Miami Federal Prosecutor Sean Cronin, who of late was most notorious for taping our fellow blogger David O Markus, in the case in which he lost and then got referred to the Bar by Judge Gold, has been arrested for Lewd and Lascivious Assault on a Child and Resisting Arrest without Violence to an office.

Now to be fair, the facts appear to be a bit ridiculous. Mr. Cronin, while at a bar, decided to go for a dip in the pool in his boxer shorts. A mother who had a young child with her complained after they stated they could see Mr. Cronin's genitals.
So this is basically as BS a case as the tight ass feds usually bring.
One can only hope that when Mr. Cronin gets counsel, the ASA assigned to the case threatens a "seismic change" in the prosecution if Mr. Cronin contests the charges. You will remember that Mr Cronin did the same thing to Mr. Markus after David filed a motion to suppress, and obtained a superseding indictment adding about a hundred more counts.
No word on whether Mr. Cronin was booked in his skivvies or was allowed to put on his pants before being taken off to jail.
Just what kind of briefs do those AUSA's carry anyway?

ReplyDelete5:30- I agree it's not great, and I also agree the feds are stronger in a re-trial. But DOM is smart and I don't think he will walk into the second trial with the exact same defense. He will shake it up a little. He knows what to do.

was cronin really "lewd and lascivious"? i wasnt there and i dont know the guy, but i HIGHLY doubt it. from what i read (and take that with a grain of salt) these are bullshit charges. the guy jumped in a pool with boxers. now he'll have the stigma of a serious sex charge attached to him for life. that is GROSSLY UNFAIR. Perhaps this will be a learning experience for all that to quickly throw a charge at someone is real damn serious and has life altering effects.
my best to cronin. im sure this garbage will be no actioned and i hope you take this experience as a life lesson on how brutal the criminal system can be on an individual.

ReplyDeleteDOM wins, with the Federal rules of discovery so tilted in favor of the Government, DOM gets a free look at their case. So though in state court this might be a lose fordefense counsel, in the feds, DOM is a net winner.

Why was this the place she chose for family fun on a Sunday? If you've never been there, it is a pool next to an adult bar, like at shuckers or shooters in ft. lauderdale, where there are bikini contests and all kinds of crap going on there at times. Im sure plenty of adults were drinking and watching football on a Sunday afternoon. Would she have been as appalled if a girl was wearing a g string at said pool? Or if a boobie fell out of a bathing suit? What if a woman was topless? If I was Sean Cronin, I would have paid my bar tab, flipped off that b*tch and left too. I dont know about the jumping fences and running, but I would not have waited around 10 seconds to explain myself to some bouncer at Finnegan's. This case needs to be dropped asap. Unbelievable.

Frankly, who goes into a public swimming pool with only their underwear on? He’s a federal prosecutor, he should have known better. And if he didn’t do anything wrong, than why was he running away and jumping fences? His actions are quite telling.
Unlike you, I’m not going to judge the lady for taking her kid to a bar; at least she didn’t wear her underwear to the swimming pool.

Well, his attire was inappropriate for a public swimming pool and he should have known better. From my understanding, Finnegan’s isn’t a nudist bar. You, Cronin supporters, are lame and your poor excuses don’t justify his actions. He made a bad call, as usual, and now he has to face the consequences.
ReplyDeleteAnd don’t bash our tourists; they are entitled to wear the skimpiest and most unflattering speedos, as long as their stuff isn’t out there, deliberately showing. For the record, speedos are meant to be worn in public, boxers are not, especially, if there is a risk that your stuff will show through the little hole in the front (Mr. Cronin’s case).
I think it’s highly disturbing that his choice of resolving or defusing the situation was by running away. If it was an innocent mistake or a misunderstanding, he could have easily articulated the issue, but instead he decided it would be best to run away and jump a couple of fences.

ReplyDeleteThe "Cronin" case sounds absolutely absurd. He is lucky that he is in a jurisdiction that will actually screen the case prior to filing. Some jurisdictions would let a jury decide the issue. For a case that seems like it should have never happened, it could have been worse.
