CRIME IS OUT OF CONTROL

UPDATE: Latest hurricane forecast below.

You can't go anywhere these days, even your local neighborhood pub for a few cool ones without risking life and limb.

The Civil boys have an interesting story about Becker and Poliakoff communicating with employees via podcasts! For you old timers, can you possibly imagine Richard Gerstein doing anything other than calling you in his office if he had something to say? Ditto Janet Reno.

David Markus seems to imply that there was some minor victory for the defense in getting an acquittal on 2 out of 6 charges in the Salesman/Miramar Commissioner corruption case in Fed court in Broward. We say a loss is a loss is a loss- the "victory" was a pyrrhic one at best. If you can't put your arms around your client as you walk out of court past the formally smirking prosecutors and agents, then you haven't won anything.

NEW HURRICANE FORECAST:
We don't know how you feel about it, but we're getting pretty tired of a bunch of nerdy dweebs in some place called Ft. Collins, Colorado, issuing dire warnings about Miami's imminent destruction sure to take place during the upcoming hurricane season. Last time we checked, and it was admittedly before the last earthquakes hit the west coast, Colorado does not border an ocean.

And yet these "scientists" are constantly issuing warnings that based on some far flung analysis of piscatorial waste products off the coast of the Galapagos islands, that ocean currents will be(choose the following) unseasonably warmer/cooler than usual, and that will (pick your poison) increase/greatly increase/bend over and kiss your sweet ass goodbye increase- the chances of a hurricane destroying all life and property within a hundred miles of the Richard E. Gerstein Courthouse.

    "Kreeger resigned too early, which now allows the gov to appoint a replacement for the seat. That means kopco and de la o have no race. De la o has a shit load of mulah and no race. Bad news for milt.

    Rumor is that Kreeger is trying to take back her resignation."

    If this is true, it will be the funniest thing ever!

I love the Sun Sentinel, here they do a story on the State closure of a Pain Clinic in Broward, and the abuses that these pain clinics do in keeping people hooked on drugs for a profit, and at the bottom of the story is a huge Google AD advertising a Walk In Pain Clinic with "No Waiting" in West Palm Beach.

  14. Here is the lastest from the DBR:

    "Kreeger’s retirement could mean the governor would appoint someone to the seat, delaying an election by two years and pushing out both candidates. Kreeger, however, made her resignation effective June 30, after the qualifying period ends April 30. Attorneys in Crist’s office are researching whether a resignation letter or the resignation date triggers an appointment."

    So what will it be? Any predictions from the captain?

  15. Colleagues, I represented myself, so I am taking all the credit for this great win in a case brought against me by my condo association nearly 8 years ago.
    I was sued by the assn., forced to go through arbitration, and to conduct an 8-day jury trial where I testified both as a fact witness and as an expert. Then Judge Jose Rodriguez, six months later, ruled for the association (ignoring the jury verdict), so I had to appeal. Attached is the short yet oh so excellent opinion just issued, completely in my favor. (Despite the "Wear v. Alca" title, I have at all times been defending.)
    Since the final outcome was completely in my favor, I expect a fee award from every stage of the case.
    The jury was out for 2 1/2 hours on December 19, 2007, before returning the verdict in my favor, and specifically rejecting each part of the injunction Alca had persuaded the arbitrator to enter.
    This was a hard-fought case, notable for Alca's determined efforts to block all discovery and to refuse me access to the condominium records.
    Since Alca's claim for relief was to have me evicted from my homestead (a violation of the Florida Constitution), I had a lot at stake. There were also Fifth Amendment (notice and hearing) and First Amendment (right to petition for redress of grievances, and efforts to censor civil discourse) violations.
    I must thank generations of defense attorneys and prosecutors, for giving me the necessary chops to litigate alone against a team of three attorneys from a big insurance defense firm.
    Alca started this litigation, by the way, after refusing my offer in June 2001 to go to mediation, which would have cost them maybe $300.00. My incurred fees are in the hundreds of thousands; the trial transcript alone cost me over $10,000 cash money American.
    The chief reason they sued me? I asked them to install a wastebasket in the hallway, for junk mail. They have refused, saying, through their long-time president, that people would put trash in it. (!)

    Congratulations on your victory! Be sure to claim all of your attorney's fees, which appear to be recoverable under authority of Quick & Reilly, Inc. v. Perlin, 411 So.2d 978, 980 (Fla. 3d DCA 1982), where the court agreed that "a lawyer who appears in propria persona has the right to recover attorney's fees."

    If you want to thank some people who helped you with it, send them a private e-mail. You just used the listserv to brag about your win that has nothing to do with criminal defense.
