BROWARD 2021

Item:
North of the Border Circuit Judge Lawrence Korda insisted that a battered wife seeking a restraining order speak in English instead of her native Spanish.
''She doesn't need any translation,'' Korda said at the Dec. 1, 2005 hearing.

"She has been here 19 years. She's watched ¿Qué Pasa, U.S.A.? for 15.''

Item: County Court Judge Lee Seidman, on the shortlist for a promotion to Circuit Court has repeatedly asked traffic court defendants if they were here illegally, and in at least one case, turned over an illegal immigrant to law enforcement

What is going on North Of the Border???
We don't know, but we see where it's heading.

Indulge us in a little speculative fiction:

Its Morning in America again. And in Broward County too.

Morning calendar, South Satellite Courthouse, Broward County, 2021.

Chief Circuit Court Judge Lee Seidman makes one of his frequent returns to the Satellite Courthouse where he sat in as a lowly County Court Judge in the early part of the new century. Sediman has a fondness for the Courthouse, because it is where he made his name as America's leading anti-immigrant Judge. The publicity of having defendants arrested and deported propelled him to the position of Chief Circuit Court Judge. Today, one of Seidman's protégé’s is taking the bench for the first time, and Seidman wants to be on hand to help.

Forty four defendants and their families sit huddled close together in the modern courtroom. Only English is spoken. A few Defendants remain tight lipped.

Seidman waits in the hallway outside the back of the courtroom.

A dozen Jackbooted Officers dressed in black leather jackets and black pants march smartly up to Seidman. The Special Services section of the Broward Sheriffs Office, charged with assisting Judges "fulfill their constitutional oaths by investigating and arresting defendants” accompanies Judge Seidman wherever he goes. Known informally as the “SS”, the unit is feared by defendants for their ruthless interrogation techniques, concentrating on suspected illegal aliens who, in the language of the time "abuse taxpayers by demanding enforcement of rights reserved to US citizens."

The SS officers wear an insignia on their sleeve: a sharp red “SS” superimposed over a silhouette of Lady Liberty, which is encased in a circle with lightening bolts shooting from two opposite ends of the circle.

Before the calendar begins the SS officers walk quickly through the rows of seated defendants asking “Cheney Cards, please. Please have your Cheney Cards out for scanning.” The Cheney card is the national ID card all people in the US are required to carry. The law requiring National ID cards was enacted during the President Lynne Cheney/ Vice President Jenna Bush administration

The new Judge takes the bench and the clerk starts calling the cases on the traffic arraignment calendar.

When a Defendant named Gonzalez is called, a young woman with a small daughter walks fearfully to the podium with another person. The Judge begins an inquiry and the other person is whispering into Gonzalez’s ear.

Judge Seidman sitting off to the side, walks up to the bench.
The SS officers snap to attention and a hush falls over the courtroom.

Seidman takes the microphone and introduces himself and says he is here to help the new Judge. Sediman then asks Gonzalez if she speaks English.

The other person begins to interpret and with a small hand signal from Seidman, the SS walks over and forcibly removes the person from the podium.

In halting English Gonzalez trys to say the she speaks some Engish.
Seidman interrupts: “It appears to this court that you do not speak English. Are you a US citizen?” The woman remains silent. Seidman looks to the head of his SS Unit.

"Lieutenant Schmidt, it appears to this Court that this Defendant does not speak English and may not be a US citizen. I have taken an oath as a Judge to uphold all of the laws of the State Of Florida. By the power vested in me I hereby order you to detain this woman on suspicion of being an illegal alien."

The SS officer rushes over and cuffs the woman. The young child begins to cry: Mama…Mama.

Seidman: "Lieutenant, take the child into custody as well. If her mother is illegal, so is she. " The SS unit works quickly as both the mother and child are taken from the courtroom.

Later that morning Seidman reviews the morning calendar with his new Judge:

“44 arraignments, 3 arrests for suspicion of not being a US citizen. About average. The key is engage the Defendant into conversation. If you notice an accent, or if they don’t speak English too well, then have the SS officer in the court open an investigation. If they don’t have a Cheney
Card, have them taken into custody.”

Its Morning in Judge Seidman and Judge Korda's America again.
In Broward County.
North of The Border.
Where not speaking English is a crime.

See You In Court.

  1. Stick with Miami-Dade. There's enough going on here without having to go north of the border.

  2. Can someone start a Broward Courthouse Blog? It will make all the judges paranoid. How fun!

    ReplyDelete
  3. That's probably true...I heard some
    judges there read this blog.

    ReplyDelete
  4. What do you think about our court system (taxpayers) paying for interpreters? In most counties if the defendant needs an interpreter they have to bring one at their expense. I'm certainly not advocating that those who don't speak English should be subjected to anything like Rumps story but why should we pay for the translators?

    ReplyDelete
  5. which counties are you refering to moron?

    ReplyDelete
  6. The judges in Broward can be nut jobs.. not all of them, but, some are and Seidman is one of the worst judges I have ever tried a case before. He is real, real bad.

  7. Breaking news:

Another sitting County Court Judge has opposition. Judge McWhorter is now up against Patricia Marino, 15 years - a member of the Florida Bar.

    ReplyDelete
  8. I am sad to hear that. I and my wife know Patty Marino, but I have watched Judge McWhorter grow into being a wonderful Judge, who always tries to do the right thing, and has a great sense of humor (although she tries to hide it on the bench) I will be supporting Judge McWhorter.
And I am not writing this just because I have a DUI set before her Monday (actually I don't).

    ReplyDelete
  9. "The moron" responds... Monroe, Leon and Osceola, where I have personally tried cases do not have free translators available for defendants who don't speak English.

    ReplyDelete
  10. Whatever happened at the Muldowny hearings?

    ReplyDelete
  11. i should have called you a red neck moron. my bad.

    ReplyDelete
  12. Patti will be a much better judge than McWhorter. McWhorter is not nice, rules very heavily for the state and really needs to get a better job.

    Go PATTI!

    ReplyDelete
  13. Ouch.

    That's gotta hurt.

    With friends like Phil, ...

    :(

    ReplyDelete
  14. I like Patty Marino. and I think she would make a good judge. I just also think that Judge McWhorter is doing a fine job and does not deserve opposition. I am sure this is not a personal thing by Patty and I hope she doesn't take it personally that I think Judge McWhorter should keep her seat. I would happily support Patty for another seat, (like I'm some political hot shot...NOT) but I also understand that these seats are limited and the criteria is that people who think they can win are running to win, not because they think the judge needs to be replaced. I probably should have kept my mouth shut, but I was truly sad to see Judge McWhorter get opposition.

On another topic, I ususally agree that Broward judges tend to be a bit looney, but I had a great experience trying a murder case recently before Judge Peter Weinstein. He was kind and considerate to the point where he actually offered to have me call in for a status conference rather than drive in from Dade. I warned him that being that nice to a Dade Lawyer could get him removed from the Broward Bench.

  15. Judge McWhorter is great. She has my support.

    ReplyDelete
  16. I think Patti will make a good judge. We need someone respectful, and imparcial. Sorry, McWhorter, is time for you to go.
    Get over it Phil!!!

    ReplyDelete
  17. No more authorities at sounding hearings.

No more "Where's your client?" at soundings.

    ReplyDelete
  18. McWhorter is mean. She never smiles. She is a good target to run against.
Phil is only sucking up to her.

    ReplyDelete
  19. glazer v. miranda. i here it's official. glazer is in trouble. ive never been in front of glazer but she was less then stellar as a criminal defense atty. that said, she is a liberal dem. which is always a good thing. the word on miranda is that she is a repulican, a good prosecutor, beautiful and rich.
i think it's over for glazer.

    ReplyDelete
  20. One person wrote that McWhorter is mean and never smiles. Maybe I identify with her because my whole life people have told me I don't smile. But she is not mean. She has a good sense of humor and I have watched her treat un-represented defendants very fairly al la Judge Shelly Schwartz (who I am also going to support at his Perricone's fund raiser on March 30 or Sunny Goldin will thrash me.)

Recently the reason I don't smile is because my wife is calling me on the cell phone to tell me something else that I screwed up at the office, but other than that I am a real happy go lucky type of guy.

In all seriousness, it is not fair to say the Judge is mean because people don't think she smiles a lot. Not every Judge can crack jokes like Judge Blake. Can anyone say how she is at sentencing? I had one DUI trial before her, but luckily it never got to sentencing.

  21. GLAZER WINS, MCWHORTER LOSES, GONZALEZ WINS, LEIFMAN WINS, DEL PINO PLANAS DEL PINO WINS

    ReplyDelete
  22. PATTI MARINO WILL BE AN EXCELLENT JUDGE. IT IS ABOUT TIME SOMEONE RUNS FOR COUNTY COURT JUDGE WHO ACTUALLY REPRESENTED A DEFENDANT IN THIS COURT. WE ARE LUCKY SHES RUNNING AND I WILL VOTE FOR HER.

    ReplyDelete
  23. ANY TRAFFIC ATTORNEY WHO VOTES FOR LEIFMAN MUST BE PLANNING ON A NEW CAREER. THE WAY HE DIRECTS THE HEARING OFFICERS TO RULE IS GETTING WORSE AND WORSE. WHY WOULD ANY TRAFFIC ATTORNEY SUPPORT HIM.

    ReplyDelete
  24. Yes, Broward is a screwy place to practice. But Judge Elijah Williams is one of the kindest, friendliest judges I have ever had the pleasure to appear before. If only the other judges up there were as kind and competent...

    ReplyDelete
  25. Miranda was a member of the Federalist Society in law schoo.

    ReplyDelete
  26. Miranda is hot. Me and my di_ _ vote for her.

    ReplyDelete
  27. To the rather narow individual who wrote that we ought to support Glazer b/c "she's a liberal dem": If that's the best thing you can say about a judge (that's she in the right political party), well... Competence or affiliation? Nice Soviet-like approach; you must be an excellent critical thinker. Face it: Glazer's weak and kinda lost on the bench. Not so bad for juvy, but one day she may get called up.

    ReplyDelete
  28. Rumpy, take down the Portia poll-- the ho was a put-on. (And since its not a real woman, I can say "ho", right?)

  30. Uh oh - Leifman better watch out, the 12 traffic attorneys are not going to vote for him. Actually, I hear the minute they show up to the polls and see the cops they'll announce a change of plea (vote)

    ReplyDelete
  31. PATTI WILL BE GOOD, MCWHORTER IS GOOD. GLAZER IS AN IDIOT

    ReplyDelete
  32. Is there a love connection going on here with Phil and McWhorter? It sure seems like it. Phil I wonder how much Judge McWhorter paid you, so that you can say nice things about her. Honestly you are just about the only person that thinks she's nice.
On another note, a judge does not have to smile to be considered nice, but they do need to be respectful. That's one thing that she lacks. What comes around goes around and she is getting booted out this election.

    ReplyDelete
  33. Good luck Patti!
or may i say, Judge Marino

    ReplyDelete
  34. i did not say to vote for glazer b/c she is a liberal dem, i simply stated that that was a good thing from the perspective of a criminal defense atty.

    ReplyDelete
  35. McWhorter is one strange bird.

    ReplyDelete
  36. Judge Jeffrey Swartz used to require defendants to appear in county court, and now he's a lawyer

Judge McWhorter should stand outside the courthouse and apologize to every misdemeanor defendant who has to go through the hassle to come to the justice building to hear their lawyer get a continuance. ANd that affidavit crap - I got your affidavit - it's my damn retainer agreement.

    WHere's your client?
    Where's your client?
    WHere's your client?

find something else to say Judge.
Bench warrant practice is for judges who cant otherwise control their calendar

    ReplyDelete
  37. judge Jeffrey Swartz was an idiot on the bench and rude to attorneys thats why he is now an attorney. At least he was on the bench. Judge leifman has no division. We dont need a judge to be concerned about the mentally ill. thats the job for a social worker and we could save 100k a year. hey leifman i hear jeffrey Swartz needs a partner.

  39. Former ASA here: Miranda is nice, very smart, tried a bunch of cases and will have a nice Glamour Shot on her campaign materials. And her family is loaded and politically connected. (Her dad bought her a 911 convertible when she graduated law school.) It was quite the sight to see her shiny Porsche in the County Court SAO parking lot next to all the other ASA cars, most of which were running with bald tires, rust spots, dripping oil etc.

Only had one case with Glazer when she was in private practice and I was a juvenile ASA. She was clueless. I gave her client a sweet plea deal b/c I felt sorry for him. Otherwise I could have really hammered the 12 year old kid and had him sentenced to the maximum sentence of 13 community service hours and a 8 o'clock curfew. :)

  40. UPDATE ON CIRCUIT COURT:

We continue to have only two contested races in Circuit Court:

    Group 25

    Dennis Murphy - $1,625

    Josie Velis - $ 0000

    Group 42

    Lawrence Schwartz - $117,490
    (from 484 contributors)

    Gina Mendez - $ 0000

Judge Mindy Glazer has no official opposition and she has raised $41,568 from 217 contributors.

New reporting donations are due on March 31.

    ReplyDelete
  42. "IT IS ABOUT TIME SOMEONE RUNS FOR COUNTY COURT JUDGE WHO ACTUALLY REPRESENTED A DEFENDANT IN THIS COURT"

Pretty interesting comment - never realized that our county court bench is turning into a former civil lawyer/prosecutor bench.

Now we have former PD Hendon back, for a while.

    ReplyDelete
  43. CORRECTION ON PEDIGREES:
Hendon started in the SAO, went into private practice, then ran to the PDs office after not too long. While i like him personally, and worked with him at SAO, he's basically an empty chair. A very safe pick for Jeb to fill a slot.

Speaking of Mindy Glazer... When she ran against a sitting Circuit Judge I thought she was nuts. And the word on her was that she was a flake. I had some cases in juvie with her and my opinion changed. She is like Jeri Beth Cohen (LITE)...caring concerned and practical. Can't say how she'd do in big boy court, though.

On Judge McWhorter... I wont harp on the age-old annoyance of having your client present at soundings. But I will say leopards generally dont change their spots...and this former ASA who spent her time in Felony Screening should have stayed there. FSU lawyers dont practice law and have no clue. Ask any ASA who has to try those pieces of crap they file in Fallacious Screening. In her defense she does treat unreps with care, but your motions will be denied and she wont give you a legal basis.

I dont know who Miranda is, but if shes hot someone direct me to her courtroom so i can check her out.

  44. on friday march 24,2006 i will be filing for county court judge. i will be running against judge leifman. Yes i finally said it. I will only be running against judge leifman only. As a Jewish attorney practicing over 20 years in the community i expect to split these voters. congratulations juan gonzalez. steve you want to stab us attorneys then good luck as a private attorney. you can see how tough your decisions have been.

    ReplyDelete
  45. You will only be running against judge leifman only. Only, only, really, really?

For the record, I didn't threaten to kill that little pissant, I just told him in no uncertain terms what would happen if he came to my home and threatend me and my family again. Since that time, he's been running around south dade telling everyone that once his investigation is over, he's going to have me disbarred and put in prison. Of course I am writing about
    "I juanna be important" D'Arce.

    ReplyDelete
  54. Phil - no one in south dade matters, dont worry. And Juannabe will try to put you in prison only because he wants to be close to you.

    ReplyDelete
  55. The people on this blog including you rump are such hypocrites. For months you have been on the "its so unfair that a latin woman is running against schwartz" kick. You think Schwartz is more comptentant than Mendez and you claim he shouldnt be targeted. Personally, I dont agree with you about your evalution of their competence but reasonable minds can differ on this.
Where reasonable minds cannot differ is a race which pits Glazer vs. Miranda. There could not be a clearer race in which one candidate has actual vast serious criminal trial experience vs someone who never handled anything but an auto burglary in Juvie as a defense attorney. Yeah Yeah all your posters will say that Glazers Ok only in Juvie and Miranda is a rich ASA (by the way I am not certain that Glazer was born in a log cabin but I digress.) The idea that she is ok in Juvie is crap. All judges may one day have to go to circuit court and I cant think of anything scarier than her handling a death case( ok seeing rory stein eating a danish in the nude might be worse but I digress again). Finally how nasty is it of your readership to dismiss her a "hot and rich" while having nothing to say about her qualifications. I never remember any male judges being ridiculed becuause of thier looks. When did being rich become a crime? and besides at least this "rich" person spent her time doing public service as opposed to selling out.
Rump, If this blog has any intellectual honesty you and your readers should be writing in support of Miranda as there could not be a clearer case of comptence vs incompetence. Check out Glazers awful bar poll ratings to back this up.

Come on Rump surprise me and support a candidate who is 5 times as competent but might be a little more state oriented.

    ReplyDelete
  56. Ok, she is cute, rich, competent, state oriented, and a pain in the ass as opposition. But certainly as qualified as anyone running.

    ReplyDelete
  57. Thank you Jason for speaking the truth. You are obviously not a whiny hypocrite

    ReplyDelete

    ReplyDelete
  62. Love to see Miranda vs. Miller - he needs to go -they sent him to civil to save him -

    ReplyDelete
  63. miller gave a woman 30 years in prison for a traffic homicide. not a dui. a lady ran a stop sign killed two beautiful young ladies. after soul searching with his wife he was quoted as saying, he felt 30 years was just. shame on him, his wife and the prosecutor. and who the fuck lost that case? shame on him also.

    ReplyDelete
  64. In Group 27 of the County Court:

    Migna Sanchez-Llorens - $41,535

$30,000 of that is loans from her to her campaign. The balance, $11,535 is from 64 contributors.

She spent $25,000 on Robert Pertierra as a consultant.

    Sheldon Schwartz - $29,200

$25,000 of that is loans from him to his campaign. The balance, $4,200 is from 23 contributors.

He has spent $2,000 on Susan Fried and $2,000 on Armando Gutierrez.

New reports due on March 31st.

On a separate note, why would an attorney write in and say that are running against Liefman, state that they are filing on Friday and not sign their name to this blog. Further, they would then go and make an ass of themselves by claiming to be jewish and only running to split the jewish vote and cause the latin name to win.

Don't you readers and bloggers have more intelligence - do you really take that "anonymous" blogger seriously?!!!

Let's stick to some intelligent blogging - the other crap is so juvenile and such a waste of time.

I thought this string was going to be about how you eneter the bizarro world after the Ives Dairy Road exit. Blog tens to trail off into space like a former old-timer County Court judge after his regular 3 martini lunch. But I too digress.

I called the chambers of Judge Steven Shutter this past week and got an answering machine, outgoing message in hizzoner's voice. It went like this...

"You have reached the chambers of Judge Steven Shutter at the West Broward Regional Courthouse. So many bad guys, so little time..."

    THIS IS ABSOLUTELY TRUE!

I didn't leave my client's name or case number thonking the judge would show up at my guy's house and sentence him before trial.

  90. Re: Glazer v. Miranda...for those who have forgotten, Judge Glazer is not the only current sitting judge to have challenged an incumbent...to challenge her, just so she knows what it's like to have the shoe on the other foot, is absurd...remember, her opponent--although highly regarded and respected--had less than a third of his term to serve if re-elected...certainly, Judge Glazer took the bench with lower expectations than perhaps any judge in recent Miami-Dade County history...but she overcame those low expectations to become a rather excellent juvenile court judge...she had a low reversal rate, she had the cojones (the female equivalent) to find a juvenile not guilty where the SAO failed to prove his/her guilt beyond a reasonable doubt or failed to establish all of the elements of the charged offense, she also had no problem finding a juvenile guilty where the evidence so required, she moved her calendar yet granted continuances when necessary and proper and she treated private attorneys with more respect than most of the judges on the bench...for the record, Judge Glazer is a conservative Republican--who just happens to have a heart and a conscience...for the record, Judge Glazer is also a self-made woman who was not born with a silver spoon in her mouth and who remembers what it was like to be a sole-practioner being required to be in 3 courthouses at 1 time...in Judge Glazer's few months on the general jurisdiction division, she has presided over several jury trials and has earned an excellent reputation in that division.
