ReplyDeleteNow we can analyze the results and when we do we find that, much to our surprise and absolute joy, the voters of Miami-Dade County did not vote strictly along ethnic lines and, across the board, elect hispanic candidates over anglo/african-american candidates.
Here are the numbers:
In the 16 contested elections, there are three run-offs and one race, Cohn v. Rippingille, that we have eliminated.
In the other 12 contested races where anglo/african-american candidates faced off against hispanic candidates, they won 7 of the 12 races, with hispanics taking the other five seats.
Those that are looking closely at those numbers, and smiling, ever so slightly, include 2008 candidates:
Barzee, Ward, Donner, Friedman, Fierro, Firtel, Trawick, Gordon, Dresnick, Farina, Prescott, Muir, Glick, Bagely, Zabel, Simons, Emas, Wilson, JB Cohen, Shapiro, Schumacher, Rosinek, Scola, Scola, Karlan, Sigler, Tunis, Eig, J. and Schwartz.

With 16 judicial seats up for election, and 35 candidates vying for them, two-thirds of the ballot in some precincts was devoted to the judges.
Late Tuesday night it was too early to call most of the judicial races. One race that appeared to be clear was the contest between County Judge Ana Maria Pando and Sari T. Addicott. With more than a third of the precincts reporting, Pando was a clear favorite.
Two circuit judges and nine county judges drew opposition this year. Misdemeanor criminal and smaller civil cases go to county court while circuit court judges hear felonies and larger civil cases.
In addition to those 11 races, 11 people are vying for four new judgeships created by the Legislature; two are running for a seat vacated by a retiring judge.
''I can't remember a time that there have been so many contested races in this county's judicial history,'' said Circuit Judge Scott Silverman, the unofficial historian of the county's courts. ``This is unquestionably a first.''
But how is a voter to know who will make a good judge?
It's actually hard to say.
Judges and judicial candidates are prohibited by Florida's canon of ethics from publicly discussing their views on anything they someday might have to rule on.
So the candidates campaign on their years of experience and their connections.
Some worry that opens up judicial races to ethnic politics.
''There are people who think because they have a Hispanic name, irrespective of their qualifications, they can win because of the demographic,'' said Ramon Abadin, a former president of the Cuban American Bar Association.
But he noted a Hispanic name alone hasn't worked for everyone. ''Some of those people who thought they could win because they had Hispanic names in contested races didn't [in 2004],'' he said.
Gerald Schwartz, a political consultant on local judicial campaigns for the past 50 years, said he thought Hispanics might not have voted in as high numbers as usual because of a combination of the rain and the lack of interesting races.
''I have a hunch that Hispanic voters would not turn out as heavily in inclement weather as they might have ordinarily because of the lack of Hispanic issues in the major races,'' he said, noting the governor's race hasn't inspired many of any ethnic background.
Many judicial campaign-watchers, Abadin and Schwartz included, were closely watching the race between County Judge Steve Leifman and attorney Juan F. Gonzalez. Leifman is widely regarded for his work for the mentally ill. Gonzalez is relatively unknown among attorneys.
Gonzalez had the lowest rating in the Dade County Bar Association poll, with 70 percent voting him unqualified to serve on the bench. Leifman had the highest rating in the same poll, with 74 percent voting him exceptionally qualified.
The Cuban American Bar Association poll results were similar in that race, with 73 percent rating Gonzalez unqualified, while 91 percent ranked Leifman qualified or exceptionally qualified.
Similarly, County Judge Bronwyn Miller was ranked qualified or exceptionally qualified by 90 percent of CABA members, while her challenger, George Alvarez, was ranked unqualified by 60 percent.
And Circuit Judge Dennis Murphy was deemed either qualified or exceptionally qualified by 91 percent of CABA members who voted versus 57 percent who voted his challenger, Josie Perez Velis, unqualified.
County Judge Ivan Hernandez, embroiled in a scandal involving allegations his assistant did campaign work on government time, was deemed unqualified by 57 percent of CABA members who voted. Only 15 percent found his challenger, Robin Faber, unqualified.
Early voting results suggested upsets were possible in several races, including the Hernandez-Faber contest. Hernandez trounced his challenger.
But absentee ballots, the next group to be counted, brought the numbers closer to a dead heat in that race, and completely turned around several other races.

Unless early voting accounts for at 75% of voting, or has customarily been an accurate barometer for predicting elections (which it has not), that is simply non-factual, sensationalistic reporting.

ReplyDeletePleae don't start any trouble. We have peace. I endorsed Faber (because it was the correct thing to do) and he won. I feel bad for Ivan. He was a decent guy who got caught up in events and did not get a handle on them. In the end, that did him in, and it reflected poorly on his ability as a Judge, so the electorate did the right thing. Can't same the same about McWhorter, and I have no opinion on Rippingille or Samuels, as I rarely or never appeared before them.

The judicial races are over(for the msot part).Now is the time we,should start a review of the selection/election process for the judiciary.

The Gorvernor should not have unbridled power to select the judiciary from a list of names submitted from a J.N.C.he had a hand in selecting.
To say the above are not political is to be foolish.But a hybrid plan,utilizing both would be appropriate perhaps.Some of the finest judges in Miami-Dade could not get appointed(i.e.Glick went to Governor over 15 times and finally was elected,not appointed).Yes,greater scrutiny is used and sometimes a better judge may be appointed,but to say this is not political is stupid.
Elections should be watched more closely.Spending limits should be set for candidates.Few know of judicial candidates and that includes sitting judges.Perhaps the J.N.C. can hold four or five open forums for the public during a campaign period,asking questions of the candidtaes so the public will have an oppurtunity to view and hear the candidates under
guidelines defined:instead of the false bravado and rhetoric spewed out during campigns.Oh yes,this may also provide the demise of the heavy handed,expensive publicist.The community has disdain for lawyers:what would the public say of the publicist.
When violations of the Election Laws or any law occur during a campaign,swift review and action should and must be taken.Action should not be a mere blurb on a blog,or slight admonishment by J.E.A.C.,J.N.C. or Dade County Bar.What good is a person being admonished five times or fifteen times and then taking the bench.Yes,we have had judges receive that many violations,founded following review and then taking the bench.Can you imagine,we allow people to lie and puff and mislead like car salesman,only to allow them to become sitting judges.
Now is the time for our legal community to do someting to change the process.It will not happen easily,because although we do not wish to acknowledge it,the rest of the State,the other sixty-six counties are out of sync with Miami-Dade(or is it the other way).
We can and should attempt to change the process for selection of the judiciary!

A report released by the Miami-Dade Election Reform Coalition said during the elections there were "serious problems with policies and procedures that are supposed to protect the integrity of the ballot."
In many precincts, the number of people who signed in to cast votes was not tracked carefully, or in some cases was not compared with the actual number of ballots cast at those precincts.
The group also said there was a touchscreen machine malfunction; when votes were tallied the results from one machine had been counted three times, creating a discrepancy of 171 votes that became part of the certified canvass, the group said.
"It slid right through and nobody caught it," said Martha Mahoney, a professor at University of Miami and a group member.
Fifteen of Florida's 67 counties used touchscreen machines, including most of the heavily populated ones.
Election officials welcomed the criticism and said the machine that gave a 3-for-1 tally has been sent for testing.

On the BRIGHT side the voters kept “Murphy's law.” I guess Rumpole the bull@#$% about Murphy running a weak campaign was just that bull@#$%. Now that I am on a roll, why would you (Rump) encourage another run by the imminently unqualified Ms. Gina Mendez. She may a nice person, and she may have run a slick campaign, but what about just saying the truth she is unqualified to sit on the Circuit Court. Remember that is the Court of General Jurisdiction in this great State and it is responsible for claims in controversy involving serious damages and the power to put a person to death or sentence someone to life. Call a Spade a Spade and stop all the$$ sucking its unseemly!! Let us as people who work in the law call for higher standards in our judicial candidates and appointees. I’m OUT!!!!

ReplyDelete9:37 has a point. The quality of the judiciary in Miami is abysmal. Why don't we call a spade a spade and admit that the only two judges we have had in Criminal Court in recent times who approximate scholars of the law are Judges Barzee and Emas? The level of legal ignorance displayed by the bench is not only embarrassing, but it undermines the integrity of the entire system.
ReplyDeleteIt's high time we did away the elected judiciary. It's equally high time we did away with the JNC/appointment sham. The judiciary should be professionalized and made into a meritocracy the way it is in much of continental Europe. Politics has no place in the judicial branch of government.

you would have heard her mention her job as a JA in passing as a factor relevant to balancing the time involved in transporting 2 kids to different schools.
she wasnt looking for any "perk" as you call it. nor did she misuse her position as a JA to her benefit.
her job as a sole assistant to an administrative judge is pertinient to her request. she mentioned it once.

or such enlighted enclaves as Massachusetts or New York.... People seem to be happy with mediocrity so long as the pictures on the ads look good. In reality how much do the voters know when they step in the booth to vote for judge? I for one concur on the Barzee and Emas comment by 10:22. Let us not worry so much about finding judges who stroke us on the heads like lap dogs, but let us focus on quality whether the judge rules for us or not. It is not about the judge laughing at your jokes jokes or backslapping. Maybe we could remember teh little signs above the bench about the search for truth and justice. Or are we just interested in having a nice day at the courthouse and some coffee at the Pickbarrel.

ReplyDeleteI agree that politics have no place in judiciary. But in this case we had a corrupt judge and needed him out. The JQC had this not been a election would have taken years to get him off the bench.

I am personally satisfied that Judge Leifman, Judge Miller and Judge Faber are more than qualified to be on the bench.
The removal of Judge Hernandez proves that the vote does work. If this was not a free society www.operationrestorejustice.com and its creator would have been jailed.
Because this is America Rumpole is allowed to keep his identity secret and promote FREE speech. The wannabe dictators wish Rumpole and McGillis could be jailed. Why they both had there disputes that what free speech is all about.
I think thats why the dictators or radical far right Americans never smile. Have a sense of humor and laugh. Rumpole created a blog which has spoken serious subjects but also some humor at the judiciary and through his popularity and this being a free society I beleive Rumpole has made this county's judiciary a better place.

ReplyDeleteLeifman's JA selling items out of Judge's Chambers to litigants and attorneys is unethical and illegal. I betcha that every lawyer that bought 2 perfumes would get preference when setting hearing dates or getting motions "taken care of" quickly.

ReplyDeletePlease explain why you think Robin Faber is going to make a good Judge? I know why Hernandez does not but do you really think Faber is any good or were you all just voting against Hernandez? My experience with Faber is that he thinks he is very smart and can actually be quite condescending in court against his opponents. He is a "rub it in your face" type of person. I hope he has grown up and changed a bit from the days he thought he was hell on wheels in Juvenile!
