We did not really know Judge Shockett so we are unable to provide any memories or details about her life and work as a Judge.

Judge Shockett was involved in the organization LEAP- Law Enforcement Against
Prohibition- an organization against minimum mandatory penalties.

Eleanor Schockett was born in Ruleville, Miss. and raised in Birmingham, Ala. She received her B.A from the University of Alabama with majors in History, Political Science and Law. She then headed to New Orleans, La. to complete her legal studies and receive a J.D. from Tulane Law School. She became interested in Drug Policy when she wrote her senior paper on the administration of US drug laws and knew something was terribly wrong. She maintained her interest on the issues first in the '60's as the wife of a owner/pharmacist and then in the '70's as a guest talkmaster on WKAT's Talk of Miami.
Eleanor was elected to the Circuit Court of Miami-Dade County Florida and began her service in January 1991. Although the latter 15 years of her private practice were devoted to Family Law, her first assignment was to the Criminal Court. By the time she left the Bench on December 31, 2002 she had served in the Family and General Jurisdiction divisions as well. In all three divisions she saw the havoc wrought by a failed drug policy.
Her particular concerns were the erosion of personal liberties of all our citizens. She believes if the American people learn just how bad things are, they will be changed for the better. She vowed to speak out and appreciates the opportunity.

I recall seeing her at more than one bar function over the past couple of year. She wore a pin and handed out business cards referencing "LEAP" - Law Enforcement Against Prohibition; www.leap.cc
For those of you not aware of this group:
Founded on March 16, 2002, LEAP is made up of current and former members of law enforcement who believe the existing drug policies have failed in their intended goals of addressing the problems of crime, drug abuse, addiction, juvenile drug use, stopping the flow of illegal drugs into this country and the internal sale and use of illegal drugs. By fighting a war on drugs the government has increased the problems of society and made them far worse. A system of regulation rather than prohibition is a less harmful, more ethical and a more effective public policy.
The mission of LEAP is to reduce the multitude of unintended harmful consequences resulting from fighting the war on drugs and to lessen the incidence of death, disease, crime, and addiction by ultimately ending drug prohibition.
So, for those of you who did not know, she was a pretty darn good judge - for the defense - given her strong feelings about this issue. She may not have been a Judge Cowart or Sorondo but she was far better than an Adrien or others that I won't take the time to name; (wouldn't want the bar all over my bar card).
May she rest in peace. (and please try to remember one of the golden rules; if you don't have anything good to say, just keep it to yourself - especially in times of mourning).

ReplyDeleteI would, as a ctizen, like to comment on an elected official. Isn't that the beauty of America. But they didn't tell me that accepting a bar card would waive my first amendment rights.
ReplyDeleteWho ever said this is a true democracy and a truly free country is sadly mistaken. It's pretty sad and serious when the govt will punish you and hinder your ability to make a living if you question that very govt. That concept reminds me of some not so benevelont dictators of the 20th century.

ReplyDeleteCollier judge says he's 'pushing envelope'; others say he's gone too far .....
If you thought we ever had it bad here in Dade, just venture over the Alley to Collier County and visit his Honor, Judge Mike Carr.
On the bench less than one year, Carr continues to make headlines. This time, he held a defendant on a Burglary charge with NO BOND. The State had not asked for Pretrial Detention. The PD filed a Writ with the DCA. Even the State's brief agreed that the defendant was entitled to a Bond.
“The petition for writ of habeas corpus is granted,” the court wrote Jan. 7, ordering a circuit court judge to hold a hearing by 4 p.m. the next day to “determine pretrial release” under Rule 3.131.
Carr, a County Court Judge, sitting in a Circuit Court capacity, took that order to mean that he could hold the defendant with NO BOND again as he was a danger to the community. So, again, he has held the defendant with no bond.

Oh Susannah Nesmith breaks this story about a former Court Clerk that was arrested today and charged with 52 counts of fraud, unlawful compensation and other crimes.
Olga L. Avila, a 16-year veteran of the Miami-Dade court clerk's office was arrested on charges alleging that she scammed couples trying to get divorced by promising them ''quickie divorces'' and then filing fraudulent paperwork on their behalf.

4:39- the first two comments about Judge Shockett were that she was not a good judge. Those were in extremely poor taste in my opinion considering the woman just passed away. But I am not the arbiter of taste and I posted them. So the question I have is, what is your point?

Judge Geri Beth Cohen has filed in Group 55 for reelection.
This leaves only one incumbent judge who has not filed out of the 47 Circuit and County Court races set for election in 2008.
In Group 35, Judge Orlando Prescott has still not filed for reelection. He has until May to decide. Will he re-up for another six years or is he considering a run for some other position: like KFR's or CM's?????

Eleanor Shockett was a very nice person. She was probably frustrating for the PDs or ASAs in her division because she was not very efficient at running a calendar and did not try a lot of cases.
ReplyDeleteHowever, she was intellectual, very compassionate, andmore personal than most of today's judges. She ran her division in a "folksy" kind of way and even (I kid you not) had a Norditrak (sic) aerobic exercise device in her chambers. She was in 4-9 or 4-10, so she was isolated from the masses. She would entertain Barbera/motion for a downward departure arguments from the guidelines while rigged up, arms flayling and doing the cross country skiing thing. I do not know if she was a native, but she exhibited a certain "Southern" charm to her.
She looked like the female teacher from the movie "Clueless" that Alicia Silverstone was trying to fix up with the other bald teacher.
She was very much into "men". The source of the argument was just as important as the quality of the argument.
She was a wonderful character that did not try to do anything to appease her constitutients but rather did what she thought was right.
scott saul you are an idiot. she was a disgrace to the bench and had no idea what she was doing. of course you liked her because she genufleected before all defense attorneys and did whatever you wanted on every case
