We posted some comments from last night and have a few thoughts:
1) We thought the E mail from Mr.Carhart about Judge Rippingale was legit, but the ever vigilant Captain noted that her name was spelled wrong. It was one letter and could have easily been a typo.
2) An alert reader posted a nice article on immunity of bloggers from lawsuits, for those of you who care about such trivial matters.
3) A person who claims to be an employee of the South Dade Branch Court wrote in with a criticism of Judge Miller. It’s an opposing view to our endorsement and deserves to be considered.
4) At least one person does not like the Alan/Chris dialogue. We’re not sure what it’s all about but we won’t block it.

I'm not sure what I have, but I think it is terminal. I woke up at 2:30 this morning,,,,and the first thing that popped into my head was Rumpole. I am sick, very sick.
ReplyDeleterump, i saw some campaign posters for Ms. Davidson, running for Circuit. Her pic, chest up, looks as if she is wearing a black judicial robe. on closer (nose to the photo) inspection she is wearing a dark black dress with one black button in the middle.

ReplyDeleteI dont think Vic Wainstein is getting enough love on here. For those of you who don't know Vic (he practiced in Orlando and then Broward, and has only been down here about a year), he is a great guy and a great lawyer. FOr those of you who are trying to figure out who he is, he can best be described as the Shaquille O'Neal of Jewish lawyers. He is about 6'6" 265 lbs. He runs the show for Josh Fisher in Miami. Anyway, the case he tried was a deadly missile case where his client was suspected of shooting into a car. The State listed no gun expert. The gun was half falling apart, and the officer had stated in depo that the gun was in such bad shape that he was afraid it was going to misfire. Vic's client apparently also said that the gun had gone of accidentally. So on the day of trial, the State ups the charges to attempted first. They pick the jury, and Vic opens telling the Jury that the gun went off accidentally, and that his client was going to testify and tell them that, etc. They recess. The next day, the State files an amended witness list with a gun expert who is going to say that the gun did not or could not misfire. Vic is livid. No chance to hire his own expert. No chance to voir dire on experts, Already stated in opening that gun misfired and committed to his client testifying. Jimenez says no Richardson violation...get this...no prejudice to the defense! Vic pulls it out and walks his client. That is justice, at least of the poetic kind.
ReplyDeleteRE: Davidson campaign poster: I saw the same thing you did while driving in my Bentley today and had the exact same thought you did. I told my driver "driver driver..pull over" but the klutz was going to fast. Anyway, maybe there is a FEC complaint heading her way.

This is the sort of crap I deal with all the time. Man, the victories are so rare and so temporary and so fleeting, why not celebrate them?

Re Victor Weinstein's win: In the State's case in chief, the gun expert was only allowed to testify that he test-fired the gun and it successfully fired a round. The expert could not say that the gun could not have fired accidentally or how many pounds of pressure were needed to pull the trigger because he never tested the gun for that. After the defendant testified, the State called the gun expert in rebuttal and his testimony helped the defense.
