ELECTION DAY TUESDAY

Before we get to the races across the country, a little local business.

The final piece of the Scott Rothstein puzzle was filed yesterday as the Government, through former Dade ASA Larry LaVecchio, asked for 40 years for the Ponzi-Schemeing attorney. The Government's sentencing memo is here.

As David O Markus points out on his blog, the sentence is a starting number, as Rothstein can reasonably expect a 33% reduction for his pre and post arrest cooperation. So a thirty year sentence becomes....hmmm.. give us a sec (carry the two, 5, 9...) .....roughly twenty years or so.

As several alert readers pointed out, although Brian Tannebaum has been elected President, Barry Wax is standing for election for Treasurer and Sergeant at Arms, and has not yet been elected, although we bestowed a victory upon him yesterday.
However, we hope our mistake was only a predictor of future good things to come. Run Barry Run!!.


PRIMARY TUESDAY:

Today is primary election day in several states across the USA and here are the races we're watching:

Arkansas Dem Senate run-off: Senate Blanche Lincoln is fighting for her political life as Lt. Gov. Bill Halter is posed to make Lincoln the third sitting senator this primary season to lose her party's nomination. Lincoln has had former Pres. Bill Clinton in Arkansas all weekend criss crossing the state on her behalf, but as this race shows, the powerful unions carry more political clout than Clinton currently does in his home state. Look for Lincoln to lose decisively.

Nevada Republican Senate Primary: Three people are running for the right to challenge senate Majority leader Harry Reid in the fall. Reid has firmed up his base in recent weeks and is polling as a winner against any of the candidates, but look for Tea Party newbie Sharron Angle to nip the two other candidates, one of whom is UNLV Coach Jerry Tarkanian's son.

In California two female former CEOs are poised to become the Republican challengers for Governor and the Senate. Note that former California Governor Jerry Brown is the Democratic Nominee for Governor. When Brown was Governor of California from 1975-1983, he pushed through the most progressive and expansive changes to the building code for new business related buildings. The US spends 40% of its energy on heating and cooling business establishments and 35% of its energy on transportation. Because of Governor Brown's foresight over 30 years ago, California - believe it or not- leads the nation in energy conservation outside of transportation.


GOODBYE ANA.

The JAA Broward Blog has this piece on the goodbye party for Judge Ana Gardiner:

Low judicial turnout - from what we're told, few Broward judges showed up for Gardiner's "Retirement Party". Stalwart gal pals Ilona Holmes, Susan Lebow, Mily Rodriguez-Powell, and Marina Garcia Wood were reportedly on scene, as were campaigners Jack Luzzo, Peter Skolnik, and Jay Hurley. The only other judge we heard about was John Frusciante, who is about to retire and set up shop as a mediator. The crowd was mostly comprised of civil lawyers, including many from Cole, Scott & Kissane. Howard Scheinberg's lawyer, Bruce Lyons, was also in attendance. Another shameful day for Broward, when a judge resigns in disgrace, and they throw her a party which other judges attend.

Rumpole says: We have nothing good to say about former Judge Gardiner. And that being said, we think the last line was a cheap shot. Let her go in peace and let her friends say au revoir.

    THE CAPTAIN REPORTS

    So you want to be a Circuit Court Judge .....

    The JNC was in session today interviewing candidates for a seat on the Circuit Court; (to replace Judge Kreeger).

    To recap, 19 applied and 11 were interviewed. The JNC now sends the following six names to Governor Crist:

    Miguel de la O
    Robert Galt, III
    Darrin Gayles
    Browyn Miller
    Lisa Walsh
    Deborah White-Labora

    If he chooses any of the last four names, he will get a 2-1 and the JNC will be back at it again in a couple of months.

    Below are the names of those interviewed that did not make the cut:

    Robin Faber
    Andrew Hague
    Patricia Kopco
    Robert Kuntz Jr.
    Rodney Smith

  5. On the whole Nancy Wear thing, there have always been type A and type B personalities.

    The origin of the Type-A moniker derives from research conducted in the middle of the 20th century by Dr. Meyer Friedman. With a colleague, Dr. Ray Rosenman, Friedman posited that there was a link between the behavior of the impatient overachiever and heart disease. I found it interesting that although "Type-A" and "Type-B" are generally used as descriptive terms, the origin of the term "Type-A" is actually clinical and was essentially used to diagnose unhealthy behavior.

    Type A personalities in the law are always impatient and dissatisfied with others because they see the nature of the dog eat dog world and have no qualms about trampling over and leaving treadmarks on the backs of anyone not so aggressively inclined.

    The law involves a lot of reuse and rehashing. Forms, templates, arguments, all are recycled. Work smart not hard. If you can avoid reinventing the wheel, you don't do so. That's good business. That we as lawyers want to "haze" each other and make one another rework through every problem is smart business too - I am not going to feed my competition the answer. Thus it is natural no one is going to jump up and be helpful.

    The question of "open up a book and read" is a rigged one. Even if one read it and one asks the question, "Well am I reading this right?" then the answer will be, "It's plain as day, only a dimwit couldn't read the plain language that explans itself."

    Which is why the best approach is to ask questions of friends and those you trust, not people on an internet website and listserv, etc. They will not "flame" you for a question. Others will because they live for the opportunity to do so to pounce on someone and rip out the jugular, it helps satisfy the red meat intake and well at the end of the day, "this is the business we've chosen."

  8. rump-how does one get the list of people arrested daily and processed thru miami dade county jail? the public record list that lawyers use to mail prospective clients.... Ive asked people and no one knows...can you advise?

    Well then, you better sign your Oath on your Full and Public Disclosure of Financial Interest form.

    And in the case of County Court Group 4, where incumbent Edward Merrigan drew opposition from DUI criminal defense attorney, Lloyd Golburgh, it appears that the challenger may have dropped the ball on this one.

    Go check out the JAABLOG where they report on a lawsuit filed by "team Merrigan" and their attempt at getting Golburgh thrown off the ballot.

    It's just a another day in paradise, North of The Border.

    Hey Rump, how bout that kid Strasburg. Everything they said he was, and more. Tonight, he pitches seven complete and gives up four hits while striking out 14 Pirates. Unbelievable.
