SHAME

Shame has fallen on Miami, the Miami State Attorneys Office, The REGJB, State Attorney Katherine Fernandez Rundle, and Third DCA Judge Bronwyn Miller.

As the Miami Herald is reporting, and all of the REGJB knew on Friday, there are a series of text messages between the State Attorney and Judge Miller.

Why is this shameful? 

Judge Miller was a prosecutor on the Corey Smith case, and Fernandez-Rundle is the elected prosecutor. And it is not as if this is any case. It is a case that has brought the Miami SAO to the edge of ruin, with disgusting stories of prosecutors manufacturing testimony, and then lying to the Court about it. 

Judge Miller, before she was a judge was part of the prosecution team, along with now thoroughly disgraced prosecutor Michael Von Zamft, who ran out of state, and may find that he has not run far enough as his misdeeds continue to be reported. This means that Judge Miller is a witness in the current Corey Smith saga. 

And of all the people on earth that maybe our state attorney should not be texting with, perhaps Judge Miller should have been at the top of that list. 

But alas, the two could not stop texting each other like a couple of misguided magpies. They texted. They gossiped. They trashed colleagues- judges and lawyers (defense attorneys in particular)- and Judge Miller speculated about the whole sordid mess being shut down by the Governor, as well as whether Judge Wolfson- who ruled against the prosecution after MVZ was caught lying- could be removed- allowing a successor judge to review all of Wolfson's rulings. 

Among other gems in the texts is Judge Miller trashing defense attorneys as having a lower standard of ethics than prosecutors. Well on that point she has us. Unlike her colleague MVZ and the office she worked for, defense attorneys have not coached witnesses to lie in first degree murder cases and arranged for witnesses in custody to be brought to a police station so they could have sex with their significant (or insignificant) others. We don't do things like that- shame on us. 

One wonders how Judge Miller ever sits on another criminal appeal, her bias towards Ms. Fernandez-Rundel's office and against defense attorneys now well established beyond what is needed for any defendant to have a well-founded fear that she cannot be fair and should be recused.

And perhaps, just perhaps, in a case where the Dade SAO has already been CAUGHT tampering with witnesses in a first degree murder case and coordinating and manufacturing their testimony- Judge Miller and Ms. Fernandez-Rundle crossed a line. 

Time will tell. 

Query: How can you tell if  MVZ is lying?  A: He's speaking.  Here's a gem from the Herald article: 

Von Zamft told the court that Miller wouldn’t speak to either side without a subpoena. By then, the texts show she had communicated with him and Fernandez Rundle, and texted about calling two other prosecutors.

Somewhere Alex Michaels is saying "I told you so."  (In his Romanian accent of course)

The texts will be analyzed and scrutinized like the Dead Sea Scrolls, or the Shroud of Tourin, or the election lawsuits of 2020. 

A special prosecutor needs to be appointed. 

A blue-ribbon commission of respected Dade Lawyers and retired judges needs to be empaneled with subpoena power to get to the bottom of this dirty mess that has broken the once proud Miami Dade State Attorneys Office. Their reputation is in tatters.  If they tell you the sun has arisen, you cannot believe them. They have no moral guidance, are running scared, and now...now...the problem may be at the very very top. And we all known what flows downhill. 

Shame.

I’m a former criminal defense attorney and I find this to be an appalling fake scandal, attack on a successful woman who has risen to the top of our legal community. The article completely misstates and mischaracterizes the actual texts which are from a former prosecutor to her former boss and who would never preside over this case on appeal. Curious as to who you think would be better than Judge Miller to handle criminal appeals on the Third for our clients as she is one of the more moderate judges. Additionally, I find it interesting that the text chains seem to be missing large chunks of texts. Maybe we should look to KFR for these missing texts. Imagine if the shoe were on the other foot on a Rule 3 and a former PD’s texts with Carlos Martinez were released - no bueno!

They don’t do the right thing LOL. Someone who knows KFR, Bronwyn, Frank Aponte, clearly just told someone that they were violating the rule during the hearing and the texts were requested. All it takes is good lawyering and people paying attention (hard to come by in Miami)…. And then the state disclosed them because they were going to be released to the media. All they did was try to get ahead of the story to try to change the narrative (and not get sued for violating chapter 119) but… too little too late

The only thing that is surprising about this is that some people are surprised. ASAs, PDs, Judges, and cops been up to this kind of stuff for such a long time.

Comical for anyone, conservative or liberal, to write a letter to the editor in support of Miller’s behavior. Unless you are going to support her trashing of Sayfie and Wolfson in text messages, don’t embarrass yourself. Unless you’re gonna support her unwillingness to speak to both sides or correct that misimpression before she testified, don’t embarrass yourself. Unless you’re gonna support her trashing of the defense bar, don’t embarrass yourself. Unless you’re going to support her directing Rundle to file a legally meritless disqualification motion of Wolfson, don’t embarrass yourself. Unless you’re going to tell Herald editors what a tremendo job their reporters did in investigating and exposing these facts, please go have a cocktail and get the sand out of your shoes.

This is the type of arrogance that comes with being a diva. Perhaps the appellate diva of Florida. Once a contestant always a contestant. These prima donnas are consumed by their own egocentrism. Their heads are filled with atrophied ideations of their stature and relevance in society, and their insatiable thirst for higher status blinds them to their supposed purpose.

Judges are human and have the right, and deserve, to enjoy life and partake just like every other mortal. But, unlike every other mortal, judges have awesome powers and responsibilities toward society as a whole, thus they must protect their metaphorical glass houses by intentionally living beyond reproach. The difference between those judges who faithfully heed this warning - like Emas, Fernandez, etc. - and those who do not is glaring obvious. The former act discretely, avoiding even the accidentally wrong assumption, while the latter are generally too intoxicated (pun intended) by the glitz, glamour and glare of the shindig du jour that the only appearance they care about comes from the reflection staring back while they retouch their mascara.

Everyone wears out their useful purpose. Our legacies are frail. Wisdom is manifested in the timing and grace of our exit. Judges are supposed to be wise. If nothing else.

Yes you can see on social media there is a pandering to write letters to the editor. Some of this is just not defensible. Trashing two sitting judges not defensible. We will see who is on the proverbial “payroll” and who will publicly sign their name to some or all of this being ok. It will probably be white privileged folks that will hide behind their money to do so.

Hmmmm didn’t see Rundle trashing our two sitting chief judges. Saw an appellate judge doing that. Assuming Rundle participated in that, it would simply have made them both guilty, it would not have exonerated miller and does not make her a scapegoat. Rundle looks pretty bad in this also. I’m sure that will come out if they don’t resolve this case quickly.

Are we really now using Tangela Sears, Parents of Murdered Children, as a pawn to do the bidding for Miller and Rundle. She speaks out of both sides of her mouth constantly. This is getting really sad folks. This is a desperate PR machine at work and it’s so transparent…. Does she understand that the death penalty needed to be waived because of the poor handling of this case? Does she understand the case is crumbling because of the poor handling of this case. Rundle’s pandering to protect her girlfriend also makes Rundle look even worse.

Yes, it is very clear that you are not a lawyer. Nothing in the text messages is exculpatory. The 3d DCA has long been recused in this case, there is no federal crime, and you should try to learn the law from something other than YouTube and google.

Sorry you don’t grasp the seriousness of this, “former defense attorney.” You must not have been privy to the status and posture of Smith’s case. The pleadings she was requesting edits on were pending IN HER COURT. She was a testifying witness on the case at the pending hearing in the trial court where her and MVZ made the representation that she refuses to talk to either party, while she’s simultaneously texting KFR… Bronwyn is passionate about this because the case MADE HER CAREER and her misconduct is going to be exposed.

Didn’t see it because it is apparent from transcripts that she deleted texts before handing them over. So we will never know the full conversation that occurred. Nothing excuses trashing our two chief judges but it seems crazy that everyone is focusing on Judge Miller and not KFR’s misconduct in all of this.

It was so great to see the state officially announce on the record they waived the death penalty. Corey has served 25 years in solitary confinement. Is that not torture enough? When will our country stop being so utterly obsessed with retribution through incarceration and execution? It’s disgusting. It’s time for the state to end the Corey Smith saga — give him CTS and send him back to the feds.

There are more texts, also calls, and not only between BM and KFR. Others too. Someone’s just gonna have to get creative, or sue, to get them.
