BREAKDOWN???

We regret to report that Mr. Richard Hersch has appeared to suffer some break from reality. It’s so sad to see these once proud lions in the winter of their career. Mr. Hersch also seems to think this blog is run by the oft mentioned, formerly called “he who must not be named” Brian Tannebaum. Sorry. But Mr. Tannebaum is not the one tormenting you.

Hey, I was having a senior moment and logged on to this electronic rag. First, it is spelled HERSCH, moron. Second, you can expect that Judge Newman will be the gentleman that he always is. Having recently tried a case in his division, I think that he gives pretty good latitude on introduction of evidence. In light of the subject matter presented in these source code issues, it is likely that there will be a pretty open presentation, notwithstanding the objection that the state will have to everything.Now, as for my "senior moments" I know that is you Tannebaum and if you can get permission from your mom, I will meet you at the bike racks and kick your ass.

Rumpole replies: We checked and re-checked our post Mr. Hersch and believe that we spelled your name correctly. The “senior moment” quip was ours and ours alone. Mr. Tannebaum, safely ensconced in Tallahassee, did not have his paws in that post. Somehow the thought of Mr. Tannebaum meddling in the new legislative session does not bring us much comfort. Of course, there is that old saying about not wanting to see how sausage or laws are made. As to Judge Newman, your post seems to indicate we wrote something negative about him, yet we did not. We called him a Gentleman Judge.


Finally, we have been called many things, but an electronic rag? If you want to trash us, can’t you do better than that?

Anyway, we still like you and think the drunks of Dade County who drive are in the best of hands this Thursday. We know you will do your normal great job.
(And not to add any pressure, but if you blow it, you can be sure we will print it here. Go get-em tiger.)

  4. How come people think you can only handle a misdemeanor if you do a bunch of DUIs? The best DUI attorneys also happen to be very good trial lawyers. I think the Essen folks are the only DUI lawyers who do ONLY DUI cases so, why do we see dumb comments like the one suggesting that Hersch go try a felony???

  8. If your cient does not blow, any good trial lawyer will win more then he will lose. plus, the client faces a max of 364. not a whole lot at stake when you compare a 2d. felony HO case.

  9. Well, we feel pretty confident denying we are Tannebaum. He has his own blog anyway. But in theory, you are correct, and we have never denied the various rumors floating around: Grey, Reizenstein, Reiff, Chief Judge Roberts, etc. So offically, only Tannebaum's name can be crossed off the list. We made a promise to keep the specifics of them private, but if you saw the vitriol oozing from those early emails we received from Tannebaum, when we were harassing him to post our address on the FACDL list serve, you would be quite sure we are two separate people.

  12. Rump, I'm sorry you do not feel comfortable with me meddling in the legislative session. Perhaps you should speak to some in the know, you may have a markedly different opinion. Especially after the activities in the last few days up there. You can start by reading the new version of Senate Bill 360 when it comes out.

  13. Senate Bill 360. 1) "It shall be unlawful for any defendant to mention the words "reasonable doubt" or "not guilty" in a court of law.
    2) Upon application to a district court of appeal, a circuit court judge shall be given the right to reverse a verdict of "not guilty".
    3) All laws in the state of florida shall be construed in a manner in which the lord jesus christ would have done.

    Whats a matter with that bill?

Rumpole wants to make sure everyone who reads this blog gets it. 1) Don't take yourselves or this blog too seriously. 2) If we mention your name, its usually because we like/respect you (as in the case of Mr Hersch) and if we tease you just a little, well, please take it in the spirit it was intended. To make sure no one has any mistaken ideas about this post, Mr. Hersch has not complained to us. He has held up under our wit and sarcasm very well. But a friend of his thinks we are too hard on him. For the record: Richard Hersch, Mike Catalano and Maggie Arias all are owed a debt of thanks from the defense bar in Dade County for their tireless efforts, for which they are working for free. Go get em guys!

  22. Your post got me thinking, Rump, and I need a moment away from the source code (yes, we broke ino CMI in the middle of the night and have had the darn thing for months.) Do I only have ONE friend?

    Wanted: ...friends. Must be as accepting, charming, intelligent and beautiful as my wife. Must be as engaging, fun, spontaneous and curious as my two incredible daughters (the finest children any parent could have). Must be as challenging and rewarding as my law practice. Uh...
