TABULA RASA


Sunday morning. Millions of Americans wake up, and after finishing their morning coffee or tea and ablutions, they log on to the web to see what Rumpole has to say about the upcoming football games. OK- maybe its just a few dozen or more bored attorneys in Dade, but the point is, all good things must come to an end, and thus has the 2006 football season begun to fade into memories of points scored, and over/under bets cashed.

Anyway, it’s tough enough coming up with things to say 4-5 times a week, and without football to write about, the Sunday post may well go on vacation until pre-season in August- which is 167 days away, but who’s counting?

It occurs to us that there are other voices out there waiting to be heard. We were quoted in that Channel 6 hatchet job as being a “frustrated writer in a lawyer’s suit” and there must be others so similarly situated.

Indeed, one wonders if there isn’t a robed reader among us, who sits in court, pondering the arrant nonsense and wondering what to do about it.

Now if some Judge is so inclined to write about whatever crosses their judicial mind, there are two ways to go about it:

1) Remain a mystery. It’s tougher than it sounds, and not because mindless fools will go around all day and point at your colleagues and aver in a knowing manner they are indeed the offending party. No, the real problem is that you can’t write about the real juicy stuff. Say some lawyer comes prancing into court, and for some reason they (while practicing to ascend to the bench) say something really stupid. The minute you write about it, your identity is revealed.


You see, to remain anonymous, you must become a master of deception, always on guard against revealing some tidbit that will unmask your identity. So to remain anonymous means you forsake writing about the really good stuff, as well as the minutiae of your day. However, there is probably some cannon against a judge commenting on an on going matter, so any judge who rises to the occasion will be left to write about loftier subjects- perhaps about the awnings on the front of the REGJB, or the lack of any plan for state court to adopt an electronic filing system that the feds seem to have gotten right.

2) Write under your own name. Ah, to be free from the burden of suspicion. To be able to walk down the street a free man/woman, without your picture being in the equivalent of the Au Bon Pain’s wanted section of the post office. But of course, you will be mocked by the lawyers, criticized by people who can’t even write their own name without a grammatical error, and subject to the scrutiny of the press. But if you’re creative and have something to say, you have all week on the bench, during boring voire dire and such, to work on your column.

The welcome mat is out. The blog on Sundays is a Tabula Rasa (for our robed readers, that means “clean slate”.)

  3. Rumor is that KFR is being investigated by Bill McCollum for an array of violations as well as ethical issues. This was told to me by one of her investigators. Seems that the Labor Department is also on her ass for working salary employees like hourly employees, not paying overtime as well as drinking on the job on her part.

    The Cuban American Bar Association said Tuesday that it has forgiven Miami-Dade Circuit Judge Jeri B. Cohen for a comment she made in her courtroom last month that "if we deport people back to Cuba, we could empty our jails."

    After meeting with Judge Cohen Tuesday at her request, the CABA board of directors announced that it would not file a complaint against her with the state Judicial Qualifications Commission.

    But that doesn't necessarily mean others won't file a disciplinary complaint or take other action against her.

    Last week, Judge Cohen sent CABA a one-page letter of profuse apology. On Monday evening, she met with the CABA board of directors to discuss the matter.

  7. Emails are flooding in on one particular topic: the channel 6 news story. I called the story a "hatchet job" because it claimed to identify me, based on nothing but a rumor. I could care less. But the attorney named was both angry and hurt. He sent me a series of private emails about what he believed the blog was doing to his reputation. Our first motto is, or should be- do no harm.
    And yet the very existence of the blog was hurting someone. That caused us pain, and brought us as close as we have ever been to revealing our identity.

    As always, we remained amazed that in the field of criminal justice, professionals who know better are so quick to convict someone without any substantial proof.

    So that is why the channel six story upset us- by recklessly damaging the reputation of another, we became the proximate cause of that problem (that is the right civil term, isn't it?)

    To 10:51- you seem to have time to read the blog. Why should you care what I do with my time? it's mine after all. I write it because I like to write. Not for you to read, and don't ever forget it.

    That's beautiful...I wonder though, about the "articulate" ones.

    And Oh Susannah shoulda asked somebody about the Chavez juror's statement that "they show you [the jury] the autopsy. They have to." Not if "they" weren't preying on emotions, Susannah.

    Don't rush to judgment, but it does need an expanation. maybe it was taken somehow out of context. But as a public official, it certainly needs to be looked into.

Yes, let's look into abe's statement that if it's a white on white crime, maybe the many latinos in this town that do not speak engligh and only read and watch spanish media may not have heard about it. Lets look into it because although its true and a good thought, we can spin it on this blog to make it look like abe hates cubans. Then we can talk about it for weeks, and ask for further imagniary investigations, nad trash one of our good public servants.

    I say we rather look into the recent comments about a judges homosexuality, or who it was that used the "n" word, or who said someones baby was ugly.

    Oh wait, we don't know who said that, those people weren't able to say their name.

    I cant either, because I am saying something intelligent here, and that probably angers some of the ignorant lawyers on this blog.

    I'm so happy we're trying the Couey case this week, maybe the state and national media will pick up on this blog and point out how stupid we all look.

    and the abducting, molesting, and killing of a young girl is a HUMAN issue and not one that has ANYTHING to do with race.

    The Miami Herald did a small piece back in September 2006, on the 400 million dollar scam and after the crooks attorney wrote the Herald asking for a retraction the Miami Herald went into hiding. The Miami New Times is also in hiding on this fascinating scam that scammed thousands upon thousands of investors all over the United States. Now two of the biggest law firms in Miami, Florida are cashing in on the prize. Yep, billing millions in legal fees to over see the assets while the investors sit back waiting for 50 cents on the dollar. Has the crook behind the scam been arrested? No. The Federal court has actually given him a $10,000.00 per moth allowance (he wanted $15-K).

    In one scam the crook out of Miami Beach, sold Barbara Steisand and Elton John concerts to thousands of Missouri investors and pocketed millions of dollars when no concerts ever existed. After the Missouri SEC went after the guy he quickly paid off the investors with money from investors in other states. Pyramid scam. The State of Wisconsin and Michigan also issued injunctions against him from selling illegal securities. Did he stop? NO.

Now that phony company hires agents to sell IRA’s to the pilots and in re-turn WWE issues a worthless promissory note to the phony IRA company WWE pockets the IRA money.

    In January 2006 his buddies in Louisiana file suit against him because he is no longer paying them a percentage of the scammed money. About 3-months later the SEC catches wind of the lawsuit and sues everybody and gets the Federal Court to appoint a receiver. Oh read the full story at the links so much more to this.

    Why no arrest?

    The law firm of Greenberg & Taurig representing the crooks in Louisiana and a former employed lawyer for Greenberg & Taurig representing the main Miami Beach crook. The Akerman law firm was appointed the receiver of the property and cash in the original suit brought by the Louisiana crooks. Now comes the SEC they file suit and appointment of receiver and allowed Akerman to remain the receiver. Was that a wise choice? Millions of dollars in cash and property over 400 million dollars in the treasure chest.

    Something just does not pass the smell test. Maybe its just me. Again why no arrest?

The same message to Editor Chuck Strouse of the Miami New Times. Is this because of the Millions of Dollars the crooks have available to file frivolous suits against the papers?   23. Sorry, his name is "Jack P. Utsick" was living in a 2 million dollar fully paid for condo on the 37th floor of the Portofino Towers. However, the receivers report filed in Federal Courts states they will be selling it for the benefit of the investors. He also had another 2 million dollar condo in the Portofino Towers but that one has a mortage (probally because it was used for office and under the company name in event company went under).

    I can't get over the $10-K monthly allowance the Federal court is allowing. I am sure the guy stashed money away.

    He went out and bought millions of dollars of properties theaters for the benefit of himself not the investors. To keep from being investigated he kept paying investors off using newer investors money.

Chief Judge Dale Ross taking heat from Sun Sentinel regarding comments at bond hearings.Maybe some of the comments were ?able,we are getting to the point anything said may be taken as inappropriate.Even in courts,we must remember all persons are human,not robots and computors.We all have feelings and sometimes say things not out of hate,but perhaps frustration.Sit there day after day and hear some of the comments made by witnesses,defendants and yes attorneys.Judges are no different and sometimes they make statements which are no worse than anyone else.

  42. I thank my friend at 4:57 p.m. for divining the limited purpose of my newspaper statement.

    I am a trial lawyer. If I were from another jurisdiction and my venue was changed to Miami, it would be foolish of me not to evaluate the demographics of my case and my potential audience.

    If it is a white-on white crime, and from another jurisdiction, AND:

    "it doesn't get covered on Channel 23 or Diario de las Americas, there's a CHANCE that your Hispanic jurors have never heard of it."

    With apologies to those who mis-read those simple words, it is NOT taken out of context. I did not say that all cases of that sort get no coverage in the Spanish media. I did not suggest that Hispanics were unable to read or watch the English speaking media.

    All I did was express the truth as I know it: More than 50% of Dade does not speak English as its first language. The media for those people is intended to /does carry stories for the target audience. Therefore, there is a CHANCE that one can find jurors who are not familiar with a very specific white-on-white crime (not necessarily this high profile one).

    This is also true for those in any group who are not TV viewers, radio listeners, or newspaper readers. But the question I was asked dealt with a unique situation which might occur in Dade - and I still am of that same opinion.

    Bigotry is not at issue. There is nothing to 'explain'. If you see a potential juror who looks like your victim, your first instinct depends on which side of the case you represent. If not, you know very little about human nature.

    If you want jurors who know nothing of the facts, perhaps you might seek them among those who do not frequent the mainstream media.

    That is all that I said. Sorry if any of you mis-understood.

    (To refresh your recollection Remember "will the last american leaving dade county please bring the flag " or the English as the official language issue Which caused Bnai Brith and others to get involved including the Greene family which donated money for spanish language signs at Metrozoo)

    As i understand it the mission is :

    1. the protection of of the legal rights of cuban americans
    2. the achievement of true diversity on the bench including increasing the number of hispanics african american and women on the bench
    3.rooting out and identiying racist or bigoted comments or actions by the judiciary
    4.improving the quality of the bench and helping to elect and retain the best judges
    5.helping with court issues before local and state government
    6.having great parties !

    Someone asked what makes the story different now from when it came out months ago. Answer read the 6:17 post above with links to recent court documents that provide more details on this amazing elaborate scam not included in the Herald piece.

    Great logical analysis. Try this syllogism.

    1. Socrates was a man
    2. Socrates was gay
    Therefore: 3. All men are gay, or all men are Socrates.

    Understanding that not all parts of this world learn information in precisely the same way is not some hidden form of racism. It seems like 'truth' to me.

    I barely know Abe, but he did not write about Blacks being drug users or that Latinos do not relate to the U.S. You did. All of your own hates seemed to have emerged in trying to discredit him.

  56. Look, I've posted several posts critical of Abe before; I'll never be mistaken as a personal friend. That said, the allegations about his supposedly racist comments are just plain stupid. I can't imagine anyone who's ever tried a case having trouble understanding his point.

    He is not the most agreeable guy in the world, but the man has served this community honestly and faithfully for decades, is a great trial lawyer and does the right thing even when it may hurt his career (look up the 3rd DCA opinion in Echevarria if you doubt that). He deserves our respect. If you can't give him that because he offended your puny little ego, at least hammer him for something real, not this bullshit.

  60. JB Cohen was an awful prosecutor and is now an awful judge. She is so in love with herself...huge ego. She walks into court and just looks around to make sure everyone is watching her.

    Judge denied alemony for his ex wife of 36 years of marriage.
