EMPTY

THE CUPBOARD IS BARE

This disappointing email from Rick Freedman arrived announcing that the State (again) has no money to pay attorneys who have already submitted bills:


I have been informed by the Justice Administrative Commission (JAC) that you may experience delays in the payment of your outstanding bills for the next three months. As you are aware, the new 90 day billing rules took effect at the end of August. As a result of that rule, the JAC was swamped with over 4,000 bills arriving at their offices in one day, (in an attempt to beat the new deadline). They believe that it will take them up to three months to catch up on their payments. Once they are caught up, they should be able to return to their regular payment schedule of paying your bills within two weeks.

On a separate note, for the first time since taking over the CAC system in 2004, the JAC has discovered a small group of attorneys that have been billing more than 24 hours in a day. None of the attorneys involved are on the Criminal Registry in Miami-Dade County. (Unfortunately, those involved include a few attorneys from the Civil Dependency Registry in our County.) Please make every effort to keep clear, concise and accurate records if you plan on filing any long form bills. The Screening Committee will not hesitate to take action against any attorney on the Criminal Registry who is found to have submitted any fraudulently billings.

THE COURTHOUSE IS EMPTY

North of the Border Circuit Court Judge Ana Gardiner recently commented that the North of the Border courthouse was overflowing with work, to the extent that even closets weren’t available.

Enter Famed Broward Blogger Bill Geilin who took it upon himself to conduct a thoroughly un-scientific but revealing study by walking the Broward courthouse at different times of the day. The result, was the not so surprising conclusion that during the afternoons more than half the courtrooms were locked and empty.

CHAMBERS SHOULD BE EMPTY...

Of gifts. As the holiday season approaches, we can all expect to see Judge Farina’s letter advising that gifts should not be given to Judges or their staff, nor should they be accepted. Judges are also advised against attending holiday parties thrown by attorneys who have open cases in their division. (insert your own joke here).

And out of Dallas, Texas (motto: we like to kill) comes this Op Ed piece about the shocking execution of a Texas inmate, where the Texas Court of Criminal Appeals would not stay open past 5PM to receive the last minute request for a stay of execution:

What's 20 minutes to you? Two miles on the expressway during rush hour? Time to slurp a latte on the way back to the office? About the time it takes to scan the newspaper you're reading now? To Michael Richard, 20 minutes was probably the difference between life and death.
The Texas death-row inmate's lawyers petitioned for a stay of execution after the U.S. Supreme Court's decision to review the constitutionality of lethal injection. ..

Mr. Richard's lawyers were working on his petition when their computer crashed. They phoned the Texas Court of Criminal Appeals, informed its personnel of the computer problems and asked them to stay open long enough to accept the paperwork.
Forget it, replied the court. Time thus ran out for Mr. Richard, who died on the gurney. A court official later said, "I advised the parties that called that we closed at 5."

Just like that.
That is unconscionable.

You might not lose sleep over the fact that the court wouldn't stay open for 20 minutes to help a convicted rapist-murderer's attempt to evade the needle a bit longer. You should think again.
When the state takes the life of a condemned criminal, it must do so with a sense of sobriety commensurate with its grave responsibility. Hastening the death of a man, even a bad one, because office personnel couldn't be bothered to bend bureaucratic procedure was a breathtakingly petty act and evinced a relish for death that makes the blood of decent people run cold.

Rumpole says: Our understanding is that our very own clerk’s office considered dispatching a team to Texas to study their efficiency, until it was realized that the Texas clerks were actually working to 5PM. When the laughter died down, the idea was voted down.

    The PD's call him good.
    And the defendant's just call him your honor.

    Sporting a Sam Slom imitation haircut and exhibiting a no nonsense and fair play approach to the law, there is a new Sheriff in County Court and his name is Joe Fernandez.

    Just this week JOA Joe bounced a .07 reading with perfect roadside tests. Other DUIs have similarly fallen by the wayside with a Judge who is not afraid to call them as he sees them.

    What's next for County Court's rising superstar? Stay tuned.

    The judge will also hear from Thompson on a motion regarding the “show cause” order issued from the bench following Thompson’s inclusion of gay porn in a docket filing.

Under the system we have, which is semi-collectivist, I would rather the money they take from me be used to pay for children and veterans health care, than Halibuton and Dick Cheney's friends. I don't like the system, and yes, if we didn't have a right wing collectivist in the White House, I would not want my money to be forcibly taken from me to pay for someone else's child- but that is a philosophical debate for something that is not the real world.

    In the real world, children in America go hungry, and children in America die from a tooth abscess because Bush and Cheney looted the treasury to pay for Halibuton and Blackwater as the Neo-Cons manipulated Bush into a wrong war so Bush could avenge his Father.

    Great you should be thrilled as you are on the road to saving your bar card. Next step prepare letters for each Judge and Bar counsel that you have lied too, insulted, libeled... (you get the picture) a one page sincere "I am sorry for being a complete jerk. I now have the correct dosage and meds available and that this will never happen again".

    Look at this you are almost at the point of being a real lawyer. Now for the final step and this is very important so read carefully. Wait my bad, I am so sorry I almost forgot before we proceed further get a full glass of water and take your 4pm psychotic pill. Great all done?     Our sources tell us that Judge Roger Silver has finally decided not to seek reelection. That means, GROUP 19 is an open seat and up until today, Mr. Millan was the only one who had filed to run.

    Enter Patricia Kopco, a member of the Florida Bar since 1995 and in 2005 she received her Board Certification in Marital & Family Law.

    Kopco will not be running in the seat occupied by Eugene Fierro, Group 11. There are already two candidates who have filed for that seat: Jorge E. Cueto and Josie Perez Velis.

I said I completely oppose both forms of collectivism. I do, however, believe the collectivism of the Left is much more dangerous at this point. That is my view. Does not mean I favor Bush at all!! Just that I think the Dems are a little worse, but in very different ways, I agree.

Any comptent doctor looking in his mouth would have seen the abcess and would know that untreated, it could leak into his brain and kill him. Instead, because he didn't have the right insurance, they gave him some asprin and sent him home. he died because no one would perform a 750 proceudre. But hey, as long as Haliburton's profits are up a billion last quarter, everything in this country is just fine. Just fine.

  41. By the way, one very misunderstood concept about Ms. Rand was that she scorned altruism. She did not. She correctly noted that every oppressive government justified it's actions on "the good of the people." And she also noted that most oppressive forms of collectivism defended their actions on the good of society. What she objected to was being told that she must- and had no choice in the matter- to care about and take care of someone she did not know, and the philospohical implications behind those ideals.

    Therefore, I defend my concern for this young boy who died as completely consistent with objectivism, and quite frankly, with my other beliefs, which hold that life is sacred. This boy's life was wasted by a society that spends hundreds of billions of dollars perfecting ways to kill people- including innocent civilians and children. And I am troubled by that. We have lost over 3,000 Americans in Iraq. Over 100,000 Iraqi's have died at the hands of our weapons. Now this is complicated I grant you, because Iraqi is filled with criminals who have no problem blowing up their own people. Now, I could paint with a very broad brush and say "violence begets violence" and I think that would be fair in the case of Iraq. However, I do not think that would be fair in the case of Afghanistan, where NATO is making real progress. The point is, we need real professionals managing these situations, and we need to break the cycle of violence in Iraq. What we don't need are greedy crooks manipulating a dimwitted president.

I've read much of her stuff-including Atlas and Fountainhead--pesonal favorite-"Anthem"-but I'm not some lockstep Ayn Rand radical "objectivist". I do think income redistribution via govt fiat is generally immoral and leads to the infantilization of the communities its intended to help. We see that in many neighborhoods in this nation, and this city.

    Leave Bush and those idiots out of it-can you really disagree with the deleterious effects the welfare system has had on folks caught in its trap? And please dont say we just need more welfare $ giveaways. Its the worst kind of pandering.

    Better to rely on yourself-better to know you'll have to rely on yourself-than to ever expect a bureaucrat or program to solve your problems-whatever they stem from.

Now, obviously, this has, again, a chilling effect on protestors, but we would ask that everyone show restraint and allow those who want to express themselves to be able to do so in Burma.

    A FITTING ENDING (???) TO A SAD STORY ....

    Many of you read the unbelievable story about the AUSA in North Florida who was arrested recently after traveling to Michigan to meet a mother and her 5 year old girl for sex. He had met the mother on an internet chat room (an Internet sting operation actually) and he went to Michiagn with a Dora the Explorer in hand (along with petroleum jelly) when he was arrested.

    AUSA J.D. Roy Atchison, 53, committed suicide in the Federal Detention Center yesterday.

    Atchison's attorney was quoted yesterday as saying that he would seek the have the charges dismissed as "prosecutors are sometimes willing to do so when a defendant does".
