UPDATE: The Herald reports here that the SAO and US attorneys Office will have a press conference this morning to announce (brace yourselves) that there is DRUG TRAFFICKING (gasp) in Miami!!!
In other news, both prosecutorial offices will confirm that they are looking into reports that some people have said that some mortgages in Miami may have been falsified over the last few years.
If there's a reason why your business is slow, you can look to those criminal law "experts".

ReplyDeleteI heard about the "Rogell" motions in a small town in northern Oklahoma. Apparently, they don't make so many DUI arrests there anymore.
ReplyDeleteI had one Judge say the Cotzin motion was the most innovative piece of legal work in DUis that he had ever seen. I had another Judge in the Palm Cost call it "psychobabble". Because the very sight of the motion inflamed prosecutors I stopped filing it.

The "Cotzin Motions" actually became a dance-craze in the Polish suburbs of Detroit in the late

Cotzin was one agent's meeting away from an appearance on American Bandstand, but it all fell apart when an eerily similar dance was unearthed in West Philadelphia.
That evolved into DJ Jazzy Jeff and the Fresh Prince.

ReplyDeleteChilton New Hampshire Gilchrist just retired from the firm is was of counsel to in Seattle. He is 86 and said he wants to enjoy his golden years with his family.
In The 1960's and early 70's Chit as he was called trained just about every lawyer in the Justice Building. He worked for the SAO and the PDs-jumping back and forth for the extra 200 a year each side would throw at him. Generally when some young lawyer wanted to take a case to trial the judge would ask "Have you run this by Chit?"
Just before leaving for Oklahoma, where he was from (he was a big ol Okie- about 6'4, 240, rock solid) Chit was in a private practice and representing an insurance company. The plaintiff and his lawyer were black. As the judge called the case he asked the plaintiff's lawyer "are you ready boy?" Chit jumped in and said the lawyer should not respond until the court addressed him correctly. The Judge said something like "you watch your step son..." And then Chilton said the words that made him famous "I'm not your son and he's not a boy." The Judge held them both in contempt and the Bar filed a complaint and national media covered the incident and both the bar complaint and the contempt were dismissed.
Chilton was always chasing the extra buck until he moved back to Oklahoma and started writing oil and gas leases for his daddy's business. A few wells hit and Chit finally had the financial security he craved. One day a college friend called Chit and asked him to come out to Seattle. The friend was a lawyer in a firm and the friend's son had a new company and they needed some lawyers to work in the company. That lawyer was named William H. Gates Sr., and his son was Bill Gates and the new company was Microsoft.
Chit worked as counsel to both Microsoft from it's beginnings and the firm Preston Gates & Ellis until the firm merged with Kirkpatrick Nelson Lockhart and Graham to form K&L Gates in 2007. Chit stayed on a year or so until he finally had enough and retired recently.
Many lawyers were trained in Chilton's homespun Oklahoma manner of speaking with jurors and witnesses. Chit tried many many cases here as a PD and a prosecutor, won most, lost a few and always good naturedly called Sy Gaer his arch enemy.
I spoke to Chit a few weeks ago when he told me about his retirement (even being with microsoft from the beginning he cant use a computer so he has no email) and he asked about a lot of lawyers who are unfortunately no longer with us. He said he remembered his Miami days as some of his happiest and asked me to tell everyone that life has been good and he is looking forward to his retirement and sailing with his wife of 45 years.
One last story about his middle name: New Hampshire. Chilton had a brother and a sister. His parents had the habit of giving each of them a middle name of the state they were conceived in. Thus New Hampshire for Chilton, Vermont for his sister Adelia, and his youngest brother Porter had the unfortunate circumstance to be conceived in Mississippi. Try going through life as Porter Mississippi Gilchrist.!!!

That way we can be sure of a cleanup job on the eleventh judicial. You mentioned Judge Safie, she should have been on that wall of shame last year along with those sorry public pretenders, who work for your courts, they stand there looking cute for the audience, without the audacity to even pretend to be doing any work, stealing tax payer's dollars. Looking Cute as a Button is what I said while at a meeting last week at the Pentagon.

Too many cops feel they are above the law. Their cars block crosswalks and handicap access. Good to see that one agency is actually taken it upon themselves to police their own.
It's like a domino effect. You empower abusive police practices when you give officers a pass when it comes to respecting the same laws we must all follow. Illegally parking a police car may be a small example but the behavior escalates if left unchecked.
It is safe to say that nobody on this blog is anti-police. We need the police. But first and foremost we need for officers to abide by the laws they are sworn to uphold. In the wake of the Hollywood DUI scandal, it may be time for officers to be reminded that they too are citizens and are subject to the same laws as the rest of us.
Thanks to Jason Pensky for getting the ball rolling on this important issue.

I saw one of the last lectures Chilton Gilchrist gave to the PDs on jury selection. He said he walks right up to a juror-looks em right in the eye and asks em if they can be fair. When they say yes, he gives em a big smile and asks em if they want to sell him a bridge in Brooklyn too. Then he bellowed "common folks- you didn't come to court to find a crook not guilty. You came here as law abiding citizens right? So lets be honest-you want to vote guilty and help the police!!!" Then he was off to the races. It works. Try it.
