Update: In the comments section a reader makes a great point- to which we will add our thoughts: The reader opines that we finally get evidence on a dirty police officer disgracing their badge- and Rumpole notes that lord knows the odds of this being officer Macias's first time coercing a female he has arrested being slim and none, and - as the reader points out- Macias gets less punishment than his victim would have received if she was convicted of DUI. Something doesn't sit right with that.

A reader has reported, and we have not been able to verify whether the 3rd DCA has halted the plan for the ROC to take all 3rd degree felonies filed as of Monday. There is mass confusion, as a few PDs were planning on cutting out early Monday to go fishing, now that they don't have to handle third degree felonies. Stay tuned.

IKE: It wasn't but a week ago that we were all nervously eyeing Ike. Now this Cat 2 hurricane which is an astounding 500 miles wide is bearing down on the Texas towns of Galveston and Houston. While Texas owes the nation an apology for sending you know who to Washington, they don't deserve Ike. Our thoughts are with our Texas neighbors and all of us should consider a donation on Monday to an appropriate relief agency. Unfortunately it looks like they're gonna get slammed.
In this business we know why the beach cop got probation and a with hold. The prosecutors are too lazy to try the case.

They were the first blog contributors to gain fame and fortune which they turned into a nice paying gig at a Department of Interior blog where they were Frank and Harry, two well known supervisors at the Department. Now with word of the cocaine/sex scandal at the department, it turns out Allan-frank/Chris-Harry are out of a job. Will you take them back?

ReplyDeleteRumpolium- I was talking with an old timer who said that in the mid 1970s Judge Winton of county court became enraged with the decision in Schneckloth v. Bustamonte, and led a revolt among county court Judges to not apply the decision, which caused great consternation among the PDs. The case deals with consent searches I believe, and apparently there were a lot of those back then and the Judges didn't want to grant all the motions to suppress the PDs were filing.

ReplyDeleteOnce Again: not all cops are bad, especially Miami Beach cops. You have no idea the type of work enviroment that a Beach cop has to deal with. On another note, Macias and the girl, this was NOT their first encounter! This story is not what you all make it out to be, some unknowing female, that just happened to have been popped for DUI. Catalano is a dirty lawyer, a liar and manipulator. It is because of his actions that the case couldnt go anywhere. He meddled too much. Dont blame all cops of transgressions of one or another...

You have no idea what happended in that case. Catalano had nothing to do with the problems with the case. The IA cops had real bad tapes and there was very little to back up the woman's story.
Thanks for being such a smart guy.
If you condone that kind of behavior by cops, please move to another country.
