FUN WITH THE BROWARD BAR

When we last checked in on those lovable and fun loving Judges in Broward and the lawyers they canoodle with, Ana Gardiner had resigned from the bench and both she and former ASA Howard Scheinberg had Bar complaints pending. Apparently in Broward it is now verboten for Judges to...whatever with ASA's who are currently prosecuting a death penalty case before them.

Who knew?

Here's where it gets interesting, courtesy of the JAA Blog of Broward:

After we reported that "H" was getting ready to nuke Scheinberg back on April 12th, the brakes were slammed on and complete silence ensued. Rumor had it the leaks caused a totally new Grievance Committee to be assigned, although that couldn't be confirmed until today, based on the Notice of Probable Cause Finding, which clearly denotes Grievance Committee "J" as the governing body. While we still don't know the full charges, it's clear "J" only filed a violation of a single Bar Rule, not the numerous violations we were hearing "H" was primed for.

Here's where it gets even more interesting. The Vice Chair of "
J" is Homicide Prosecutor Tom Coleman. He worked with Scheinberg at the SAO for years (not in Homicide, a recent promotion), and currently reports toBrian Cavanagh, who wrote a lette in support of Scheinberg. The other members of J are: Mark Andrew Levy (Chair), Eugene Keith Pettis (Designated Reviewer), Minerva Vazquez Bailey, Brian L. Lerner,Mimi L Sall, Donna M. Marra, Jean-Pierre Mucha, Michael O'Rourke, and Scott Ross. Courthouse regular Pettis was apparently the Designated Reviewer for both "H" and "J".

  1. Speaking of bar issues, anyone wonder where "superlawyer" Eric Marshall has been lately? It seems his slimey ways finally caught up with him - three year suspension. I wonder who is getting all of his shady bondsmen referrals?

  3. The Captain Reports:

    State v. Casey Anthony .....

    The State rested their case this morning and after the standard defense Motions, they will begin to put a case on tomorrow.

    The evidence presented by the State has been circumstantial. Prosecutors have built their case on Casey Anthony's lies and her conduct.. The rest of their case was the forensics including the smell in the trunk, the searches on the computer, and the duct tape found on the skull.

    So, what say this group as to the strength of the State's case. Have they presented enough? Is this a death case? Will the defendant take the stand? What are your thoughts?

  4. 1.JOA denied.
    2. Defendant will not testify.
    3. She will be convicted.
    4. Mothers never get the death penalty for this kind of child killing. She is sick but, not a drug dealer who killed someone in a bad drug deal.
    5. The case makes all of us feel bad for that poor child.
    6. No jury will excuse her for all party activities shortly after her kid is reported missing.
    7. I hope this case goes away soon.

  5. It seems the prosecution pushed the envelope on a death case with the novel air particle and smell evidence and the morphing of the skeleton with an existing image of the victim. It definitely created perhaps unnecessary appellate issues.

  8. Guilty. No evidence, but no amount of childhood trauma could explain her not reporting the baby missing for a month.

    Death penalty is a good possibility for a mother who killed her kid, buried her, lied about it, then serves up her own father as a child molester to save herself at trial.

  9. The case may not pass the "smell test." Besides they have not proven the cause of death. She will be convicted and it will be reversed.

  10. If I am elected judge, I already have a commitment from Kathy Ireland to be my baliff. I won't get the women's vote, but a lot of guys will get arrested just to have their fingerprints taken in open court.

  11. She will be convicted. The conviction will be reversed for the bull shit "scientific" evidence they used to convict her. And, Baez will be disbarred after she files a 3.850 saying she had to sleep with him to pay her legal fees and he was ineffective in thinking of sex and not her defense in addition to wholly inexperienced for this type of case. The whole thing is sad on all fronts.

  12. Sorry Rump. I disagree with you statement that nobody tops the JAA Blog. Frankly, I think it's disgraceful that any blog, let alone a blog run by defense attorneys who make a living urging people to not judge others, allows the kind of personal attacks that blog allows. While they certainly have exposed matters of concern to us all, the over the top and personal attacks are disgusting and unprofessional.

    I much prefer your moderated blog.

    If you were judge who would your bailiff be?

    Having the supermodel is a bad idea. I don't want people coming by just to get a glimpse. Besides, no one looks good in that uniform.

    I think I would choose Peter Adrien. I hear he is looking for work. And no one is more used to dealing with a crowded courtroom than he.

  15. Actually, the JAA blog is run by a Broward lawyer who accepts the written contributions of others. I forget his name but he is obviously pissing off a lot of people up there ... I wouldn't want to be one of his clients ... now I know why Rumpy is in the shadows.

  16. If I was a judge, my bailiff would be Jesse "The Body" Ventura. Former Navy Seal/Pro Wrestler/Governor. We'll have a lot to talk about after 10 am (when court is over and I'm heading to the golf course) and maybe he'll do the Body Breaker on some annoying prosecutor.
