DEPOSITION DICTATORS

We have noted something disturbing. If you want to take a felony deposition, you need to schedule a room with the State Attorneys Office. The State Attorneys Office will then decide, based on the number of witnesses you want to depose, how long you will have to depose this witness.

Now lets take a guess here: When you send your request for a deposition, do you think Ms. Rundle gets together with Don Horn and they review the file, see how serious the case is, whether you are deposing a lead detective with a 50 page report, or a guy who strung up some crime scene tape, before deciding what’s a reasonable amount of time? Or is it a secretary sitting around with nothing better to do?

, this is an outrage! Just where in the rules of criminal procedure does it give some nameless faceless bureaucrat who is stalking the halls of the SAO the right to decide how long you should have to depose a witness?


We would expect the FACDL to jump right in on this and do something, but they are too busy arranging the memorial to Sy Gaer, right guys? How’s that coming? Almost done?

Well, I don’t know about the rest of you, but we're not going to give some two bit SAO bureaucrat the right to decide how long we have to depose a witness.

(Memo to whoever gives a damn at the SAO: your little slide show about victim’s rights has several grammatical and spelling errors, including instructing victims about what to do if “your out in public and feel afraid.” Change that to “You’re”)

Gov. Crist has named his replacement for the open seat of Judge Pereyra Shuminer.

Nushin Sayfie, of the Dade County Public Defender's Office has been chosen over Lisa Walsh, Judge George Sarduy, and previously eliminated Joe Davis, Miguel De La O and Judge Darrin Gayles.

As I previously wrote several weeks ago, contrary to the typical Bush move of appointing a County Court Judge and getting a 2 for 1, Gov. Crist has chosen a private attorney in all but one open seat throughout the State during his first year in office.

Next up is the open seat of Judge Jorge Perez, who recently resigned to go back into private practice.

    Why is it that when anyone complains about something they immediately want to know why FACDL-MIAMI isn't on the case? Have you called or emailed Mr. Barry Wax and let him know, or do you just expect him to be aware of every little thing going on in the world?

  6. To 9:28 and the other naysayers:
    Nushin Sayfie is bright, fair and experienced. She has worked in the pits, as a felony training attorney and as a senior supervising attorney. She is well thought of by not only the PD's office, but by the private bar and bench as well. She has tried more than 60 jury trials, including capital murder. In fact, she has more experience than many, if not most, of the judges sitting in the REGB now. The system for picking judges may be imperfect, but Gov. Crist certainly got this one right.

ELECTION OBSERVATIONS: Judge Patricia Marino Pedraza should be reminded even though it has only been a year since she won her election that all eyes and ears are around the Judges and especially the Judicial Candidates. If she continues to accompany Judge Norma Lindsey to multiple events she is a walking a fine line around the Cannons. I'm sure she wouldn't want her actions to be miscconstrued as endorsing a candidate. The mere appearance could be looked at disfavorly upon yourself and the friends you support. It should also go without saying that you should be even more careful of the words you speak and to whom you speak them to.

  12. Actually the most qualified person in the group was Miquel de la O followed by Judge Sarduy. As 9:28 stated we once again will watch someone sitting on the bench learning what a courtroom is all about. Being an administrative PD with a husband who used to be Jeb's speech writer and political hack are not qualifications to deal with the complicated issues of a criminal trial and how to control spoiled lawyers ready to jump on your every sign of weakness. But that is okay, because even Justin will not save her in 2010.

  14. Rumpole the FACDL is way too busy trying to get two additional names on the FACDL stationary. Jesus almighty have you seen the cover letter from the FACDL? Every lawyer who ever worked for, looked at, spent time with or any of the above in relation to the FACDL is listed on the stationary.

    The letter head is the funniest shit I have seen in years. All those egos trying to get there name on the stationaty for the FACDL. There must be at least 100 names squeezed in on the top bottom and left hand side of the letter head. I though someone was joking and boy was I wrong.

  17. Batman and 9:28: You have absolutely no clue what you are talking about. Nushin Sayfie has tried MANY felony trials (including murder cases). I should know b/c I tried a dog of a case with her, and she did a fantastic job of turning a cop's testimony on its ear. The jury came back with "not guilty" verdicts in about 30 minutes on what I thought was a loser case. I'm pretty sure that Nushin's skillful cross had much to do with that verdict. I'm not sure where you get your info/gossip from, but trust me, Nushin is NOT the PD to bash for not taking cases to trial. I am certain that she will make a fine and fair judge. Double-check your facts before you run your mouths.

    Thanks for the heads up. The fact is, I had no idea about this deposition room problem at the SAO until I read the blog today. My personal experience is entirely different - I have never been limited in deposition time, or ousted from a room in the midst of questioning. On behalf of FACDL, I'll deal with the issue. If you or anyone else have any specific instances where this happened, please send me an e-mail at barrywax@bellsouth.net so I can bring them to the SAO's attention. And by the way, the Sy Gaer memorial is comning along just fine... ;-)

  40. 3:56- by "cover 2" I assume you mean the 4-3. It's overrated. There are better ways to play 4-3 than cover 2. I tend not to like the 3-4 and yet some teams, a very few, run it very very well. The Steelers obviously. In fact I think the Steelers threw the first shut out of the year last Sunday. That being said, what I don't like about the 3-4 is the lack of pressure. The Steelers on the other hand, while they may line up 3 linemen and 4 line backers, usually are sending 4,5 or more to rush the quarterback. So in a sense they are actually running a 5-2-4 or a 6-1-4, or some variation.

    The 4-3 in which the s safetys divide the deep zone (i.e, cover 2 (deep)) is a zone defense. Out of the 4-3 I much prefer to roll a safety up for run defense, send a dog (blitzing linebacker or conerback) , put the other saftey and the
    cornerbacks in man to man or a modified zone. The Patriots play a variation of that as well as a 3-4, and so do several other teams.

    Actually my favourite defense is the old Tom Landry Flex Defense that the Cowboys ran in the 70's. It always made sense to me to back a few guys off the line to see what develops. Ironically, the weakness of the flex defense was a trapping offense which the Steelers ran, and you saw what they did to them in the two super bowls in the 70's.

    Conclusion: for every possible defense, there is an offense that will exploit its weaknesses, and vice a versa.

    Oh, but don't bother if you're running against an incumbent, you won't get their endorsement anyway.

  43. I took depositions this morning in a case where Jorge Cueto is the ASA. Apparently he is running for Judge, and I think he would be a wonderful addition to the bench. Cueto is smart, fair, compassionate, and an all around good man. He knows the law well. He was a cop and a prosecutor, yet has the perspective to know what is right from what is wrong. He strikes me as someone who will be a very good judge. He will make the garbage go away, be tough on those who deserve it, and treat all who come before him with respect. Go Jorge!

  47. In my opinion, the circuit judge that needs competition in 08' is Jacqueline Hogan Scola. I have lost track of the times she has treated me like a piece of trash in the courtroom. When I received her campaign letter asking for money, I almost passed out. I believe it is still buried on my desk somewhere. Maybe I should send it back with some of my student loan statements.

She tried many cases before me and she was a first class trial lawyer - prepared, intelligent, superb temperament and i believe that she would make an excellent Judge.   55. if u don’t like doing depos at the state; do them at the pd's. The front desk staff at the PD's is rude and nasty. the rooms are dirty and dark. The state is clean nice and orderly. I sure they would give you a room for as long as you needed just book it in advance.

  59. I’m not sure the fascination with giving me these two choices. But since I am an expert in nearly everything you could possibly want to know, I will endeavor to entertain, enlighten, and educate you.

    Utah together with Omaha can only refer to- when used in conjunction- the code name for the two landing points of the American Expeditionary Forces in Europe for WWII.

    The 4th Infantry Division landed at Utah Beach. The 4th ID landed way off course, but they quickly made their way inland and secured many of the major D-Day objectives they were assigned. Brigadier General Theodore Roosevelt, the only General to land on D-Day, and the oldest American to land in France on D-Day (at age 57) made an early reconnaissance of the area, realized the landings were off course, and directed his troops inland in the proper direction of their objectives. Roosevelt is remember for his very American sentiment upon realizing the error of the landings “Well, we’ll start the war from here.” General Roosevelt was awarded the Medal Of Honor for his actions on D-Day, which included a personal reconnaissance in what was behind enemy lines. As opposed to Bloody Omaha, only 200 Americans were killed in the landings on Utah Beach.

    V Corps, comprised of the raw and untested 29th Infantry Division, the 1st Infantry Division and eight companies of US Rangers, were assigned the task of landing and securing what became known as “Bloody Omaha”.

    While many brave men fought and died at both beaches, there can be no comparison- Omaha Beach was the toughest assignment on D-Day, and the battle raged back and forth for much of the day before a beachhead of approximately one and one half miles was established by 9PM. Approximately 3,000 Americans died on Bloody Omaha. While Roosevelt is remembered for his good humor and calm demeanor on Utah Beach, Colonel George Taylor is remembered for his rallying cry on Omaha Beach to the Americans pinned down under lethal German machine gun fire: “Two kinds of people are staying on this beach- the dead, and those that are going to die. Now lets get the hell out of here.” And with that, Taylor led the men around him in repeated charges that eventually breached the German lines.

    So to answer your question: were I transported back in time, I would choose to land on Utah Beach.

He's fortunate to be wealthy enough that her early jump in fund-raising is irrelevant. The hispanic name garners ethnic points even if he doesn't stoop to play the card. Finally, her natural constituents, jellyfish, can't vote.

Lisa Walsh's name has gone up to the Governor more than 5 times, but she didn't get the appointment because she's not married to Justin Sayfie. Anyone who thinks that Nushin got the appointment for any other reason than who she's married to is lying to themselves. And, just as an advanced reply to those who will accuse me of actually being Lisa, I am not. If she saw me, Lisa probably wouldn't even know my name. Nushin's useless and it's a shame she took someone's spot.

    What I want to know is WHEN Crist intends to replace JNC members Dorta, Cadre and Pedrosa since their terms EXPIRED June 30th. No wonder the more qualified and experienced candidates keep getting passed over. "If you keep doing things the same way, you will continue to get the same results". Take a minute from property tax reform and fill your JNC appointments Charlie...we're waiting.........and while you're at it...could you stop picking the same people to serve on the 11th Circuit JNC AND the Federal JNC so some other Miami lawyers who actually practice law have a chance to give input on who should be selected as a judge?

  77. To 1:29 and the others who claim that Nushin is not quialified...

    I have known her for eight years or so. I have collaborated on cases with her, watched her trials, gone to her staffings, etc. It's BECAUSE of what I have seen her abilities to be that I seek her out when I have a question on how to proceed with a case. She's extremely bright, more than qualified, and has a great temperment (I'm sure those who guess who's writing this would say much better than mine). She tries cases regularly and not too long ago won a big murder case in Judge Murphy's division. She's done everything up to and including work on capital matters.

    The bottom line is this - Nushin is qualified REGARDLESS of any other factor that may exist. She knows how to supervise people and is fair with her compliments as well as her criticisms - yet she is not afraid to call people out when they deserve it. Perhaps those of you (who I suspect may only number a couple) who are saying the negative things that you are about her are among those she needed to remind how to do your job properly. My advice - don't be jealous of others and concentrate instead on being a better lawyer and human being yourselves.

    As for the accusation that we - her friends - "anticipated" the attacks - that may be true but only because we know for the most part who you are and that you would have negative comments to make about certain members of our office regardless of the topic at hand. So yes, we are quick to defend her because she deserves defending by the likes of you. You could only hope to one day be the caliber attorney or person that she and many others over here are.

    I, for one, feel very fortunate to have been able to learn from her while she was at our office. I am very proud of her achievements thus far as well the fact that I can call her my friend. She will be a great judge and a definite asset to the bench.

    Go get 'em Judge.

Spending all this time on a memorial or something , while the Wheel dies, hurting hundreds of their members, while close-close goes away, all the BS we have to deal with in the cthouse, jails, etc. Do these people ever succeed on any real issues? Too many fucking gasbags.

You simply cannot accept the fact that people who actually know her qualifications and temperamanet might feel the need to share their opinions in the face of the baseless assertions that have appeared on this blog.

    And for the Lisa Walsh supporters, try to accept the fact that brains, success, and litigation skills may not be sufficient to get a judicial appointment. We're all adults, right? Everyone knew the landscape going in, right?

  83. First Judges are not allowed to endorse or appear to endorse any candidate for any race. Second it just looks bad that Marino who has been friends with Lesperance for many years is now "friendly" with Judge Lindsey. She should have remained neutral it shows more class.

    Well, all I have on the Jack Thompson hearing today in front of Judge Jordan is (what purports to be) Jack Thompson's summary of the hearing posted on GamePolitics here:

    I’m delighted to announce that Judge Jordan vacated his order regarding referring me to the disciplinary committee, and he decided to forego all disciplinary remedies.
    The judge started out by suggesting that he did not feel comfortable doing so unless I admitted I had done something wrong. I said I did nothing wrong and would not admit that I did. He asked, “Then how do I know you won’t do it again.”
    I pointed out to him that Christ said, “Render unto Caesar what is Caesar and unto God what is God’s.” Christ, then, was making it clear that people of faith are not free to disobey civil authority, and if he now entered a court order for me not to do this, then I would not, as Christians are not free to disobey the law without consequences. But I told him he could not order me to say I did something wrong, because as a matter of conscience I could not do so.
    That obviously satisfied him, and he voided out the entire disciplinary matter. Norm Kent was there, which was hilarious, having moved the court last night at 10:30 pm to let him “intervene” and appear before the disciplinary committee against me. Poor Norm, he went away from the hearing sad.
    As to the Bar’s motion to dismiss, the judge will rule in two weeks. I expect to receive from the court certain federal relief against this Bar. You all don’t know the case, and I do. Norm Kent, who is now unofficial legal consultatnt to Dennis McCauley as to all things “Jack” smugly predicted here and elsewhere that this disciplinary blow by Judge Jordan was sure to unravel everything for me.’
    Now the disciplinary matter does not even exist. How did that prediction turn out for Norm and Dennis?
    Kids, leave the lawyering to lawyers. I’ll leave the mind numbing games to you all.
    I had a great day, standing before a federal judge for a 2 hour and 45 minute hearing, and I did just fine. Even Norm Kent would have to admit that.

If its true that Judge Marino-Pedraza has turned her back on Lisa Lesperance I will be extremely disappointed in her. I just want everybody to know that last year I stood in the rain holding her sign among others because of Lisa. If it's true I won't support her ever again and I hope somebody runs against her next time.

    1. The new judge will be fine. She is just as qualified as the rest on that list and everyone knows it.
    2. I know for a fact that Patti Marino did not endorse Lindsey and did not appear at any "function." That is bullshit and the person who posted it should be ashamed of itself.
    3. Gayles is a really smart guy. He will become a circus judge in no time. (Yes, I spelled that right)
    4. Lisa Lesperance and Patti Marino are still real good friends and probably will be for life.
    5. Norma Lindsey is a very nice lady and should be treated with the utmost respect.

  98. For the person who wrote the blog below, please keep in mind that this logic would make it impossible for Judge J. Scola to run without violating a Cannon. As well, Judge Pando and Mills-Francis can still be dealt with as the statute on this runs even 2 years after they leave the bench.

    Thus, show your passion as true and report them to the JQC or shut up.

    ELECTION OBSERVATIONS: Judge Patricia Marino Pedraza should be reminded even though it has only been a year since she won her election that all eyes and ears are around the Judges and especially the Judicial Candidates. If she continues to accompany Judge Norma Lindsey to multiple events she is a walking a fine line around the Cannons. I'm sure she wouldn't want her actions to be miscconstrued as endorsing a candidate. The mere appearance could be looked at disfavorly upon yourself and the friends you support. It should also go without saying that you should be even more careful of the words you speak and to whom you speak them to.

  99. From the gossip I hear, Marino Pedraza snubbed Lisa Lesperance at the League of Cities event and make some rude comment to Lisa in fromt of Lindsey. Guess Marino Pedraza was trying to score points with Lindsey! Just sucks because I heard that Lesperance was a great friend to her before and during the election. Marino should remain neutral and just tell Lindsey that she is not gonna get involved instead of being seen at so many events holding Lindsey's hand. But doesn't surprise me. Patti Marino Pedraza snubs all her old defense lawyer friends now. The bench has gone to her head for sure!!

  101. I have known Nushin for 12 or 13 years. While I suppose that passionate opinions about who becomes a judge are a good thing, you should reserve your considerably negative judgments here. Being a Circuit Court judge, especially in the criminal division, is not glamorous. It is grubby, difficult, sad, and sometimes overwhelming. We have enough gilded lilies, we have enough primadonnas in this city. Judge Sayfie is hard-working, organized, fair-minded, generous, brave and experienced. She will happily go to any division and fill any position without complaint. This is a judge who actually knows what the bridge looks like, has tried many cases, and has developed compassionate relationships with her clients. I am thrilled for her and you should be too. Very soon, she will be the division you will breathe a sigh of relief to enter, you will tell your clients, "don't worry -- you're in Judge Sayfie's court." You will not suffer ineptitude, erratic decision-making, arbitrary judgments that impact your clients' freedom, or so many of the other ills that you regularly expect. Justice in her court will be fair, rational, consistent and reasonable. Set aside your venom, open your mind and prepare to be impressed.
