They hate Johnson in Juv because he finds everyone not guilty. He is actually a nice guy.

Flora has been a really rotten judge and has no personality. How did she get appointed?
Kopco is no ball of fire but, was a respected prosecutor and has a decent rep in divorce circles.
I agree with the guy at 12: 02, Jeff Swartz was a nightmare as a judge. Remember when he made clients sit in his chambers and listen to classical music as punishment for playing their car stereo too loud? I say, NO JEFF SWARTZ... PLEASE NO JEFF SWARTZ!!!!

ReplyDeleteThe U.S. Supreme Court Monday dismissed a case regarding the scope of immunity prosecuting lawyers have in case surrounding wrongfully convicted citizens. The case revolved around a lawsuit in which two men wrongfully convicted of a 1978 murder filed suit against the prosecutors, alleging they had procured false testimony. The parties in the lawsuit recently reached a $12 million settlement. The case potentially opened the door for a ruling on to what extent can prosecutors be held responsible for violating the constitutional rights of defendants.

ReplyDeleteJudge Francis is no where nearly as nice as she appears. Faber is worse because he is so insecure and unsure of himself. Liefman and Pooler for jail division. Francis for social worker and Faber for village idiot.

ReplyDeleteHe was always professional and always had a calm demeanor when he was my opposition. In litigation.
A Judge has to be able to take on difficult task and remain judicially calm.
In addition he is smart and knows the law and will be able to make sound legal rulings from the bench.
He also surrounds himself with some of the best jurist on the bench and that says something about his character.

This blog is so full of hypocrisy. You guys constantly bitch that jnc applicants are just looking for a raise because they can't make it in the private sector. You bitch that some of the new judges have no trial experience. Here comes Milt Hirsch and Miguel De la O, two guys taking huge pay cuts, successful private careers and loads of trial experience, and you anonymous yahoos begin engaging in petty juvenile name calling. Tear these guys down, and you'll get the judges you deserve. Sure Milt has an ego, but he's earned it and is a good guy. Talk to him and see for yourself. Have you ever spoken to Miguel? Completely down to earth, approachable guy, with no ego. We could do a lot worse (Planas, Adrien, Swartz), and won't find many better.

I underwent many show-downs in front of Johnson, and on legal issues I think he applied the rule of lenity beyond its fair bounds, though I usually felt he at least gave the appearance of listening to the State's arguments before making up his mind. I agree with another commentator that Johnson too often found juveniles not-guilty, although I would have too if I so frequently fell asleep during the hearing and missed substantial evidence. It is not that he is unkind; he is nothing if not a gentle soul. However, if trials or other factual hearings bore you, then perhaps he should resign and hope for elevation to the 3DCA.

ReplyDeleteAgree with the Johnson comments. You will not find a nicer guy. But not the sharpest legal mind. But he is pretty harmless over in juvenile, unless you are an ASA over there, in which case get ready for a few Not Guilty verdicts on your "slam dunk" cases. PDs love him over there.

Gerald "Hawk" Hubbart will indeed be a loss to the bench when he retires.....This statutory senility law has caused some of the best and brightest to leave. He will be one. Others leave only because of DROP....or the idea they will make beaucoup bucks in private practice. Others are born with the termperament, intellect and decency to be judges. ReplyDelete5:51 - You don't know what you are talking about. You obviously weren't there. I was. I was a prosecutor on the Beach when Swartz was there.
ReplyDeleteHe never MADE anyone listen. In return for going back and spending 2 hours listening to opera, the defendant got a dismissal. You all complain that judges don't find ways of helping defendants out. Swartz did and you rail on him for it.
I suppose it would have been better for the defendants to take PTI and spend several weekends taking a values course and pay for it to bbot. Or better yet carry a withhold with costs.
Every one of those defendants was always given the choice to go to trial. Not one did. Not one got less than a dismissal. The cops were happy, the defendants were happy, the residents of M.B. were happy and so was I.
