The Judge has struck at the soft underbelly of the Broward SAO: He has ordered the State Attorney, Mikey Satz himself, or the Chief Assistant State Attorney Chuck Morton (who happens to be a nice guy) or the the Chief of the Felony Division Jeff Marcus (a/k/a Dr. No) to be present for the soundings on October 7,13,14, 19,27,28 and November 3,4,10,17, 18 and December 1,8,9 ostensibly to assist the in court prosecutors who apparently have to keep leaving the courtroom to call their supervisors for permission on pleas. Apparently the same disease that infects the Dade SAO has spread to Broweird.
Talk about hitting below the belt! Talk about not fighting fair! It's one thing to undercut the prosecutor in court, but to order a supervisor to spend his valuable time in court during a calendar?? Why, that is almost unheard of. Who will count the coffee cups? Who will write the mind numbing emails outlining the latest new policy ("henceforth no prosecutor shall lend his or her in court copy of the Florida Statutes to any individual who is not an employee of this office..." ) ?
From the order: "The volume and inability to handle the docket and issues requires a supervisor as designated in the above order from the State Attorney's Office for the orderly administration of the Court's docket. See, Code Of Judicial Conduct, Cannon 3B(3); The Rules Regulating the Florida Bar, Rule 4-3.5."

That sound you heard is the ball being soundly hit back into the court of the Broward SAO. How will they respond? We can hardly wait.

While I admire Rodriguez for not being a rubber stamp for the Broward SS, er SAO, he doesn't have to be such an asshole about it. Say what you're going to say, let the ASA make his/her objections and move on to the next case.
ReplyDeleteI disagree with 10:20. Most ASAs have been reduced to bureaucrats who are afraid of their own shadows and reprisals for excercising the most minut of discretion. It is time to let the ASAs be lawyers and stop seeking to cover their asses in fear of their superiors.
ReplyDeleteIf the SAO would spend more time supporting the troops instead of making them live in fear, they would function better. If they can not handle the pressure then it is time for them to go and time bring in those who can. The system will operate better when the cream rises to the top.
In order to finally change the SAO's practices up in Broward, someone's going to have to take as stand and quite frankly be an asshole about it. If this is what it takes to get Satz and his minions to change their evil ways then so be it. Honestly, the SAO

ReplyDeleteThe judge is acting like a spoiled brat. There are other ways he could get his point across, but he goes about it like a jackass. He will be the one who comes out of this with more of a stain, because judges are supposed to be above such petty spitefulness.

But I suspect that Judge Rodriguez will soon become a target of the Broward “establishment.” An upitty Latino in Broward, no way!
ReplyDeleteAll kidding aside, what Judge Rodriguez is experiencing is harassment from the SAO, slow down his calendar, complain, and get him out of Criminal. Only if you do not know how they play the game do you strike out.
Broward is a throw back to the Miami-Dade of yesteryears. I recall how it was when I began to practice in the 80"s. Lilly white, male dominated judiciary and power elite. I was taught to always mention, stress, the senior partner’s name, a fine outstanding board member of the La Gorce elite, who helped author the justification for La Gorce policy of exclusion. (What an experience for a Cuban kid to proof read and edit this manifesto of prejudice.). The then Power Elite of Miami-Dade, kiss their ring, cow tow to them, or suffer their rath. Make no mistake about it, Judge Rodriguez is taking on the Lilly White Power White of Broward, He is challenging their status quo, and they do not like it, let alone coming from a Latino! (Hell look what them Cubans did to Miami!).
Knowing Judge Rodriguez for many years, I can tell you he knows the game well and knows what the SAO is up to. Stay tuned, he deserves out support from South of the Border.
Thank god for Rodriguez. I can't believe Rump is supporting getting along and going along with the scum from the Broward S.A.O.

DBR correctly calls the "judge" the loser in this, and points out that the 4th DCA entered one stay on him already, and now the "judge" got booted off to the family court division.
