CHH CHH CHANGES

This is a good fact to ponder throughout the day:

The Captain writes:

Next time The Captain will refrain from metaphoring with references to skud missles and the Middle East. It looks like I turned the REGJB blog into the Middle East Conflict Blog.
Let's get back to the good stuff like the upcoming elections and the Indictment of a Judge (that is Indictment on this Blog).

In less than 7 weeks, the voters of Dade County will be faced with contested races in:

Circuit Court:Group 25, 42, 78, 79, 80

County Court:Group 1, 4, 9, 10, 11, 12, 14, 27, 39, 40, 43

That means we could be looking at as many as 16 new judges in our County come January of 2007.
Let the voter beware!!!!!

AND THE CAPTAIN HAS SPOKEN .....

Rumpole wonders how many members of the judiciary are getting less sleep than the Captain(who posted after 1AM) and Rumpole (who posted before 6 AM)?

PS: Congratulations to Judge Rob Pinero. Successful prosecutor. County Court Judge. Respected Circuit Court Judge. But you've never really made it in this town until your thoughts on sentencing are posted on everyone's favorite federal blog. Welcome to the big time Judge Pinero!

    I admit it. It's a sick joke. But it's a kind of metaphor for the madness taking place in the Middle East today.

    If it wasn't all a matter of life and death, it would be humorous. If it wasn't all a matter of preventing another holocaust, it would be laughable. If it wasn't all a matter of preserving Western Civilization from perhaps its gravest threat, it would be a laugh riot.

  2. All judges have their own agenda (pro-state, pro-defense, etc.), some are easy to work with and others more difficult. The good ones had experience in the courtroom before they took the bench and honored the legal system rather than embarrassed it. In the races where we have incumbents to measure, the winners ought to be:

    Circuit races:
    SCHWARTZ (Larry) - He is qualified. His opponent is too but he doesn't merit replacement.
    MURPHY - He is qualified. His opponent is too but he doesn't merit replacement.

    County races:
    McWHORTER - She is qualified. Her opponent panders to the latin vote with her name change and lacks experience.
    FABER - He is qualified. His opponent is poorly rated by lawyers, has problems with the JQC and has not proven worthy of re-election.
    ADDICOTT - She is qualified. Her opponent is poorly rated by lawyers, has ethical lapses of her own and has not proven worthy of re-election.
    MILAN - He is qualified. His opponent is poorly rated by lawyers, has not proven worthy of re-election and is blatantly playing the race as a victim card to retain her seat.
    LEIFMAN - The most highly-rated judge on the bench and extremely qualified. His opponent is not in any way qualified.
    SAMUELS - He is qualified. His opponent is not.
    SCHWARTZ (Shelley) - He is qualified. His opponent is too but he doesn't merit replacement.
    MILLER - She is qualified. Her opponent is not.
    RIPPINGILLE - She is qualified. Her opponent is too but she doesn't merit replacement.

  5. c'mon hernandez is a vet and for this reason he should be re-elected. Who cares if he allows his JA to campaign from his office to undeat other judges. He is still a VET. Who cares if you cannot get a hearing before him after you have pissed off his JA. He is still a VET. Who cares if the JQC is investigating him. He is still a VET.

  14. Being a vet is about the last thing that qualifies someone for the judiciary. Soldiers don't question authority, they blindly follow it. A judge, particularly on the County bench, needs a critical eye to judge the testimony of police officers and witnesses. By the measure of Hernandez' ethical lapses, seems he forgot about those principles he was fighting for when he donned his robes. The man is not a good judge and his vet background doesn't make him worthy of re-election.

  17. Migna Sanchez-Lorens and Bonnie Rippingille are both qualified. They have paid their dues, tried cases and have the experience for serious consideration. We can debate whether they are better candidates than their opponents, but that is a different debate.

  18. Hernandez is not under investigation by the JQC, there is nothing in the canons that prevents a Judicial Assistant from working on campaigns, thus how would he be in violation of anything?

    Leifman feared Juan D was working on Juan Gonzalez's campaign and tried to attack Hernandez's JA to put pressure on Gonzalez to drop out.

    Hernandez is not being investigated as there is nothing he could be investigated for.

    Ivan is a respectable Judge who meets Rumpole's criteria for endorsement. I am going to vote for him.

  20. Third DCA (aka Third PCA) could give a damm about telling people why they will lose the case. Now with Rithenberg on the Third DCA (aka Third PCA) all hope for PCA's to be gone is lost. Although with rothenberg you may get a 50 page opinion here and there but you will not find a legal basis for her argument.

  22. Gina Mendez should get serious consideration Rumper. Everyone and I mean everyone that I speak with says that Schwartz is the terrible. Mendez might be married to a guy who is a little frightening but can we blame a nice woman for wedding a (sb)? It happens everyday. She distingished herself as a prosecutor and proved as a defense attorney, that she is not afraid to try difficult cases. That sounds like a balanced trial atty to me who would be an asset to our bench. Plus, she is a very nice person who comes from an outstanding family.

  26. i guess if you served in the armed forces, you are inherently qualified to be a judge. i, too, see the correlation between selfless service to your country and the ability to interpret the law. the leap should also be made to appointments like the surgeon general; if you are a vet, you are inherently qualififed to make major medical opinions.

  42. I like the Middle East discussions - they're a good metaphor for the justice building and all the goings on inside. It's all a big grinding, never ending wheel, a trial of sorts, that will always end in a hung jury, to be retried again and again, with everyone claiming the moral highground. These discussions about which judge is best is like voting for a US president thinking that he can ever make a difference over there. Judge Murphy is a great judge, but he presides over only one courtroom. Bill Clinton had Arafat and the former PM shaking hands on the South lawn. I read today's paper, and I wonder whether that actually took place or I'm just dreaming. PD's blame prosecutors, Israeli's blame Arabs, vice versa all around, and nobody gives an inch, ever. If everything weren't sufficiently summed up by a metaphorical effort to grab or keep more land, we would all live in a happier world; not lobbing insults or bombs at each other. Nobody has a unique claim to land in the middle east, and nobody has a monopoly on truth in the justice building. We just work there.

  60. LATEST COUNT IN BROWARD:

    It's now 24 candidates for the six open seats - and still three hours of qualifying time left on Friday.

    Both Circuit Court races have three candidates each that have qualified.

    Interesting note: Dade APD Michele Towbin qualified today - but added her married name and is now running as Michele Towbin Singer.

    Also, County Court candidate Arlene Simon became ArlenE Simon Campione.

    and for all you Terri-Ann Miller fans, she has qualified to run in Group 32.

Hey, if those criteria were to be met to become a judge, 20 jury trials, 10 years experience, and proficiency of the English language, where would that leave 50 percent of our newly elected judges. Thomas, AKA Tomas, I don't believe has more than 8 or 9 trials. Adrien, AKA Camacho, has never stood in front of a jury and English is not his forte. Who else can I pick on this beautiful afternoon? There is no reason we must continue to elect judges, (statutes and amendments not-withstanding); they can be appointed after first being vetted by some reasonable non-political process. Or we can raise the prerequisites to become a judge so that if voters choose to elect a Judge by flipping a coin all the available choices are qualified. (Sort of a tipsy coachman rule for elections). Do you really think it’s a good Idea to elect people to preside over Jury trials if they have never been in one? Do you think it benefits anyone to have a judge who doesn’t know what he or she is doing in a courtroom? Do you think it is healthy for our democracy to allow uninformed voters pick our Judges by playing the name game, or rock, scissors, paper? You are an Idiot.     McWhorter, Leifman, Gonzalez, Slom, and Cohn are bad examples.

    Does anyone really think a 5-8 year lawyer is "qualified" (other that statutorily) to be a judge?

    When you were in law school, did you envision people like juan gonzalez as judges?

    Do we want experienced practitioners to run and seek appointment, or just people with names that will register with unknowing old ladies?

    Are the non cuban judges bad? And are all the cuban judges the best?

    Should we get rid of leifman because the ticket lawyers are mad at him?

    Should we elect Cathy Parks because she is a nurse?

    Should we defend Juan DArce's right to use judicial elections not to place qualified candidates, but to seek revenge?

    Yes, this is a democracy, but shouldnt we be responsible about it?

  89. Funny but, Judge Ed Newman started out real slow but, lately has become a rather good judge.

    Maybe the rule should be:

    To be a judge you must:

    a. Be a reasonable person.
    b. Have practiced law on an active basis for at least 10 years.
    c. The judgeship must be a cut in pay.
    d. Must have tried at least 50 cases.
    e. Must be nice and not be a jerk.

  90. 15 years, or the judicial pay must not be more than 30% of what you make now. So if its 130 grand - then you have to make at least 100 to be considered for appointment or to run.

    This saves the 15 year asa's and pds who are making like 70

  99. Yes, an inexperienced lawyer can eventually make a good judge. But, that misses the point. It takes years and a judgeship should not be a learn as you go job. Remember that judges can cause substantial damage to the community and people's lives during the "learning process."

    I doubt it would make any of the victims or defendants who got screwed by a crappy judge who didn't know what he or she was doing feel any better if they learned that the judge later achieved competency.

    In 2006, Judge Ivan Hernandez a South Florida County Court Judge decided to ignore his duty to promote public confidence by continuing to employ his Judicial Assistant after the Judge's office was raided by the Miami-Dade State Attorney's office under a criminal subpoena. Judge Hernandez court house computer was seized in early March 2006, as part of the Miami-Dade State Attorneys Office public corruption criminal investigation against the Judge and his Judicial assistant.

    The Judge's right hand and judicial assistant also made several anti-Semitic slurs against highly respected administrative Judge Steve Leifman, because the administrative Judge had informed Judge Ivan Hernandez that he was getting numerous upon numerous complaints from litigants about the judicial assistants rudeness and obstruction of access to the court.

    Judge Ivan Hernandez who is fortunately up for re-election this year will be facing opposition for his judicial seat. O.R.J. urges all who vote this year to restore justice and remove Judge Ivan Hernandez by voting for highly respected Attorney Robin W. Faber.




    In addition to the criminal investigation Judge Ivan Hernandez, recently had a "show cause order" (writ of mandamus) issued against him by the Third District Court of Appeal, after his judicial assistant Juan D'Arce was rude and repeatedly denied a litigant access to his Court. Slom (the Administrative Judge overseeing Judge Hernandez), tells the Miami Herald on May 30, 2006, that he has received numerous upon numerous complaints about Juan D'Arce being rude, insensitive and obstructing the access of litigants to the Court.     Operation Restore Justice is geared toward exposing corruption in the Florida Court system. The web site is here to expose the very rare cases in which a Judge or those under the Judge's control violate the publics trust.

    The Supreme Court of Florida has set a path of rooting out judicial wrong doing at all levels. The Supreme Court has released numerous opinions over the past few years making it clear to the general public that it will not tolerate violations of the code of judicial conduct either by a sitting judge or a candidate for judge. Recently the Supreme Court of Florida removed a judge from office because of violations of the code of judicial conduct that happened during his judicial campaign to become a Florida Judge.

    All citizens of Florida can be sure that our highest court will NOT tolerate violations of the Code of Judicial conduct at any level. Our supreme court is not shy in expressing its condemnation of any Judge who violates the public trust by not following the code of judicial conduct.

    Operation Restore Justice is under the control of a private citizen. It was due to the criminal investigation presently against Judge Ivan Hernandez and his Judicial Assistant, by the Miami-Dade State Attorneys office which has resulted in the seizure of the Judges computer under a criminal subpoena, that Operation Restore Justice was born in early 2006. In addition to complaints from numerous litigants of being denied access to Judge Hernandez court and Racial slurs by his Judicial Assistant against the administrative Judge.

    Florida has some of the best Judges in the world. We cannot let a handful of bad apples destroy the prestige of Florida's judicial system. The Supreme Court of Florida through its recent opinions has demonstrated that it will NOT tolerate judges who do not follow the code of judicial conduct.
