FED ARRESTED-loose briefs.

BREAKING: The 39th President of the United States, James Earl Carter, was hospitalized today on a flight to Cleveland. No further details at this time, however, Cleveland is known to have that effect on people, right Lebron?

UPDATE: BAD TIME TO BE A FED. Karama continues to strike at the DOJ, as we are just learning that Nicholas Marsh, a federal prosecutor currently under investigation for his role in the discovery shenanigans in the Senator Ted Stevens prosecution, has committed suicide over the weekend. The breaking story is here.

<--------TAKE OUR CRONIN POLL

AUSA Sean Cronin's booking photo.

Miami Federal Prosecutor Sean Cronin, who of late was most notorious for taping our fellow blogger David O Markus, in the case in which he lost and then got referred to the Bar by Judge Gold, has been arrested for Lewd and Lascivious Assault on a Child and Resisting Arrest without Violence to an office.

The title of the post links to the arrest.

Now to be fair, the facts appear to be a bit ridiculous. Mr. Cronin, while at a bar, decided to go for a dip in the pool in his boxer shorts. A mother who had a young child with her complained after they stated they could see Mr. Cronin's genitals.

So this is basically as BS a case as the tight ass feds usually bring.

One can only hope that when Mr. Cronin gets counsel, the ASA assigned to the case threatens a "seismic change" in the prosecution if Mr. Cronin contests the charges. You will remember that Mr Cronin did the same thing to Mr. Markus after David filed a motion to suppress, and obtained a superseding indictment adding about a hundred more counts.

News coverage of that fiasco is here and here.

No word on whether Mr. Cronin was booked in his skivvies or was allowed to put on his pants before being taken off to jail.

Just what kind of briefs do those AUSA's carry anyway?

Karama Kramer.

Check out the post below. David hung Buju's jury in Tampa. Nice work.

  1. I guess that means the all boys on the swim team need to go to jail since you can see their junk in their speedos????

  2. Wel, what would be Mr.Cronin's way of dealing with it?
    Indict em all, I guess.

  3. this is a defeat for DOM. His client will remain in jail, will pay more $ for a second trial, and the feds now have his testimony and rarely does the defense win a second trial in federal court.

  4. Assuming that guy did not rub himself or otherwise play with himself, what the fuck are they doing busting a guy for swiming in his boxers?

Hell, in Florida, (Duvalle v. State) you can go naked in public so who cares if you could see his dick inside his boxers?

  5. it seems that the charge against cronin is BS. interesting how things come full circle. if i recall he added a hundred counts to a guy for defending himself. while i personally wish cronin the best, maybe the gov't will open their eyes a bit. maybe....

  6. 5:30- I agree it's not great, and I also agree the feds are stronger in a re-trial. But DOM is smart and I don't think he will walk into the second trial with the exact same defense. He will shake it up a little. He knows what to do.

  7. i want to feel bad for cronin bc this is clearly a BS case, a waste of taxpayers money, etc. but its hard to feel sorry for someone who plays that unfair (re: the case with markus where cronin jacked the indictment bc a defendant had the audacity to defend himself).

all that aside, i personally wish cronin the best, i hope this has no effect on his career or fla bar status, but i also hope that the govt will see how easily a flimsy charge can really rock someone's world.

was cronin really "lewd and lascivious"? i wasnt there and i dont know the guy, but i HIGHLY doubt it. from what i read (and take that with a grain of salt) these are bullshit charges. the guy jumped in a pool with boxers. now he'll have the stigma of a serious sex charge attached to him for life. that is GROSSLY UNFAIR. Perhaps this will be a learning experience for all that to quickly throw a charge at someone is real damn serious and has life altering effects.

my best to cronin. im sure this garbage will be no actioned and i hope you take this experience as a life lesson on how brutal the criminal system can be on an individual.

    peace

  8. 5:30;

"this is a defeat for DOM. His client... will pay more $ for a second trial"

Sounds like pure win for Mr Markus!

  9. Why did the mother take her daughter-- a minor-- to a bar?

    ReplyDelete
  10. 8:25--my sentiments exactly.

I don't know Cronin, I don't approve of what he did in the case against Markus, but it sounds like this case is total bullshit.

  11. 5:30-- are you insane? Huge win for DOM. Feds win 90% of cases and Buju was on tape trying coke and talking about deal. How did he convince anyone to vote NG?!

  12. Rump,
When you say "the ASA assigned to the case threatens a 'seismic change' in the prosecution if Mr. Cronin contests the charges" who are you referring to?

  13. The mother of the child should be indicted for bringing her to a pool bar that serves alcohol, and is advertised for am over 21 crowd. Arrest the Mother!!!

    ReplyDelete
  14. DOM wins, with the Federal rules of discovery so tilted in favor of the Government, DOM gets a free look at their case. So though in state court this might be a lose fordefense counsel, in the feds, DOM is a net winner.

    ReplyDelete
  15. By the way, the irony of the timing of Cronin's arrest while DOM is doing good legal work in the world should not be overlooked.

  16. I hear Michael Van Zant is assigned to prosecute Cronin, H ehas has already had the pool cavumed and has found lots of hair stands, but given Cronin's folically challenged scalp, he enlisted animal services and the Mimia-Dade Hoocide unit, to collect DNA samples from all the cats in the area.

  17. What nonsense. You mean to tell me the mother was so upset by a penis in a pool that she not only reported it to staff at Finnegan's, but called the cops too? Why was this the place she chose for family fun on a Sunday? If you've never been there, it is a pool next to an adult bar, like at shuckers or shooters in ft. lauderdale, where there are bikini contests and all kinds of crap going on there at times. Im sure plenty of adults were drinking and watching football on a Sunday afternoon. Would she have been as appalled if a girl was wearing a g string at said pool? Or if a boobie fell out of a bathing suit? What if a woman was topless? If I was Sean Cronin, I would have paid my bar tab, flipped off that b*tch and left too. I dont know about the jumping fences and running, but I would not have waited around 10 seconds to explain myself to some bouncer at Finnegan's. This case needs to be dropped asap. Unbelievable.

  19. Anonymous 9/28/10 at 10:50 AM:

I disagree and your comment is pretty suspicious, I wouldn’t be surprised if Mr. Cronin left a very defensive comment about his highly embarrassing ordeal. Frankly, who goes into a public swimming pool with only their underwear on? He’s a federal prosecutor, he should have known better. And if he didn’t do anything wrong, than why was he running away and jumping fences? His actions are quite telling.

Unlike you, I’m not going to judge the lady for taking her kid to a bar; at least she didn’t wear her underwear to the swimming pool.

That’s karma for you Mr. Cornin, next time (if there is a next time), wear proper attire and don’t run away if you have nothing to hide, of course.

Best of luck, it seems like you’re going to need it.

  22. the boxers i wear are a lot more covering than your typical pasty tourist sportin a speedo.

dude wasnt wearing tighty whities, they're boxers for christs sake. i see about a dozen sets of them in the REG every day

    ReplyDelete
  23. Well, his attire was inappropriate for a public swimming pool and he should have known better. From my understanding, Finnegan’s isn’t a nudist bar. You, Cronin supporters, are lame and your poor excuses don’t justify his actions. He made a bad call, as usual, and now he has to face the consequences.

And don’t bash our tourists; they are entitled to wear the skimpiest and most unflattering speedos, as long as their stuff isn’t out there, deliberately showing. For the record, speedos are meant to be worn in public, boxers are not, especially, if there is a risk that your stuff will show through the little hole in the front (Mr. Cronin’s case).

I think it’s highly disturbing that his choice of resolving or defusing the situation was by running away. If it was an innocent mistake or a misunderstanding, he could have easily articulated the issue, but instead he decided it would be best to run away and jump a couple of fences.

  25. I think most people here will agree that what Cronin did was stupid. But stupid does not equal criminal.

  26. is court closed for the storm?

    ReplyDelete
  27. I hate to admit but, arresting a over zelous prosecutor for something really stupid is fun to watch but, really wrong and maybe he will now see how the police frequently over do it.

  28. dude - the a form said he had a little boner going on

  34. The "Cronin" case sounds absolutely absurd. He is lucky that he is in a jurisdiction that will actually screen the case prior to filing. Some jurisdictions would let a jury decide the issue. For a case that seems like it should have never happened, it could have been worse.

Hopefully it will be "no actioned", Cronin and his Federal contemporaries will take notice of this Due Process and it will ripple into that fancy shmancy court house with the cheapass sign and wallmart furniture laying out in the front
