BANNED BY BRUMMER




WELCOME TO THE OFFICE OF THE DADE PUBLIC DEFENDER:
They defend the worst this community has to offer.
Accused of murder, sexual assault, child abuse, clients march into the Dade County Public Defenders office confident that they will be treated with respect and dignity.

All are welcome, and the young and dedicated attorneys who staff that offfice have taken oaths to defend their clients to the best of their ability.

Yes, all of society’s downtrodden and outcast are welcome and provided succor and assistance when they trod through the doors at 1320 NW 14th Street.

But for a certain exclusive club of lawyers, ex-employees of Bennett Brummer, it’s a different story.

You see, these lawyers are

BANNED
from the Law Offices Of Bennett Brummer, the elected Dade County Public Defender.

Like a bloated and corrupt ruler of the apprachik that one would expect to find in the former Soviet Union and not Miami, Brummer comes down hard on all who dare oppose his thirty plus year reign.

The "terrible two" PD's who ran against Brummer in the last election (Gabe Martin and Lonnie Richardson) are rumored to be banned.


So too is the elegant Lynn Overmann, who is such a good lawyer that earlier this year she managed not only to have charges against her client dismissed, but the officer who arrested him arrested himself for perjury.

"Country” Dave Pettus is rumored to have a restraining order against him.

What in the name of Nixonian Paranoia is going on at 1320 NW 14th Street?
Engage in some perceived slight against the Czar of 14th Street, and out you go!

Why would anyone care about being banned from the PD’s office?


The office is used by criminal defense attorneys to take depositions of prosecution witnesses in criminal cases. In many cases where multiple defendants are accused of a crime in the same case, the Public Defenders office has the responsibility to schedule depositions and coordinate the schedules of the attorneys working on the case.

But when you are part of the few, the proud, the banned, no depositions for you.


You are reduced to being turned away at the door and the whole lot – attorneys, court reporters, and witnesses have to trudge in the summer heat around the corner with their tails between their legs to the State Attorneys Office and hold out their hands and beg like the orphaned attorneys they are:
”Please sir may I have a depo room?”

Moral Of the Story:
You can be accused of any crime, and no matter how horrid the accusations, Bennett Brummer and his lawyers are there to help.


Just don’t insult the grand poobah of the poor; the Czar of 14th Street; the big kahunna of indigent defense.

Because if you do, you are tried, convicted, and banned.

All without benefit of Judge or Jury (or even the Public Defenders)

    The Dade County Bar Assc. Judicial Poll was mailed recently and should be arriving in your offices no later than Monday. The deadline for returning the Poll is August 14, 2006.

    With so many contested races, this Poll becomes a very important tool for the candidates to use in their campaign literature.

  37. People who assume those positions of authority and power have an obligation to ensure that they uphold the high standards that we expect. The Public Defender fights for everyman defending the rights we all expect to enjoy. A Judge protects those rights by ensuring that decisions are made solely on the basis of the law and facts, and not by reason of politics or business. Not only should breaches of the public trust be trumpeted, we should applaud them and condemn those public officials that betray our trust. Can't say it loud enough if you ask me. And we must encourage people to vote for their opponents.

The reality is that Lonnie was banned b/c he was fired after taunting BHB in public at the MLK parade in "04. Lynn was banned b/c she supposedly misused office equipment during the campaign. And Dave was banned b/c he was so arrogant and disrespectful of all the authorites over there.

    Fact is that you were all losers - even before you lost the election. Just ask some of the privates who've had to take your cases and clean up your messes. Sad then, even worse now. I know it's difficult to find something to do since you can't get clients but reverting to bashing your former boss is pathetic.

His point (which I think was well done and funny) was that how can the PD be afraid of these lawyers to the extent they are BANNED and yet not be afraid of the denizens of criminals that frequent their office. I can make a logical and coherent argument that Rumpole is right and Bennett looks poorly when held up to the light of reason and intelligence. (smack smack, chomp chomp)

    1)RUMPOLE is banned from the 14th street PD Complex. Because there is a controversy, Milt Hersch, Rick Freedman, Phil Reisenstein, are all banned until one of them is proven to be RUMPOLE.
    2) ANY AND EVERY PD who reads this blog is FIRED AND BANNED.
    3) Judge Will Thomas is BANNED from my Kingdom because he's an ex-PD and acts like a putz on the bench.

  57. Rumpole - please ask this august (pronounced awe-gust) body if they can clarify the set up of the CABA judicial poll.

    It asks whether the judges are exceptionally qualified, qualified, or unqualified.

    It then asks "Does the Judge/Candidate treat Hispanics fairly and equitably as well as demonstrate a responsiveness to their needs?"

    I have several questions:

    1. How do we determine whether a Judicial candidate treats hispanics fairly and equitably?

    2. What is considered unfair and not equitable when dealing with hispanics?

    3. What does it mean to be "responsive to their needs?" I thought they needed Justice?

    I have been a member of the Florida Bar since 1965, having graduated from the University of Miami Law School. I have dedicated my life to public service.

    I began by working in the Peace Corp for two years serving in Venezuela. I then worked for the Legal Services of Greater Miami. I joined the Public Defender's Office in 1971 working in the Appellate Division. I went on to become the Chief of that division and later to Executive Assistant to the Public Defender. In 1976, I was elected Dade County's Public Defender and have held that job for nearly 30 years.

    I run an office that employs over 400 people including nearly 200 lawyers. We handle over 90,000 cases each year.

    I have started an Anti-Violence Initiative, Community Involvement and Partnerships Program and an International Cooperation Project, among other accomplishments.

    I am proud to say that more than 40 attorneys from this office have gone on to become judges.

    Sure I have made some mistakes and I am sorry for those. But overall, I am extremely proud of my career and to my dedication to the citizens of Miami Dade County.

    This blog has disbursed much hatred toward me and some of the employees of my office. You certainly have that right, the First Amendment provides that to you. But at least give this office credit for the hard work of its dedicated team.

    And finally, to set the record straight, this is a public office and there is noone "banned" from this office.

    this blog is a disgrace to the profession and a slap in the face to the rules that regulate professional conduct.

    if I was running the florida bar I would have this blog shut down by order of the supreme court of florida because it is operated by a member of the bar who is in violation of at least 2 dozen rules. He rumpole should be disbarred and then he can continue he child like blog.

  97. I am an ASA. As such, I do not work for BHB; I work for the lovely KFR. That being said, it is clear that the PD's office here in Miami is far better than those in most other large cities. The Miami PD's office hires (with a few expceptions) bright capable lawyers, many of whom have graduated from the best law schools in the country. The Miami PD's office provides extensive training to these young lawyers. The Miami PD's office succeeds in retaining their lawyers for an average of several (as opposed to a few) years. As much as it pains me to admit this, these are all things that the Miami SAO has not been so good at doing. Does BHB get none of the credit for all of this? Is the obvious quality of the lawyers in his office just an accident of fate? I think not.

    As for Gabe and Lonnie, et al--what a joke. I practiced against both of them. Gabe was at most an average lawyer (which translates into a below-average PD). Lonnie, on the other hand, was truly horrible. Didn't even know how to make a JOA argument. I watched training attorneys scribble them out longhand for him to read to various incredulous members of our judiciary.

    But their litigation skills (or lack thereof) are completely beside the point. I am so sick of hearing how BHB and KFR should be in the courtroom trying cases. They both run enormous offices. They have tremendous managerial responsibilities. They don't have the time to try cases. The idea that Gabe Martin, with four years under his belt as a PD, was ready to run an office with hundreds of lawyers and support staff is ludicrous, and speaks to nothing but his own hubris. And the stated rationale for his candidacy--that of the "dissidents," he, with his Hispanic surname had the best chance of winning--smacks of precisely the type of ethnocentrism that makes Miami the cesspool of corruption and incompetence that it is.

    Now, with respect to the subject of Rumpole's post, yes, there is something ironic about the fact that dangerous criminals waltz in and out of the LOoBHB, but certain attorneys are banned. Assuming that this is true, there are still good reasons for such a ban. The 2004 election was very bitter. Given the bad feelings on both sides, BHB may have had a legitimate fear of further incidents should certain people be allowed into the office.

    Rumpole, it's high time that you gave up on this pipe dream of yours that you are a journalist. You are no such thing. You are the moderator of a blog. Your stock in trade is rumor, innuendo, and gossip. That is why people read your blog. Your post about BHB isn't any type of journalistic endeavor. It is merely an uninformed hatchet job. A journalist would have endeavored to learn the truth by speaking to both parties. You did not such thing.

    PS--apparatchik is spelled like I just spelled it. An apparatchik is an underling. The corrupt ruler to whom you refer would hypothetically rule over an apparat, or bureaucratic apparatus.     Lets assume you really are a prosecutor. You get up in the morning. Drive your used Toyota that you hate to court. Take advantage of some civil lawyer who when business was slow picked up a SA robbery and can’t do an arraignment. You get yelled at by the Judge because even if you are a DC you have no authority over any case and you get sick of saying “I have to speak with a supervisor about that” 100 times a day 5 days a week. You slink back to your cubby hole of an office and unwrap your stale tuna sandwich and curse the fact that they don’t pay you enough to live on and eat lunch out. And for fun you read this blog, and instead of enjoying it, it pisses you off because you wish you thought of it, you wish people were reading what you had to say. You think you’re smart, you think you can be witty and damn you missed another opportunity to make your name in the world. So the only thing left in your petty little world is bitterness, anger, resentment, and while you’re at it, why not threaten me with being disbarred?

    As the late, great Judge Morphonios would probably say: “Sorry pal, ain’t gonna happen. “

    I don't wish I thought of the blog because I don't consider creating and moderating a blog to be something that takes much skill or creativity. I write fiction in my free time (it's much harder than writing immature rants). And yes, I've been published.

  141. Okay, time for a recap of Rumpole's rumor-spreading to see just how little of substance we have actually obtained:

    Saturday morning (8:25:37 in the Hernandez comments), Rumpole asks for details about an alleged ban of certain lawyers from the PD's office.

    Saturday afternoon and evening (same comments section), Rumpole promises us "a good one" about "BANNED BY BRUMMER".

    Undeterred by the total lack of substantiation, Rumpole on Monday morning posts his screed against BHB. I pointed out (9:09:03) that what he published was a rumor, not facts. Since then, there have been 120 comments. NOT ONE SUBSTANTIATION OF THE RUMOR. (Sorry 9:23:37 and 11:54:05 and 11:56:23 and 12:16:49, but anonymous confirmations of an anonymous rumor ummm... lack a certain credibility).

    Rumpole, you said a while ago that you did not want to be a part of unfairly destroying a person's reputation through malicious rumors. Well, what is it that you have done with this rumor if not what you claim to abhor? Methinks it's high time for some supporting facts or a contrite and sincere apology.

    By the way, I have no particular love for BHB, just met him once, seemed like an ordinary person. I do however despise rumors whose purpose is to destroy the good name of a person. As General Westmoreland asked after a determination that he'd been libeled, "Where do I go to get my reputation back?" You may not aspire to be a journalist, Rumpole, but your words can hurt people and you should always be aware of that.

While General Westmoreland did sue to get his reputation back, the exact quote I was referring to was "Which office do I go to to get my reputation back?" and it was uttered by Ray Donovan, Ronald Reagan's former secretary of labor, after being acquitted of fraud and larceny charges. The idea is of course the same, that unsubstantiated words or charges can hurt a person's reputation when thrown about recklessly, even if those words are later proven to be untrue. But, mea culpa for the historical inaccuracy.

  148. The Martin/Richards ban was part of the settlement of the Martin/BHB post election lawsuit. BHB paid Martin. It was stipulated that Martin and Richards could no longer set foot in the Public Building now named by Bennett H. Brummer, after Bennett H. Brummer. This was the lawsuit, where BHB had to pay over $100,000)out of public money) because of his the indidents arising from BHB's campaign activities. I believe these facts were published both in the Herald and in the blog.

    While this would have been a wonderful bit of detective work, it simply is not possible. A simple check of the calendar, however, reveals the following:

    The last Friday in July (7/28), June (6/30), May (5/26), April (4/28), February (2/28), January (1/27), December of 2005 (12/30), and November of 2005 (11/25) do not qualify, as none of these Friday dates is a prime number.

    The only month that met the requirements of your "theory" was March (3/31), and there was no post from Rumpole that date (according to the archives).

    In 2006, Judge Ivan Hernandez a South Florida County Court Judge decided to ignore his duty to promote public confidence by continuing to employ his Judicial Assistant after the Judge's office was raided by the Miami-Dade State Attorney's office under a criminal subpoena. Judge Hernandez court house computer was seized in early March 2006, as part of the Miami-Dade State Attorneys Office public corruption criminal investigation against the Judge and his Judicial assistant.

    The Judge's right hand and judicial assistant also made several anti-Semitic slurs against highly respected administrative Judge Steve Leifman, because the administrative Judge had informed Judge Ivan Hernandez that he was getting numerous upon numerous complaints from litigants about the judicial assistants rudeness and obstruction of access to the court.

    Judge Ivan Hernandez who is fortunately up for re-election this year will be facing opposition for his judicial seat. O.R.J. urges all who vote this year to restore justice and remove Judge Ivan Hernandez by voting for highly respected Attorney Robin W. Faber.




    In addition to the criminal investigation Judge Ivan Hernandez, recently had a "show cause order" (writ of mandamus) issued against him by the Third District Court of Appeal, after his judicial assistant Juan D'Arce was rude and repeatedly denied a litigant access to his Court.     In 2006, Judge Ivan Hernandez a South Florida County Court Judge decided to ignore his duty to promote public confidence by continuing to employ his Judicial Assistant after the Judge's office was raided by the Miami-Dade State Attorney's office under a criminal subpoena. Judge Hernandez court house computer was seized in early March 2006, as part of the Miami-Dade State Attorneys Office public corruption criminal investigation against the Judge and his Judicial assistant.

    The Judge's right hand and judicial assistant also made several anti-Semitic slurs against highly respected administrative Judge Steve Leifman, because the administrative Judge had informed Judge Ivan Hernandez that he was getting numerous upon numerous complaints from litigants about the judicial assistants rudeness and obstruction of access to the court.

    Judge Ivan Hernandez who is fortunately up for re-election this year will be facing opposition for his judicial seat. O.R.J. urges all who vote this year to restore justice and remove Judge Ivan Hernandez by voting for highly respected Attorney Robin W. Faber.




    In addition to the criminal investigation Judge Ivan Hernandez, recently had a "show cause order" (writ of mandamus) issued against him by the Third District Court of Appeal, after his judicial assistant Juan D'Arce was rude and repeatedly denied a litigant access to his Court.     Operation Restore Justice is geared toward exposing corruption in the Florida Court system. The web site is here to expose the very rare cases in which a Judge or those under the Judge's control violate the publics trust.

    The Supreme Court of Florida has set a path of rooting out judicial wrong doing at all levels. The Supreme Court has released numerous opinions over the past few years making it clear to the general public that it will not tolerate violations of the code of judicial conduct either by a sitting judge or a candidate for judge. Recently the Supreme Court of Florida removed a judge from office because of violations of the code of judicial conduct that happened during his judicial campaign to become a Florida Judge.

    All citizens of Florida can be sure that our highest court will NOT tolerate violations of the Code of Judicial conduct at any level. Our supreme court is not shy in expressing its condemnation of any Judge who violates the public trust by not following the code of judicial conduct.

    Operation Restore Justice is under the control of a private citizen. It was due to the criminal investigation presently against Judge Ivan Hernandez and his Judicial Assistant, by the Miami-Dade State Attorneys office which has resulted in the seizure of the Judges computer under a criminal subpoena, that Operation Restore Justice was born in early 2006. In addition to complaints from numerous litigants of being denied access to Judge Hernandez court and Racial slurs by his Judicial Assistant against the administrative Judge.

    Florida has some of the best Judges in the world. We cannot let a handful of bad apples destroy the prestige of Florida's judicial system. The Supreme Court of Florida through its recent opinions has demonstrated that it will NOT tolerate judges who do not follow the code of judicial conduct.
