ATONEMENT

Today (State) Courts in Miami are closed in observance of the Jewish holiday of Yom Kippur; The Day of Atonement. The Federal College of Cardinals are open for business.

The holy day is a time for atonement for sins; but according to the rules and tradition, atonement for sins by one person against another person cannot be made until one asks forgiveness.

I ask forgiveness.

For those of you who have been offended by words I have written, please forgive me. The intent of this blog was to amuse and to provide a place to generate thoughtful discussion of the issues that affect us.

I believe it was wrong to write about the criticism of Judge William Thomas when I had not seen it first hand. When I did see Judge Thomas in Court I realized I had made a grievous error. He has his own style for sure. But he is a good and hardworking Judge who clearly was called to this career by his desire to better his community. I truly regret the initial post (and no, I do not currently have any cases before him).

I also erred when I did not pay as much attention to the comments as I should have and missed several vicious comments about a Judicial candidate and allegations about his orientation. I am sorry that those comments were posted and I apologize.

I am sure there are many other mistakes I made, and for those who have been caused any pain or unwarranted discomfort by this blog please accept my apology.

I hope that as we approach the one year anniversary of this blog, that the readers will continue to contribute to interesting and humorous comments about our little world where so much happens.

I have tried to use the anonymity I have, responsibly, and endeavored to not use this blog for my own personal grievances or to take cheap shots at people for the fun of it (although so many of our robed readers present such a tempting and juicy target.)

I have tried to allow all comments to be posted, even those critical of me and this blog.
Overall, I think it was a very good first year.

    I am also sorry for just now insulting Jason's temper and paying homage to his prowess as a man's man--all at once.

    I am very, very sorry for insulting the PDs and questioning their abilities as defense attorneys. They work hard...sometimes. Sorry for that last one too.

    Do you think BB will let it slide? Or, do you think he will enlist his buddy KFR to uncover us all and prosecute my remorseless behind?

    Well, at least I can take comfort in knowing that the Miami-Dade ASAs are on that job...unless Abe (he could convict me of anything he choose-with or without evidence) or Gail (she would just plain scare me to death) are available, chances are I will beat the rap.

    Oh, Damn, sory for insinuating that the State Attorney's Office is overworked, underpaid and overstaffed by bafoons at the top. Forgive me please.

    Can somebody Jewish please explain how this forgiveness thing is supposed to work? I kind of prefer the Catholic methode of confession and penance.

    Sorry Jews for suggesting that our brand of forgiveness is complicated and difficult to understand (afterall, don't we not believe in heaven) - and, sorry Catholics for thinking that your brnad of forgiveness is easy.

  7. It works like this: on Yom Kippur Jews who fast and pray can atone for sins against G-d. For sins against another person, Jews still need to apologize. Rumpole got it right.
    Plus, on the night Yom Kippur begins, last night, Jews who were forced to make oaths they did not believe can be absolved of them. Sort of like a coerced confession, Kol Nidre is the ceremony of a people enslaved who were forced to make oaths they did not believe it. Overall, its a very positive experience, and if you are claustrophobic, you don't need to go into a little booth, so thats a plus.

  8. Talk about changing the subject... Who ARE these frantic Congresspeople? Aren't most of them lawyers?? And they're relying on police for legal advice?? Here's today's challenge: WHAT statutes, federal or Florida, has Mark Foley allegedly violated?? I'm putting my twenty years' experience on the line and declaring - NONE! (This bold declaration, made without all the facts, assumes no e-mail went to anyone younger than 16). If you can find one statute seemingly violated, please post the citation. Otherwise, I can only conclude that the real crime here is Republican family-values hypocrisy. I apologize for posting anonymously, but I don't apologize for volunteering to represent Mr. Foley!

    Using e-mail to entice a minor to commit a sexual act is a federal crime. Haven't read any of Foley's e-mails so I don't know if he broke the law or not, but that's what they're investigating.

  23. Seems to me under that law you gotta look to intent more than content. For example: if somebody posted an inticing message on the blog with explicit suggestions, but there is no intent, there is no crime. But, if somebody invited little Jhonny over for ice cream, and intended to fool around with him, then there is a crime.

  33. The new law of great significance that went into effect today is the end of close-close. Starting today the State will get the first close, then the defense and the State will close. Regardless of whether any evidence or testimony was submitted by the defense. Begin raising the legal challenges, arguing that the law is procedural and not substantive and as such the seperation of powers has been violated.

You provide a respected, reasoned and seasoned anaylsis that is needed to weed out the 'riff-raff'. (I know, I know, not an actual word, but it fits, right?)

BTW, speaking of Barzee...as a new comer to REG, I saw Dava Tunis walk into Smith & Wilensky's a/k/a Au Bon Pan sometime after 8:00am recently. Totally dressed for success but with a skirt that was a nice cut above, shall I say; for someone her height, she had bare, tanned legs that went on forever and an ankle braclet no less. Let's just keep it classy and say the reaction was there. We could be doing worse at REG. Can't wait for my first side-bar.

    From, Florida Elections Commission in Tallahassee and can confirm the following:

    Anthony Verdugo founder of that hate group "Christian Family Coalition" and "Take Back Miami Dade" individually and on behalf of his hate groups have NOT paid any of the $11-k fine from a Final default judgment issued against him in Feb 2006. According to the Election Commission Anthony Verdugo was served with the Final default judgment on Feb 27, 2006. He was sent a reminder to pay the $11-k on March 27, 2006 and a Final Warning letter on March 31, 2006.
    On April 11, 2006, the file was sent to the enforcement Attorney Eric Lipman, Esquire., to file the Final Judgment in Leon County against Anthony Verdugo and his hate groups, for the $11-K.
    We are told that once Attorney Lipman’s Paralegal Tracy Aulet at ext #109, prepares the papers for Leon County Circuit Court and the formal Judgment is filed with that court the election commission will then file a copy in the Miami-Dade County Court and seek to collect the $11-K through assets etc.

  43. 11:46 - I know that the AP & others are reporting that using e-mail to entice a minor is a federal crime, but most journalists are not lawyers. I spent all weekend trying to find this so-called crime. I asked for citations because I certainly can't find it. 18 USC 2422(b) says it's a crime to use e-mail (interstate facilities) to entice someone under 18 to do anything sexual for which anyone can be charged with a crime, but what crime can you charge someone with for having sex or soliciting non-commercial sex with a sixteen-year-old? Just because the newspaper says it's a crime doesn't make it so. Sorry for being so picky on the details, and I'm truly sorry if I'm mistaken. Someone please correct my misguided research.

We, of this blog, shall let Camacho Adrien know the law is the law and he can't change it. He has no clue. Judge Thomas was a State APD and a federal APD before getting on the bench. not so with Adrien. as a matter of fact, I don't really know where that man came from.   99. Hey 3:48 pm, your facts are incorrect and you are obviously not a federal pd. Migna was never asked to leave the federal pds office. Rather, she was offered a training position in the domestic violence division which is what she wanted to do, rather than try drug cases. When she resigned from the federal pds, Kathy offered Migna an appellate position so that she would stay, but Migna declined. Ask lawyers in the federal pds office. Instead of spreading false rumors (which were fabricated during the election), get your facts correct.
