THE RUMPOLE UNABRIDGED DICTIONARY

Today's definition is:

Swartz; (swore-ts)
noun- Person, former judge;
Latin: judicious desperatous;
adj: To Swartz.1) to file for election against an incumbent who is about to be promoted, thus securing for yourself the elected position un-contested.

Word reaches us that the Florida Election Commission on February 24 of this year fined former County Court Judge Jeffrey Swartz over $9,000.00 gavels for failing to file campaign treasurer reports on four separate occasions.

Here is what we think: are there any attorneys out there who were recipients of a lecture from Judge Swartz because they didn’t file motions timely, and were lectured on the proper way to do things?

Its not so easy when the shoe is on the other foot is it?

A Judge is empowered to decide whether a person violated the law. Shouldn’t the judge have the common sense to follow the law?

Election finance reporting requirements are not suggestions.
The reporting requirements are the law in Florida.
Go over to those strange orange and black colored books on your bookshelf entitled “Florida Statues, cut off the cellophane, open Chapter 106, pour yourself a large cup of coffee, and read.

In this day and age the citizens and legislature demand judges who have little tolerance for people who do not follow the law. (until one of them is charged with a crime, but that’s a topic for another day).

Rumpole has little tolerance for judges who cannot follow the law.

  2. Magistrate Klein needs our good thoughts and positive energy. The good thing is he is in great shape and ran with his friends every morning for 15 years. His cardiovascular system should be very strong.
    But, he is sick- the diagnosis- unknown. Is there some weird mold or disease at the old fed. courthouse?? Seems really strange that he got sick out of nowhere. Perfectly healthy runner, skier, hiker one day and then in ICU really sick the next?
    Magistrate Klein we are rooting for you!!!!

  3. Can you post something about Magistrate Klein that is NOT in the same story as Swartz, Del Pino, Jacobi or any other ------- ????. It is shameful to mention his illness in a footnote to the trashy stories about these candidates.
    He REALLY deserves better. He REALLY deserves his own posting. Forty years as a great lawyer, teacher and judge in Miami- don't you think.
    Is it that difficult??

  8. Gina has a lot of signs that nobody notices. She will not be able to compete against his money in the last month and he will drown her out. Good thing too. She's a Leslie Rothenberg waiting to happen. Larry has his moments but she would be a nightmare.

    Larry Schwartz (incumbent) and Gina Mendez (challenger) are both former prosecutors. But Gina gets the endorsement of the League of Prosecutors. What does that tell you? GO Gina!

  18. To the friend of Magistrate Klein who keeps getting offended by our posts: 1) We do not want to make a big deal of his illness and turn it into a fulfilling prophecy. We just want to let people know he is ill so they can send positive thoughts.

    2) This is Miami. This is the Miami legal community. Look around. Do you see Mother Teresa or her kind next to you in court? This is a nest of thieves and a den of vipers. it is virtually impossible to have a blog about the legal community and not mention objectionable people. We thought we put it pretty good when we said Ted Klein was the rare lawyer who when he walked into a courtroom was liked and respected by everyone. We stand by those words. But unless we devote a whole post to him, just about any other member of our little cesspool will carry some negative connotation.

  19. THE CAPTAIN REPORTS:

    A very sad case is coming to an end at the REGJB this week. In February of 2005, 22 year veteran attorney Knovack Jones was arrested and charged with Grand Theft in the First Degree and Forgery.

    For the State: Gail Levine
    For the Defense: Larry Handfield
    Judge: John Schlesinger

    Ms. Novack Jones entered into a disciplinary resignation with The Florida Bar on September 30, 2004 (tantamount to disbarment) as the result of an alleged misuse of trust funds.

    Ms. Jones practiced law in Florida since 1983, was a certified family court mediator and an original member of the Miami Dade Commission on Ethics and Public Trust (I am not kidding).!!!

    She was accused of misappropriating over $370,000. Apparently, she was representing a family in Probate Court, had that money in Trust as part of an Estate, and was supposed to hold that money until the Estate work was complete. She should have then distributed the money to the client (three family members of the deceased).

    Instead, she was caught up in a Nigerian investment scam, and wired all the money to Nigeria.

    She has been convicted and faces sentencing this week before Judge Schlesinger. The Judge must decide whether to send Ms. Jones to prison!!!

    The Captain remembers being told early on in their career that, just about the only way to a quick disbarrment in Florida, is the mishandling of Trust Acct. money.

    Final sentencing is set for Thursday afternoon.

  20. This goes to show you that good 'ole Jeffery is a legend in his own mind and all around ass. Maybe he should practice what he could preach when he was on the bench. Care to take a guess of what the odds are he will ever get elected or appointed to the bench again?

  21. Those who believe Gina will be a pro-state judge need to put the crack pipe down before they start typing. Gina will be fair and professional...something Larry can never be.

    If people vote for Larry because he is the "known" quantity then they should begin using their minds. Just because we know the devil doesn't mean we should overlook the fact that the devil is the devil.

    Gina has my vote!

  22. Well written and a very sad case indeed Captain. Knovack Jones was I believe a former ASA and a former city attorney or attorney for the police. Very Sad and we would not want to be in Judge Schlessinger's shoes on this one.

  30. I don't know how someone who has been an effective defense attorney for numerous years can be construed as being pro-state and a front for the police. Clearly, the person who wrote that comment about Gina Mendez either needs to up their dosage or change their medication.

    If you want to see pro-state, endure a daily tirade by General Schwartz regading how the State should be treated more fairly by the defense. Barf
