Former Miami-Dade Assistant State Attorney Herbert E. Walker III resigned suddenly last week amid an investigation into complaints he sexually harassed at least five women in the office, according to documents released Friday.
At least two women accused Walker of touching them inappropriately and several said he would often comment on their appearances, saying they were ''sexy'' or even talking about specific physical attributes like their legs or breasts, according to complaints filed by the women.
The complaints were released by the state attorney's office in response to a public records request.
One woman complained that Walker told her she would be his girlfriend -- if it weren't for their working relationship -- then put his arm around her shoulders and touched her breast.
The woman said she moved away and he apologized, but that he did the same thing again at a later time.
Another woman said that Walker was so persistent in his advances she stopped wearing makeup to work ``so he would not look at her.''
''We don't tolerate any type of inappropriate behavior, whether it be sexual or issues of credibility,'' said Terry Chavez, the spokeswoman for the office.
Walker, who has been involved in several high-profile cases over the past few years, did not return a phone call seeking comment.
Several of the women said they were afraid to come forward, fearing Walker, a 10-year-veteran of the office, would retaliate against them. One woman said she didn't feel comfortable coming forward because ``he touches everybody.''
Another woman confronted him and told him she felt his comments were inappropriate. But three days later, he ran his fingers through her hair while the two were talking in a hallway.
Office management received the first complaint on Dec. 14 and, within a few days, the other women came forward.
Walker, an avowed evangelical Christian, also sent one woman an e-mail about Jesus and the Bible, and then called her into his office and insisted she view the e-mail message with him.
The woman, who is not a practicing Christian, told him she ``wasn't into it.''
''Mr. Walker then said that his supervisory duties kept him from telling me what he truly felt about that,'' the woman told her superiors at the office. Later that day, he came into her office, closed the door and told her she was ``sexy.''

Sexually assault and batter employees and create an actively hostile work environment to the point where women are afraid to show up for work, and the State Attorneys Office allows you to resign with nary a peep?
What in the name of Watergate is going on over there? These people need some sexual harassment counseling from the Broward Judiciary. Even Judge Ross from North of the Border is laughing today at our State Attorney.

As I have said before numerous times, the allegations against Herb have been going on for a long time. Howard Pohl always turned the other way. I wonder why!!!!!! wink wink.
ReplyDeleteThese rumors started a long time ago relating to female interns who worked under Herb. Some of these female interns asked for transfers based on not liking the workload in domestics, but the truth was that Herb was sexually assaulting them *(verbally and physically). However, the interns felt if they said anything they would not get a job at the office. I hope these interns who do work in the office or are no longer in contention for a job will speak up. I know some of these interns, as they ended up working for me.
Why would Brother Don not spank Brother Herb? Guilt or Brotherly Love?
If these allegations are proven to be true it will be a total disgrace and very disturbing; however, they are what they are, allegations. I find it amazing that most of the "hang em high" comments are more than likely authored by defense attorneys. Innocent until proven guilty unless you are an ASA hated by many for being religious, boastful, and self-righteous. I hope all of you possess flawless characteristics and you live your life blameless if not (as a previous post stated)what goes around comes around.

Rule 4-8.4 (d) states that a lawyer may not disparage another on the basis of “religion.”
Either The Bar finds out who this person is who has disparaged me on the basis of my religion and disciplines him for that, or The Bar must drop its Rule 4-8.4 (d) prosecutions of me. If The Bar is going to be the “manners and speech police,” then it had better discharge those Orwellian functions equally and not in pursuit of equal protection-denying selective prosecution. While in Juvenile Court, Patricia Lieber screwed over two ASAs in the same manner. Lieber gave verbal approval and after the plea was done, the bitch screamed and sanctioned two ASAs on two different occasions.

There is Lewd and Lascivious on the Elderly and Disabled Adults (thus could be adults).

This might be an Aggravated Assault though if 366 is what you're after.
As to the "on LEO" aspect, ASA's are technically not LEO's but SAO Investigators under 27.255 are.

The Bar, just so you all know, as if you cared, enforces Rule 4-8.4(d) if you say something truthful about a porn lawyer, and we're going to see if it enforces it in such a way that disparagement of Christians is acceptable.

ReplyDeleteHow do you not know what a SLAPP suit is? SLAPP is an acronym for strategic litigation against public participation. It is the growing technique of filing suits or actions against a whistleblower or activist to deter him from exercising his First Amendment rights. See Florida Statute 768.295.
This statute is just one reason why my suit against The Bar will be successful in state court.

I think your (rightful) anger and frustration over what's happening at the SAO is clouding your judgment. Here's what you said:

have you all forget that the bill of rights ensures free speech? I invite you to show me the amendment that states that you are free from being made fun of or offends.
ReplyDeleteFreedoms come with a price. One of those prices is that your public actions may be criticized ok this little blog. Does not seem to be a very high price to me.
If you can't handle being made fun of, stop posting your crazy pleadings on the blog. And stop. Cc'ing all of your correspondence to the bar and governor here.
I'm really shocked that attorneys act like such babies. How embarassing for us all.
jack - you are a hypocrite. Free speech is a two way street. Do you have any paying clients or do you just sit around thinking of people to sue?
