The Government was using an informant to feed Kuehne phony information that drug money was legitimate. They ought to hang their heads in shame for prosecuting this man.

ReplyDeleteRump- this just in: Dale Ross surveyed the damage, was walking away from the courthouse when he turned back to look at it one last time- and turned to stone!!!! Plans are being made to put him next to the Napolean Bonaparte Broward Statue in the new building.

''Kuehne should have suspected the [two] Colombians were unreliable. However, how would he have known that a U.S. sting operation was behind the money attributed to Saravia and his businesses? The government was placing him in harm's way in a classic entrapment. Who better to conceal the dirty money than a government sting operation?'' Tew said.
Others agreed.
''Since available information seems to indicate that Saravia played a key role in landing Kuehne in the dock, the question becomes: Did Saravia help prosecutors to snare a laundryman or did he set up an innocent, high-profile target to take a fall?'' said Brett Wolf, a U.S. money laundering analyst with Complinet, a London-based firm that helps financial institutions meet their compliance obligations.
''Taking into account Kuehne's outstanding reputation, one must assume the latter until such time as prosecutors present compelling evidence to the contrary,'' Wolf said. ``They clearly haven't done so at this time.''
South Florida attorney Myles Malman, a former federal prosecutor, said Saravia's informant role became the linchpin to the government's case against Kuehne.
''Saravia has the chip in his pocket -- the Ochoa linkage to the money in Colombia for his defense fund in Miami,'' Malman said. ``He's helping federal agents by becoming an undercover informant, an active informant. He's a key witness in the Kuehne case.''
Justice Department spokesman Paul Bresson declined to comment...."
The Government did this to Kuehne? AND there's no court Monday. But Broward is open? This is all too much. I think I need a continuance.

ReplyDeleteIt would be interesting to know know if ICE were involved in this case at all. The Herald article says that the charges originate from activities occurring 6 years ago. Wasn't the current US Attorney of SDNY the director of ICE at approximately that time? And who was his principal legal advisor at the time? The strange coincidences abound.

No Country for Old Men is as good a film as the Coen brothers, Joel and Ethan, have ever made, and they made "Fargo." It involves elements of the thriller and the chase but is essentially a character study, an examination of how its people meet and deal with a man so bad, cruel and unfeeling that there is simply no comprehending him. A bounty hunter trying to recover drug money named "Chigurh" is so evil, he is almost funny sometimes. "He has his principles," says the bounty hunter hired by the business man who owns the money and wants to find Chigruh (the bounty hunter for the bounty hunter is Woody Harrelson), who has knowledge of him.
ReplyDeleteThe moview twists and turns at its own pace and is a rewarding film for film's sake, forgoing the sappy hollywood ending that we could otherwise see ten miles off. None of that here, and we are better off for it. Go see this movie.

Then - Next time someone hurts someone you love (G-d forbid), maybe you can call Santa or the Great Pumpkin to try to gain some semblance of justice.
Prosecutors are decent persons who try to do their best. Ask the criminal defense Bar - most of whom have had a stint as prosecutors. They did not have to check their decency at the door.

1. Please stop with the "who-you-gonna-turn-to-when-someone-you-love gets-(hurt-killed-raped-robbed)" argument. If it's not beneath you, it's certainly beneath your reputation. And, it has nothing to do with some people, owing to their nature and/or their view of the government, not being comfortable with being in the role of a prosecutor. There is need for prosecutors, but that doesn't mean all lawyers could stomach being one. (Especially with the lack of discretion in your particular office!)
2. Excuse me while I get out of the way of your ridiculously broad brush: "Prosecutors are decent persons." Simplistic? Yes, and naive, to boot!

ReplyDeleteHere is what I don't get- almost every article about a defendant getting a new trial based on DNA is followed by the prosecuting attorney swearing they will re-try the scoundrel. And then about a month later, the case is quietly dropped. Just about any top prosecutor that I know in Miami would race to court to drop charges if DNA exonerated someone and there would not be any nonsense about a trial anyway. What gives with the rest of the nation? Why can't they admit they made a mistake, say sorry, and move on?
