Looks like Sanchez-Gronlier will be cross-appealing to both the Hispanic as well as the French voters.

I've only been in practice for 6 years and I wouldn't think of running for judge although it would double my salary. Could someone 'qualified', ie, experience with jury trials etc, (things that you write about Jason, captain, rump, et al.) tell me why you aren't running for judge? When I've been around for 15 years will I be making so much $ that I won't want to lower my pay? or will I be jaded by that point? or be 'too good' to be a judge? It seems like a good job. Why don't more qualified people run?

ReplyDeleteAs to the comments under yesterday's post and Gina Mendez: 1) I do not dislike her. Many years ago I tried a case against her (that settled in the middle) and I felt she was very fair and competent.
2) I am not sure, but I think I voted for her last time against Murphy because I did not know Murphy and I have a long standing belief that ex-prosecutors generally make the best judges. Of course, I will now be voting for Murphy as I think he is a great Judge.
3) I have no idea who Rumpole will be endorsing and I wish people would get back to accusing Rick Freedman of being Rumpole.
4) I am not a candidiate for judge. if nominated, I will not run. If elected I will not serve. My ambitions are westward, not upward.

I am sick and tired of five-year wonders running for judge.
It bothers me that someone with no experience, life, or legal can win a judgeship.
It irks me when people for whom I am required by law to stand upon their entry don’t know the law, the rules of evidence, the rules of criminal procedure, or what it is like to battle before a Jury.
It offends me when lawyers who are incapable of earning a decent living see a Judgeship as an easy way to a pay raise and a 20-hour workweek.
It is sobering to think that these same people have the power to sentence a Human being to the statutory maximum upon any conviction, tear families apart, issue warrants to search peoples homes, warrants to arrest, and impose the death penalty.
I am unable to comprehend the hubris of a person in their early thirties five years out of law school who aspires to hold such power.
We are talking about Peoples lives.

TALLAHASSEE FL - Political consultant Bob Levy nervously checked the clock at 11:50 a.m. Friday in the state's division of elections.
He had 10 minutes to advise his client, judicial candidate Judy Rubenstein, to switch to a different Miami-Dade County Court race now that a Hispanic candidate had qualified to run against her and incumbent Judge Jeffrey Swartz.
Levy said Rubenstein and Swartz would split the Jewish vote and that candidate Ada Pozo Revilla would win in November because Hispanic voters would probably flood the polls.
As the noon qualifying deadline loomed, Levy called Rubenstein at the Miami-Dade County elections office to switch and challenge newcomer Valerie Manno for another county court seat.
Thus, the Byzantine politics of Miami-Dade judicial elections played out Friday, as a few insiders such as Levy analyzed ethnic surnames, campaign contributions and last-minute opportunities in 32 county and state circuit court races.
''It's a little nerve-racking,'' Levy said.
``But it's a lot of fun.''
It's not always enjoyable for the candidates.
At the Miami-Dade elections office, Rubenstein told Manno that she didn't mean to change her mind just before the noon deadline.
Campaign's Strength
Rubenstein told The Herald that she and Levy made the decision based on the strength of Pozo Revilla's campaign, her ethnicity and fundraising ability.
For similar reasons, Rubenstein also declined to run against Haitian-American incumbent Fred Seraphin.
''It was not just an ethnic issue,'' said Rubenstein, legal counsel for the Miami-Dade Police Department.
''Running against [Manno] was not my first choice, but that open seat was the obvious place for me to go,'' she added.
Had Rubenstein stayed put, Manno would have been elected Friday because she was the only candidate in that race.
The incumbent, Raphael Steinhardt, did not seek reelection.
Racial Dominoes
The contest's racial dominoes began falling last week when Pozo Revilla, a former assistant public defender, targeted the Rubenstein-Swartz race rather than challenge Circuit Judge William Johnson. He's black and an incumbent.
Unless opponents have political dirt at the ready, sitting judges are virtually impossible to beat in Miami-Dade because they have status, name recognition and money -- invaluable advantages in a vast, complex county.
Sixteen circuit judges and 10 county judges drew no challengers Friday and won. That left four contested circuit court and two county court races in the Aug. 31 election -- a lineup shaped by the retirement of three judges. Runoffs will be held Nov. 2.
On Friday, some candidates, supporters and consultants made the traditional pilgrimages to the county elections office in West Miami-Dade or the state elections division in Tallahassee.
Last-minute Move
William L. Thomas was among them. An African American, he points out he's in a circuit race against an Anglo, a Cuban and a Jew. Thomas, who paid his $5,300 qualifying fee at 9:30 a.m., stuck around the elections office until the deadline only to see Catherine B. Parks qualify at 11:59 a.m. Cameras whirred and reporters started asking Parks why she waited so long.
Thomas, an assistant federal public defender, jumped in with a smile and an answer: ``So she can get on television.''

On Friday, circuit judge candidate Peter Adrien decided to earn some name recognition on the cheap. He gave himself a new middle name: ``Camacho.''
Formal Name
Adrien, a lawyer for the Dade County Legal Aid Society, ran under his formal name in a bid for the circuit court in 2000.
Back then, he was Peter Sylvester Adrien.
Now he's going by Peter ''Camacho'' Adrien. He said he chose to use his mother's Portuguese maiden name, Camacho, because he felt voters were confused by his middle name, Sylvester, in the previous election.
'I'm running on my credentials, not on the name `Camacho,' '' said Adrien, who is originally from Antigua.
Schwartz, who represents Circuit Judge Henry H. Harnage, said Adrien is trying to mislead voters into believing he's Hispanic. ''If I run for office as Gerry ``Camacho'' Schwartz, people are going to get a different idea about me,'' he said

unfortunately all us lawyers pontificating about who will be an acceptable judge is an exercise in futility. our little voices in the regjb make up about 6.5% of the electorate who will be deciding who we will practice in front of. the rest of the voters predictably make their decisions based on name, suspected race, religion, where your name is on the list, etc. there must be a better way. do you really believe Rose Steinberg in aventura knows the difference between larry schwartz or gina mendez? she's going for the jew. God bless her. this system is what gives us judges like postman, adrien, etc and the only one that really suffers (other then a lawyer's ego)is joe defendant or sarah victim because some bombastic judge denies them justice.

ReplyDeleteTo the many people that want to libel Judge Hernandez saying he has a JQC investigation, please call the JQC and check that there is none! Stop being stupid and tell the truth, you just hate the fact that this man does not kiss ass like the rest of the Judges or that he is not care to save the establishment. Like the Herald, unhappy that minorities (excluding blacks) get on the bench. What about 20-30 years ago when Hispanics tried to run and get elected? No one seem to be upset about the fact that everyone voted for Smith, Schwartz, Goldstein, etc. and not Diaz, Hernandez, Alvarez and so forth. The Anglo majority back then had signs that stated: “No Shirt, No Shoes, No Cubans” and “Go Back to Where you Came From!” Did you all forget about that? Look at those who are making the big bucks on the campaigns by scaring candidates or the candidates who took the time to scare their opponents off or at least try. It is no secret that Steve Milan is being harassed for being Catholic by this Blog. That Armanteros was contacted repeatedly by Judges and Lawyers and threatened. Alvarez was harassed by Hector Lombana and promised many things to run at a different seat that he now sued to make it an appointed one. Hernandez is being smeared in an effort to get him bad press, regardless of the fact there is no evidence against the man. That Gonzalez has had his personal file abused by the Administrative Judges, regardless of it being personal. That Gloria Gonzalez was visited by her Judge opponent at her office and asked for her to be fired. That Gina received a threatening phone call. That Shelly is being black mailed by his own colleagues. Poor Rippingaile is being attacked by her own colleagues as well. That Jacobi and Pino are hated because many of the Blog readers are simply jealous that these two wonderful lawyers are following their dreams. As Charlie Crist, I stand by the hardworking Hispanics who will and are taking the bull by the horns and will in less than 10 years own the majority of the Judicial Seats of the 11th and there is nothing you can do about it! What began as a wonderful career ended on a sad note for former attorney Knovack Jones, on Thursday, in courtroom 2-8 before Judge Schlesinger.
As I wrote about earlier this week, Jones pled guilty to Grand Theft and Forgery after stealing over $368,000 from her clients while handling a Probate case for them.
Late Thursday afternoon, the Judge sentenced Jones to 5 years in prison followed by 20 years of Probation. 240 months to pay back the money.

Ans while I don't normally comment - just report the facts - there seems to be a misconception that - because she was scammed - that somehow made her less culpable for the crime.
The fact is, the Nigerian scam is irrelevant to the crime.
She stole $360K from her clients. It was her clients money, not hers. She had no right to touch that money - for any reason. It was in a Trust Account.
There just simply is no excuse for what she did.
I have no comment on the amount of jail time she received. That is a difficult decision - one that Judge Schlesinger must have struggled with. But he obviuosly felt strongly that, becuse she is an attorney and she is expected to carry herself in a professional manner, he held her to a higher standard - and maybe he should have - and he slammed her with 5 years in prison.
It is a very clear message to ALL attorneys. Don't mess with the Trust Account - it is the first way to disbarrment and now also
- a quick ticket to the pokey.

I was in law enforcement and I know this organization and it has NOTHING TO DO WITH D'ARCE. The judicial candidates were asked to submit questionaires and from what I hear a lot of the current judges blew it off. These candidates attended an event for endorsements purposes so let's not crucify them. Just because they endorsed Hernandez, don't assume that Juan D'Arce is involved. If that's true, then all the people the PBA endorsed are working for D'Arce too because Hernandez got endorsed by the PBA! So let's stop this crap

You might want to read them some time. I guess Ivan never did either, or you would both understand that you give up some of your rights by accepting the mantle of the judiciary and agreeing to be bound by a higher standard of ethical conduct.
