PIGS, APPLES, AND AMERICA.

A follow up from our faux pas yesterday: A reader left this enlightening comment:

Kissimmee Kid said...

Man driving down road.
Woman driving up same road.
They pass each other.
The woman yells out the window, PIG!
Man yells out the window, BITCH!
Man rounds next curve.
Man crashes into a HUGE PIG in middle of road and dies.

Thought For the Day:
If men would just listen

Rumpole says: You're asking way too much. You might as well request that we stop and ask for directions as well. Never happen.

ANOTHER DAY.... another sitting judge in Broward gets a challenger. Judge Mary Robinson is next on the hit parade.

This just keeps getting better and better.

Our favourite Federal Blogger wins a civil case, finally.

And speaking of David O Markus, what has him so fired up?
Try calling him a former federal prosecutor to his face and see what happens.

Nobody's talking about Scott Rothstein anymore.

FACDL soiree this Saturday night at the Fountainbleau. We're not invited, as usual.

A COKE; AN APPLE; A FLIGHT TO FREEDOM:

For those of you who missed it, or missed the several dozen requests in the comments section that we post it, here is the Herald article on the Mariel Boatlift and Assistant Public Defender Ivonne Cuesta, who just happens to have her name before the Governor for a County Court spot.

For those of you who missed the symbolism, therein lies the greatness of this country: From a Cuban refugee to a potential judge - only in America.
Good for you Ms. Cuesta!

  1. there has been a lot of bashing on this blog about Carlos and the PDs, but Ivonne's story truly tells the story of what is still really awesome about being a PD. The office still has great talent and people in mentor positions who help develop young lawyers into great ones. The office doesn't begrudge you either when you decide to leave and start private practice. They are very supportive of their APDs going on to bigger and better things.

Nothing against Ms. Cuesta (I don't know her and perhaps she'd make a great judge...), but why the kudos and fascination? Were all the "Cuban" judges currently on the bench born in this country?? A while back Lourdes Simon (a Cuban refugee) was appointed (not just had her name go to the guv, thanks) to the county court bench and I didn't see any fawning over her. There's been others recently, too, but I won't list them all. What am I missing here?

  4. To yesterday 5:22 p.m. -

Most of us have to scan through the absolutely witless "shumie time" and "fake ted mastos" b.s. to glimpse SOME commentary on the law and judiciary where we practice.

Every now and then, someone has an actual opinion on the people that we work with. While most of the comments are gripes on the negative, every now and then, it is nice to hear some praises of those judges and lawyers that are doing well and who are making an actual effort.

Yesterday, I commented on the good qualities I saw in our new administrative judge.

The commentator at 5:22 pointed out to me and to the person who had the differing opinion that Judge Soto is not the "chief judge." Thank you SO much for pointing out the obvious. "Chief" as we utilized it is the shortened title that the lawyers in the criminal courthouse use to refer to the admin judge. Blake was referred to in that way as Soto is now. Everyone with a brain knows the difference.

Additionally, the person who disliked her as well as I were commenting on our perceptions of her qualities as a judge. No one mentioned anything about "power" as you did.

It never ceases to amaze me that the only time people on the blog tell you to stop commenting and "get a life" is when you say positive things about someone rather than harping on jealousies and negative attitudes.

  6. NOT FOR NOTHING 934 AM but the amount of shumie time posts on this blog pale as compared to the civil blog where st is frequently the hot topic of conversation of the day. And to the extent some people inject some humor by posting under "fake names" I have a quote for you from the great movie Stripes: "LIGHTEN UP FRANCIS".

Its just people having some fun and interjecting some humor in what can be a stressful profession and many difficult days.

I for one often take a break and read the blog for a chuckle before going back to my difficult job, where between authoring scholarly articles and adjudicating difficult cases, I devote my time to charity and the poor the weak and the gullible.

  8. The amount of contested races in Broward is one of the best thing's that could have happend to the South Florida legal community in years. I have been in practice for nearly two decades and always wondered what the problem was in Broward with respect to never challenging weak or poor judges. Apparently Broward is now making up for lost time and everyone is getting a challenge. I realize that this will cost some good judges their seat but the long term benefits for the citizens of Broward as well as the entire South Florida legal community are tremendous.

About 20%-25% of my practice is in Broward and up until the last couple of years there judges have been the rudest and most arrogant group of judges anywhere. Many of them run brutally inefficient courtrooms. They never had a fear of being challenged. Now they do. If there was ever a group of judges that needed to be replaced it is the group in Broward. Maybe some of this challenge stuff will spill over to the State Attorney's office and we will see a real improvement in the way things are done north of the border.

  9. 9:27 p.m., read the Herald story on Ivonne Cuesta and what she went through and you'll see how she's different from other Cuban refugees who have "made it" in the judicial system.

We're an entire country of people with tragic stories that led us or our ancestors to these shores in search of something better, somewhere freer, and momentarily disregarding the genocide of the Native population, no one's history makes them any better than anyone else, or grants them any entitlements. Running from a brutal dictator, a czar, a famine, religious persecution, whatever...relating stories of our own immigration should not devolve into Quint and Mr. Hooper drunkenly comparing scars on the Orca.
