Careful readers will remember that the Governor just appointed Labarga, a Palm Beach circuit court judge labouring in anonymity but for his run in with attorney Gary Kollin, (click here for our post "4th DCA Brouhaha") (you'll have to scroll down for complicated reasons) to the 4th DCA, when the Governor decided to continue his fight with the JNC by asking for more (read Hispanic) names when he didn't like the list submitted for the Florida Supreme Court. (Our own Judge Emas was the best choice by far.)
Now Governor Crist has finished the rapid rise of Judge Labarga by appointing him to the Florida Supreme Court, and in return, Crist will get the originals and the negatives of the pictures Labarga apparently has.
Our own El Capitan called it correctly in our comments section here, on the Justice Building Blog that gives you the news before it is made. A great reason to keep reading in 2009.

What, with all the budget crises, the court couldn't have turned out the lights and turned off the air for a day? Only 'essential' matters should have been heard today.
This caps off a bizarre selection process that was first reported by the Daily Business Review, that critics contend featured the worst politicization of the judicial selection process and even undermined the Judicial Nomination Commissions. The architect of the state constitution (Sandy D'Alamberte) has called for all the JNC's to resign and the entire process to be reengineered in the wake of the controversy -- that I'm proud to say were it not for the Daily Business Review, probably would have gone unnoticed, and happened quietly in a closed meeting. We fought to open that meeting and reported on it. This is why the First Amendment is so important. In a society based on the rule of law, the process is important!!!!
ReplyDeleteTo Power Ball or not to power ball? On the plus side, the jackpots should be bigger. On the down side, the already long odds of winning just got a lot longer (power ball odds are in the range of 1 in 195,000,000 vs Florida Lotto odds of about 1 in 22,000,000).

ReplyDelete12:21- CAREFUL readers of the blog know that for the past three weeks or so I have been ensconced in my winter blogger's retreat high in the Sierra Nevada mountains where my biggest worry was whether the light was flat (and thus wear my brown tinted sunglasses) and whether the powder was too deep for my snowboard. But alas, all good things must come to an end, and we are flying back early to see the dolphin game on Sunday.

ReplyDeleteJorge Labarga is in a trillion dollar federal lawsuit, with several other Florida Supreme Court Justices. The case is related to a New York Supreme Court whistleblower case and is known in certain circles as Patentgate or the Iviewit story. Info can be found at
