time.

The cause for it is obvious;

The security is undertrained,

There is a lack of manpower and a

lack of machines.

While I understand the immediate cause of the problem, I am baffled by the lack of effort to, at the least, try to mitigate the problem.

Listen, you can't have people standing in the hot sun for an hour. You cannot have professionals treated like they are cattle and get prodded by an untrained person. You cannot have people, nervous at it is because they are going to criminal court, get worried because they feel that they will suffer the consequences of being late or missing court. One day, serious violence will erupt because this is a riot waiting to happen.

If this was scrutinized by a private sector, it would be deemed wholly unacceptable.

Simple things like staggering court schedules, scheduling appearance 30 minutes early, doing away with the frisking of professionals and, most importantly, when one person is being screened, have another security personel keep the line moving.

The current situation is embarassingly assinine. I watch females get poked in an improper manner. There is a definite noticeable difference between how different races are screened. It is inexcusable that there is not a law enforcement officer positioned in front of the line assisting and preparing those about to enter into the building.

The current system can only be accurately described as "sucking". However, the powers that be that are responsible for monitoring or improving should be the most ashamed.

I could do better! There's room for improvement. Whose got the common sense, decency and motivation to recognize that this is a problem and, whether you are a professional or a defendant, nobody should have to stand in line, in the hot sun, to get into a public building?

Come on! Don't be a poser! Do something! When there is a problem, you don't complain about the problem, you solve the problem.

In response to your post, you are being sent a membership application to finally join the Florida Association of Criminal Defense Lawyers, Miami Chapter. That way, you can join our effort that Betty Llorente, Bob Pardo and others on the Board have been working on for several weeks now. We met with the Chief Judge about this issue in June. As a result of that meeting, we believe that we should be able to get private attorneys passes to enter the GJB similar to those used by the SAO and the PDO.

Of course, the private attorneys will have to become members of FACDL-Miami and go through the process of obtaining the pass which we are attempting to set up with the AOC and/or the PDO as soon as possible. There are several administrative hoops to jump through, (as you can imagine) all involving security issues, but we invite you to join the effort by becoming a member and then by stepping up to the plate on this issue, as we have always known that:

"[You can] do better"!!!!!

  1. I don't know Scott Saul other than that he frequently comments/rants or complains on this blog for a variety of reasons. I completely agree with him on the line situation. But as the next post made clear, FACDL-Miami has been trying to resolve this issue for weeks while most of you just blog and complain about these issues. It is akin to the person who complains about government but doesn't vote.

I don't think the Judges have anything to do with the amount of money allocated to security at REG, and therefore are going to have little impact on any decision to purchase additional scanners and detectors, which must cost a fair amount. I don't know whose decision it is to not allow private attorneys the same luxury of using a separate entrance like PD, ASA, and LEO, but I would also think it is not the Judges. Maybe it has something to do with them being state, county, or city employees.

    But in the mean time, till this is sorted out in order to lighten the load, feel free to call me to cover your cases. Mention this post for a discounted coverage fee!

    How about no writing checks regardless of ID cards?
    We shouldn't be writing checks to anyone we practice in front of.
    I gave up contributing to anyone a few years ago.
    If I like you on the bench, I'll tell 3 people I know to vote for you. If I don't like you (and you have a worthwhile opponent), I'll tell 10 people to vote for your opponent.
    More important things to do with my hard earned money.

  9. 1:17- Absolutely NOT. Shumie time is NOT about what is NOT happening in the office. Shumie time is EVERYTHING about whats going to happen when you leave the office.

  10. 1:17 my two shumie cents- you will notice that the pros who call the Shumie invariably say where they're going. For example:

    "I've got a golf cart ready and a six pack on ice at Key Biscayne for the back 9...I'm outta here. Shumie Time!"

    OR- "My new Girlfriend just sent me a text of her topless on the sailboat. Va va va voom. I am going home. Shumie Time"

  18. The solution is most simple. Re-adjust the metal detectors sensitivity to what it was before it it was changed to very high sensitivity a few months ago. Who ordered the unreasonable and impractical sensitivity adjustment? The chief judge? An administrative or associate administrative judge? The building manager? Someone from GSA? The managers at 50-State Security company? Was it because of the embarrassing "code brown" a few months ago or because of some other reason? Whoever it was, please, step forward and take responsibility for the mess you've needlessly created! There is no such thing as perfect security, all that we can hope to achieve is a reasonable balance between practicality and security. And what we've got now is not reasonable!

  26. My recollection of news stories tells me shootings are by family members of victims, defendants who get hold of guns somehow, and disgruntled litigants in various civil cases.

    I cannot recall a single story of an attorney firing a gun in court. Allowing asa and PD special access makes no sense. Assumptions that they are less likely to carry a weapon has no basis in fact.

    I seem to recall a story recently about an ASA who fired a gun pretty recklessly...
